9/23/2014 16. H .1. EXECUTIVE SUMMARY Recommendation to appoint two members to the Pelican Bay Services Division Board OBJECTIVE: To appoint two members to the Pelican Bay Services Division Board to fulfill vacant terms expiring on March 31, 2017 and March 31, 2018. CONSIDERATIONS: This 11 member Board was established by Ordinance 2002 -27, as amended, to provide input to the Board of County Commissioners (BCC) in carrying out the purposes of the Pelican Bay Municipal Service Taxing and Benefit Unit as set forth in the Ordinance, and to recommend to the BCC an itemized budget, work programs, and priorities in accordance with the adopted budget or budget amendments. The Board will exercise decision and control of the day to day operational affairs of the Unit to the maximum extent allowed by law, unless and except when there is some overriding governmental reason to do otherwise. A list of the current membership is included in the backup. One of the members, Mr. Frank C. Dickson, has passed away, and another, Mr. John Domenie, has resigned. Concerning filling vacant positions on this Board, the Ordinance (Municode Version) provides in relevant portion as follows: "Sec. 122 -1662. - Composition, nomination and appointment Any member of the PBSD Board who ceases to meet the requisite qualifications during his or her term of office shall immediately advise the Board of County Commissioners in writing of such change in status. Upon the Board of County Commissioners receiving such notice, otherwise becoming aware of such vacancy, or if a vacancy occurs by any other process, the Board of County Commissioners shall declare the position to be vacant and shall promptly consider filling the vacant position with a person from among the unsuccessful candidate(s) vying for the position from the immediately preceding recommendatory balloting that receives recommendation from the PBSD Board. In the event the PBSD Board should fail to provide its recommendation to the Board of County Commissioners within 20 days of the Board of County Commissioners being informed of "member's change in status ", the Board of County Commissioners shall appoint the recent unsuccessful candidate that received the greatest number of votes among those unsuccessful candidates. In the event that there are no prior unsuccessful candidates available for appointment to the PBSD Board as provided herein, the vacant position shall be filled pursuant to the procedures of Collier County Ordinance No. 2001 -55, including as may be amended or its successor ordinance." For the most recent appointments in 2014, no election was required to be held as not enough applications were received. Visosky I Resident 1 185 1 However, the PBSD Board decided that this 2013 election was held too far in the past to be relevant for the purposes of filling the current vacancy, and requests that the BCC fill these vacancies pursuant to the procedures of Ordinance No. 2001 -55, as amended. At their meeting on September 3, 2014, the PBSD Board voted unanimously to recommend that Ken Dawson be appointed to fill the vacancy created by Mr. Domenie's resignation. FISCAL IMPACT: None. GROWTH MANAGEMENT IMPACT: None. RECOMMENDATION: That the Board of County Commissioners considers the recommendations for appointment, appoints Ken Dawson and Henry Bachman to fulfill the remainder of vacant terms expiring on March 31, 2017 and March 31, 2018 respectively, and directs the County Attorney to prepare a resolution confirming the appointments. I am going onto 86 and as someone stated: "Getting old is no fun; but what are the alternatives ? ". The alternative of course revolves around medical help. These health problems have not diminished and I find that a good part of the day is devoted to doctor visits, tests, etc. And now Maida's eyesight has suffered even more, so that she can not distinguish depths of field and hence should not be driving. This means that I need to drive her to all her medical & shopping trips. Although I try to schedule appointments in the morning, this is not always possible, and hence these start to interfere with having me attend PBSD meetings. Here - at home - I have a plaque dated July 2008 given to me by the PBSD "thanking me for the outstanding and dedicated service for the past 9 years ". Since then I have served at least three more years, so that I feel I have "served my time ". At the turn of the century our problems revolved around the 10 Year Permit, cat tails, etc. Now the work has become much more "technical" involving pollution in the 64 lakes and the Clam Bay System. 1 find that i am not fully conversant with such terms as: Ammonia; Ortho-Phosphates; Organic Phosphorus; Nitrogen; Nitrates and Nitrites; Dissolved Oxygen; Copper sulfate vs Copper in the Sediment; etc. Younger minds are better at understanding the effects of these products on our waters. Under these circumstances I hereby submit my resignation as a member of the Board of the Pelican Bay Services Division. In closing I would like to make two comments: The Budget Committee which has been under the outstanding leadership of Mike Levy will be losing three of its members - it will be critical to begin training someone to take over this position as there will be a major turn over in personnel in this Committee. In the past the PBSD has produced two great DVDs: "Jewel of Pelican Bay" and "Water Runs Through It". I feel that it would be an excellent idea if you were to consider another DVD. It could start with aerials of the Naples Coastline - before development and after built up. It would show what the developers of PB considered before starting construction: saving the mangrove estuary and developing a system of lakes, pipes, swales and weirs to control the waters. It could then show how the lakes in each system slowly release the waters "downhill" until the waters reach east of the berm. We could show how lake embankments are being "reinforced" to protect against erosion, and what steps have been taken to limit the amount of pesticides and fertilizers Packet Page -3317- 9/23/2014 16.H.1. being used in the green spaces. A scene showing a lawnmower cutting grass along the edge of a lake and casting the cuttings in the lake could be compared with a scene of litoral plantings. Such a DVD would be shown at events at the Community Center and at association meetings - and would show the EPA (and the BCC) what steps we are taking to protect the environment. It would be part of the education line in our Budget. By the way, it has been suggested here (The Breakwater) that we use the plants from the floating islands to create litoral borders once their use on the floating island has ceased. I would like to thank all Board members - past and present who have dedicate time and effort to fulfill their responsibilities.
