EXECUTIVE SUMMARY
Recommendation to authorize the County Attorney to file a lawsuit on behalf of the Collier
County Board of County Commissioners against Michael H. Chalfin and Tyler R. Chalfin
in the County Court of the Twentieth Judicial Circuit, in and for Collier County, Florida,
to recover damages for the repair of a County vehicle and a County road sign in the
amount of $7,348.79, plus costs of litigation.
OBJECTIVE: For the Board of County Commissioners to authorize the County Attorney to file
a lawsuit against Michael H. Chalfin and Tyler R. Chalfin in the County Court of the Twentieth
Judicial Circuit, in and for Collier County, Florida, to recover damages for the repair of a County
Vehicle and a County road sign in the amount of $7,348.79, plus costs of litigation.
CONSIDERATIONS: On March 17, 2014 a vehicle owned by Michael H. Chalfin was being
operated by Tyler R. Chalfin in a southerly direction on Santa Barbara Boulevard in Collier
County. As this vehicle approached the intersection with Golden Gate Parkway, traveling at an
excessive rate of speed, Tyler R. Chalfin ran the red light and drove into the County's vehicle
that had turned right from Golden Gate Parkway onto Santa Barbara Boulevard heading south,
causing damage to the County's vehicle and a County road sign in the amount of $7,348.79.
Although payment for these damages was requested on numerous occasions, the Chalfins have
refused and continue to refuse to pay them. The County has no other recourse for recovery of
the costs than to proceed with litigation.
FISCAL IMPACT: Funds are budgeted and available in the Risk Management Property &
Casualty Fund.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this item.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and
requires a majority vote for Board approval. - KN
RECOMMENDATION: That the Board of County Commissioners authorize the County
Attorney to file a lawsuit on behalf of the Collier County Board of County Commissioners
against Michael H. Chalfin and Tyler R. Chalfin in the County Court of the Twentieth Judicial
Circuit, in and for Collier County, Florida, to recover damages for the repair of a County vehicle
and a County road sign in the amount of $7,348.79, plus costs of litigation.
