EXECUTIVE SUMMARY
Recommendation to approve a Second Amendment to Developer Agreement between Citygate
Development, LLC, 850 NWN LLC, and CGII, LLC and Collier County, amending the provisions
related to roadway access, street lighting requirements and transportation concurrency vesting.
(This is a companion to Agenda Item 9.A. and Agenda Item 9.B.)
OBJECTIVE: To provide unrestricted access to County-owned properties adjacent to the future
extension of City Gate Boulevard and continue the future development of the County’s public roadway
network.
CONSIDERATIONS: A Developer Agreement was approved by the Board of County Commissioners
on December 1, 2009 to improve the transportation network that serves both City Gate and the traveling
public. These improvements specifically include modifications to the City Gate development access
points and additional capacity to Collier Boulevard and Davis Boulevard.
A First Amendment to Developer Agreement was approved by the Board of County Commissioners on
June 23, 2015 to allow the County to extend and construct City Gate Boulevard North from the current
terminus to the eastern line of the City Gate DRI/PUD.
The Second Amendment will permit unrestricted access to the Resource Recovery Business Park and all
of the Collier County 305 parcel, provide a time frame for installing street lights abutting the extension of
City Gate Boulevard North, clarify verbiage related to roadway extension, and vesting all of City Gate for
transportation concurrency. The amendment removes a development restriction on Collier County 305
and continues to implement the future expansion of the County’s roadway network. The amendment is
consistent with prior Board approvals when the County acquired the Collier County 305 parcel and when
the concept of the sports park was presented.
All remaining terms of the Developer Agreement and First Amendment remain unchanged.
FISCAL IMPACT: The total cost for recording the Second Amendment will not exceed $45.00. Funds
are available in Fund 001.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: To approve the Second Amendment and authorize the Chairman to execute
the Second Amendment to Developer Agreement with Citygate Development, LLC, 850 NWN LLC, and
CGII, LLC; and authorize the recording of the Second Amendment to Developer Agreement in the Public
Records of Collier County, Florida.
