EXECUTIVE SUMMARY
Recommendation to approve First Amendment to the Agreement for Child Advocacy Supervised
Visitation with Collier County Child Advocacy Council, Inc. d /b /a Children's Advocacy Center
funded by the Department of Justice Office of Violence Against Women.
OBJECTIVE: To continue providing supervised visitation services to Collier County families.
CONSIDERATIONS: Collier County Government has partnered with the Collier County Child
Advocacy Council, Inc. d/b /a Children's Advocacy Center (CCCAC) since 2005 to administer the Safe
Havens: Supervised Visitation and Safe Exchange Grant Awards funded by the Department of Justice,
Office of Violence Against Women (DOJ). On October 23, 2012, the Board accepted an increase and
extension to the original 2009 Safe Havens grant (Agenda item 16D10). The continuation grant award is
effective October 1, 2012 through September 30, 2015. The scope of this grant includes the provision of
supervised visitation and safe visitation exchange of children by and between parents in situations
involving domestic violence, child abuse, sexual assault, or stalking.
CCCAC is the only not - for - profit agency in Collier County able to provide supervised visitation and safe
exchanges for victims of domestic violence and their children. On December 11, 2012, the Board entered
into a contract to provide these services with CCCAC which is effective October 1, 2012 through
September 30, 2015 to coincide with the grant term (Agenda item 16D10).
Adjustments to the contract are needed to include and allocate funds not fully expended in the October 1,
2009 - September 30, 2012 portion of the award, and to reallocate funds within the October 1, 2012 -
September 30, 2015 portion. The additional allocated funds within the 2012 -2015 portion of the award
includes health insurance funds not expended from the County's budget, therefore these funds were
transferred to CCCAC, as reflected in the chart below. The travel budget was reduced, and budget for
personnel /fringe was increased to reflect current program needs. Furthermore, CCCAC has requested a
clarification to the way the number of clients served is defined.
The proposed Amendment to the Agreement:
1. Amend Paragraph 5, Compensation, as follows:
COMPENSATION: The County shall pay the CCCAC for the performance of this Agreement a
total amount of
($318,995.00) Three Hundred Thirty Two Thousand Seven Hundred and Ninety dollars and
eleven cents ($332,790.11) based on allowable expenses incurred. Payment will be made upon
receipt of a proper invoice and a signed affidavit from the CCCAC Executive Director, attesting
that the work has been completed and upon approval by the County Grant Coordinator or
designee, and in compliance with Chapter 218, Fla. Stats., otherwise known as the "Local
Government Prompt Payment Act ". Collier County reserves the right to withhold and /or reduce
an appropriate amount of any payments for work not performed or for unsatisfactory performance
of contractual requirements. Budget for this Agreement is shown in "Attachment B ",
incorporated herein by reference.
2. Amend Project Narrative, Goal l Objective 1, as follows:

1. To provide visitation services for a minimum of 85 families pef yeaf (255)-+ 255
families over the three year period (minimum of 85 families a year) The same families
may receive visitation services over the three year period and if so be counted for each
year.
3. Attachment B, Budget Detail Worksheet and Narrative, is hereby deleted in its entirety and is
replaced with Revised Attachment B, Budget Detail, as attached. The chart below provides a
overview of the budget changes to include unexpended and additional funds from the 2009 -2015
portion of the award, and additional funds within the 2012 -2015 portion, as follows:

All other terns and conditions of the Agreement remain in full force and effect. The grantor did not
require prior approval to make the proposed contract changes.
FISCAL IMPACT: Funding from the Department of Justice Office of Violence Against Women under
grant award 2009- CW- AX -K011 is available in Human Services Grant Fund 707, Project 33239, and
Collier County Services for Seniors Fund 123, Project 33058. No budget amendments are required.
GROWTH MANAGEMENT IMPACT: There is no growth management impact due to this request.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board action. - JAB
RECOMMENDATIONS: That the Board approves and authorizes the Chairman to sign the First
Amendment to the Agreement for Child Advocacy Supervised Visitation between Collier County and

FIRST AMENDMENT TO AGREEMENT FOR
CHILD ADVOCACY SUPERVISED VISITATION
This Amendment, is entered into this day of I , 2014,
by and between the Collier County Child Advocacy Council, Inc. d/b /a Cliildren's Advocacy
Center of Collier County (hereinafter referred to as the "CCCAC ") a not-for-Profit Corporation,
authorized to do business in the State of Florida and Collier County, Florida, herein after to
be referred to as "COUNTY," collectively stated as the "Parties."
WHEREAS, on December 11, 2012, the County entered into an agreement with CCCAC
to provide supervised visitation and safe exchange of children by and between parents in
situations involving domestic violence, child abuse, sexual assault, or stalking. (hereinafter
referred to as the "Agreement "); and
WHEREAS, the Parties desire to amend Paragraph 5, Compensation, and replace
Attachment B, Budget Detail Worksheet and Narrative, with Revised Amendment B, Budget
Detail Worksheet, and clarify Project Narrative, Goal 1 Objective 1.
NOW, THEREFORE, in consideration of foregoing Recitals, and other good and
valuable consideration, the receipt and sufficiency of which is hereby mutuilly acknowledged,
the Parties agree to amend the Agreement as follows:
1. Amend Paragraph 5, Compensation, as follows:
COMPENSATION: The County shall pay the CCCAC for the performance of this

projects, functions, or activities, and prior written approval for those which exceed or are
expected to exceed ten percent of the current total approved budget.

Mandated training is allocated for almost all the partners in the MOU, including the CCCAC;
County Government staff training is not included in this budget. Training will be provided to
each partner based upon their educational and community needs. The numbers below are

comply with Collier County guidelines, and prior County approval must be obtained for any

1. Personnel/Fringe
The Program Director will oversee operations of the supervised visitation center, provide
supervision to the Case Managers, and conduct case reviews. The Program Director will
serve as Lead Staff member for the collaborative partnership, reporting the activity of the
center. The Case Managers will accept intake referrals, conduct intake interviews, collect
necessary reporting statistics, and prepare all reports to the court. The Program Director and
Case Managers are employed by CCCAC, and the Victim Advocate is employed by The
Shelter for Abused Women and Children. Case Managers are responsible: for scheduling and
supervising visits and exchanges. The Victim Advocate will meet directlk with victims over
the course of the grant period to assess safety, conduct safety planning, and receive feedback
regarding visits and exchanges, and serve as a liaison between the visitation center staff and
the shelter advocates, coordinating victim services. Partner agencies, Legal Aid Society,
Collier County Sheriff's Office, David Lawrence Center, and The Shelter for Abused
Women and Children, are expressly listed below under the `Consultants' sub - category. The
Collier County Sheriff's Office statutorily cannot receive any compensation for these
services, as this is within their regular scope of work. Health insurance increases occurred in
2014, and have been included over the applicable 16 month period.

3. Consultants
Training, consultation, and clinics will be provided as detailed below in`, collaboration with
the visitation program and individually as needed, with additional support activities for
individuals with disabilities, and people with limited English proficiency. iprior approval will
be obtained via GAN for any consultant costs in excess of $81.25 per hour or $650 per 8
hour day. Legal Aid Services of Collier County will provide training for partners on legal
issues affecting victims and their families. David Lawrence Center provides the Certified
Batterers' Intervention Program, and substance abuse and crisis intervention, for individuals
and partners on these issues affecting victims and their families. The grant will assist in
covering security costs for the visitation program provided by the City of Naples Police
Department, and partially funded by the CCCAC through private donations.
