Continue Item 16A30 to the October 14, 2014 BCC Meeting: Recommendation to authorize the
Director of Transportation Engineering to execute Standard Zero - Dollar Construction Agreements with the
State of Florida Department of Transportation acting as the Construction Coordinator for Collier County to
ensure that all improvements constructed through the FDOT permitting process within the State right -of-
way comply with FDOT standards and conditions. (Staffs request)

EXECUTIVE SUMMARY
Recommendation to approve a Resolution authorizing the County Manager to designate an official
to provide signature authority on behalf of the County for Resources and Ecosystem Sustainability,
Tourist Opportunities, and Revived Economies of the Gulf Coast States Act of 2012 (RESTORE)
grant applications submitted through the federal GrantSolutions online grant management system.
OBJECTIVE: To receive delegation of authority from the Board of County Commissioners
(BCC) for the County Manager to designate an official to sign and authorize RESTORE Program
grants.
CONSIDERATIONS: Collier County has been identified as one of 23 Florida Gulf coastal
counties to be impacted by the Deepwater Horizon oil spill of April 2010, and is therefore
eligible to receive grant funding through the federal RESTORE Act. The amount of funding
may be significant, but depends on civil penalties yet to be settled with parties determined
responsible for the accident. The funding estimate for Collier County has been reported to be
between $5 million and $20 million. On August 15, 2014, the U.S. Treasury Department has
published an interim final rule to administer the grant program. The interim final rule specifies
that Collier County's allocation is 7.019 %. As of June 30, 2014, $772,985 has been deposited
into the Trust Fund for Collier County. Comments on the interim final rule are due within 30
days of the date of publication and the Interim Rule will become final 60 days (est. October 15,
2014) after publication.
In anticipation of the final rule, the Treasury Department has requested the County to provide
individuals who will be responsible for entering/submitting and authorizing grant applications in
the GrantSolutions online grant application and management system managed by the U. S.
Department of Health and Human Services. GrantSolutions.gov is a web -based system through
which applications will be submitted and awards will be managed for the RESTORE Act grants.
Staff has already provided Treasury with individuals who do not need BCC authorization.
The Authorizing Official who is responsible for signatory authority for grants must be the BCC
or the BCC's designee adopted by Resolution. Staff has prepared the attached Resolution to
allow the Authorizing Official be the County Manager's designee on behalf of the BCC.
FISCAL IMPACT: There is no fiscal impact with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and
requires a majority vote for Board approval. -- SAS
GROWTH MANAGEMENT IMPACT: There is no growth management impact with this
action.
RECOMMENDATION: Recommendation to approve a Resolution authorizing the County

A RESOLUTION BY THE COLLIER COUNTY BOARD OF COUNTY
COMMISSIONERS AUTHORIZING THE COUNTY MANAGER TO DESIGNATE
AN AUTHORIZING OFFICIAL TO PROVIDE SIGNATURE AUTHORIZATION
FOR SUBMISSION OF BOARD APPROVED RESOURCES AND ECOSYSTEM
SUSTAINABLITY, TOURIST OPPORTUNITIES, AND REVIVED ECONOMIES OF
THE GULF COAST STATES ACT OF 2012 ( "RESTORE ACT ") GRANT
APPLICATIONS THROUGH THE FEDERAL GRANTSOLUTIONS ONLINE
COMPREHENSIVE GRANTS MANAGEMENT SYSTEM.
WHEREAS, the Board of County Commissioners of Collier County is the governing body
in and for Collier County, Florida, a political subdivision of the State of Florida; and
WHEREAS, under the RESTORE Act (title I, subtitle F of Public Law 112 - 141), eighty
percent of the administrative and civil penalties related to the 2010 Deepwater Horizon Oil Spill
will be deposited into the Gulf Coast Restoration Trust Fund ( "Trust Fund "), and will be
available through grants for programs, projects and activities that restore and protect the
environment and economy of the Gulf Coast region;
WHEREAS, Collier County ( "County ") will be allocated a portion of the Trust Fund's
"Direct Component," which sets aside, thirty -five percent of the penalties for eligible activities
proposed by Alabama, Mississippi, Texas, Louisiana, and twenty -three Florida counties;
WHEREAS, the U.S. Treasury Department ( "Treasury ") is responsible for issuing
compliance and .auditing procedures for the entire RESTORE Act, and is responsible for
administering the Direct Component grant program;
WHEREAS, on August 15, 2014, the Treasury published a new Interim Final Rule in the
Federal Register for Gulf Coast states and municipalities to receive funding for environmental
restoration and economic development projects under the RESTORE Act grant programs, and a
Final Rule is expected to be published following a public comment period;
WHEREAS, while the RESTORE Act rules are being finalized, the Treasury has
recommended that Collier County enroll individuals, or "points of contact," who will be
responsible for preparing, submitting and authorizing the County's grant applications in the
federal GrantSolutions online grant application and management system;
WHEREAS, the Treasury requires at least one individual to be enrolled as the "Authorizing
Official" who will be responsible for providing signature authority on behalf of the County for
all RESTORE Act grant applications submitted through the GrantSolutions online system.

WHEREAS, Collier County desires to authorize the County Manager to designate an
"Authorizing Official" to submit Board of County Commissioner approved RESTORE Act grant
applications through the GrantSolutions online system.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners,
Collier County, Florida, that:
I. Authorization to Execute and File Applications. The County Manager is hereby
authorized to designate an "Authorizing Official" to submit Board of County
Commissioner approved grant applications on behalf of Collier County for grant funds
authorized by the U.S. Treasury Department's RESTORE Act Direct Component grant
program, through the federal GrantSolutions online grant application and management
system.
2. Authorization to Make Minor Required Updates or Modifications to Grant Applications:
The designated "Authorizing Official" is hereby authorized to make minor required
updates or modifications to RESTORE Act grant applications submitted through the
federal GrantSolutions online grant application and management system.
3. Effective Date of Resolution. This Resolution adopted after motion, second and majority
vote favoring same, this day of 12014.
