EXECUTIVE SUMMARY Recommendation to approve proposed revisions to the Construction Standards Handbook for Work Within the Public Right -of -Way, relating to performance bonds for improvements in the public rights -of -way, and certain cosmetic revisions, and to allow staff to further amend the Handbook for future Board consideration. OBJECTIVE: To obtain Board of County Commissioners (Board) approval of proposed revisions to the Construction Standards Handbook for Work within the Public Right -of -Way ( "Handbook "), relating to bonding requirements for improvements in the public right -of -way and cosmetic revisions, and to obtain Board approval for further changes not previously authorized. CONSIDERATIONS: On April 8, 2014, under Item 1 LE, the Board reviewed various aspects of permitting for improvements in the public rights -of -way. Following a discussion on the item, the Board directed staff to take appropriate action to address liability concerns for major projects for improvements in the public rights -of -way. As a result of this direction, staff prepared proposed revisions to the Construction Standards Handbook for Work within the Public Right -of -Way (Handbook). The proposed revisions would update the Handbook's existing provisions relating to performance bonds, by establishing thresholds for posting of such bonds. Under these updated provisions, any improvement project in the public right -of -way that exceeds $250,000 will require a performance bond. Every project in excess of $500,000 would require a performance bond and a Board- approved agreement. An exception for utility companies and franchisees with established uses within the public right -of- way would allow these entities to submit a blanket performance bond, in lieu of the new bonding requirements, to cover maintenance and repairs. During the course of preparing revisions to the Handbook, it became apparent that the Handbook will need further revision for consistency with current standards. Some obvious cosmetic revisions are included in the proposed update (e.g., references to the Transportation Services Division have been updated, basic definitions added), and further revisions remain. Board approval of these further revisions to the Handbook is also being requested. These proposed revisions were presented to the Development Services Advisory Committee (DSAC) on May 7, 2014. After reviewing the proposed revisions, the DSAC voted unanimously in favor of forwarding the proposed revisions to the Board for approval. FISCAL IMPACT: None. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. PURPOSE This Construction Standards Handbook for Work within the Public Right -of -Way (the "Handbook ") regulates the location, manner, installation, and adjustment of all work performed within the right -of -way of the Collier County roadway network. The issuance of permits for such work is in the interest of capacity, safety, protection of existing facilities, ease of maintenance, and future development of the roadway network. This Handbook provides standards, procedures, and guidelines for construction and ; S'nance within the public right -of -way that are in the best interests of and for the protection of the public. The applicant shall submit one complete application form titled "Right -of -Way Application" to Perform Work and /or Maintenance in Public Right -of -Way, to the County for its approval, with all the required information on the permit filled in. 2.
