AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AMENDING ORDINANCE NO. 2017-53
WHICH RE-ESTABLISHED THE COUNTY GOVERNMENT
PRODUCTIVITY COMMITTEE, ELIMINATING THE REQUIREMENT
FOR STAGGERED TERMS OF OFFICE; PROVIDING FOR CONFLICT
AND SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF
LAWS AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, on December 12, 2017, the Board of County Commissioners (Board)
adopted Ordinance No.2017-53,re-establishing the County Government Productivity Committee
(Committee)to review the efficiency of departments of County government under the jurisdiction
of the Board; and
WHEREAS, Section Three of Ordinance No. 2017-53 requires the terms of office of the
Committee members to be staggered, which comports with Ordinance No. 01-55, as amended,
"Standards for Creation and Review of County Boards;"and
WHEREAS,after due consideration the Board has decided that it does not wish to stagger
the terms for this Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that:
SECTION ONE: Amendment to Section Three of Ordinance No.2017-53.
Section Three is hereby amended as follows:
SECTION THREE: Terms of Office.
The initial terms of office of the Committee members and each appointment or re-
appointment thereafter shall be as-follews:for two (2)years.
A. Three (3)of the District members shall serve for one (1)year.
B. Two (2) of the District members shall serve for two (2)years.
C. The at large members shall serve for two (2) years.

member of the Committee may be re-appointed by the Board of County Commissioners for one
(1) successive term; however, other qualified applicants may be considered for any vacancy.

Appointments to fill any vacancies on the Committee shall be for the remainder of the unexpired
term of office.
SECTION TWO: Exception to Section Seven of Ordinance No. 01-55, as amended.
This amendment is intended to be an exception to Section Seven of Ordinance No. 01-55,
as amended, which requires staggered terms of office for County Boards.
SECTION THREE: Conflict and Severability.
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any court of competent jurisdiction holds any
phrase or portion of the Ordinance invalid or unconstitutional, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION FOUR: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and may be made a part of the Code of
Laws and Ordinances of Collier County,Florida. The section of the Ordinance may be renumbered
or re-lettered to accomplish such, and the word "Ordinance" may be changed to "Section,"
"Article," or any other appropriate word.
SECTION FIVE: Effective Date.
This Ordinance shall take effect upon filing with the Florida Department of State.
PASSED AND DULY ADOPTED by the Board of County Commissioners of Collier
County, Florida, this I 34 day of March, 2018.
