EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign the Utility Facilities Quit-Claim
Deed and Bill of Sale between Collier County and Avalon of Naples, LLC, in order to reconvey to
Avalon of Naples, LLC, a portion of the potable water and sanitary sewer utility facilities associated
with the development at Avalon of Naples, PL 20160002356, which were previously erroneously
conveyed to the County.
OBJECTIVE: To correct the erroneous conveyance of certain potable water and sanitary sewer utility
facilities to the County for the Avalon of Naples development project.
CONSIDERATIONS: The purpose of the Utility Facilities Warranty Deed and Bill of Sale from Avalon
of Naples, LLC, recorded on March 10, 2017, at OR Book 5371, Page 822, was to convey only the
portion of the potable water and sanitary sewer utility facilities located within the Deed of Utility
Easement, recorded on March 10, 2017, at OR Book 5371, Page 829, to the Board of County
Commissioners (BCC) of Collier County, Florida. However, the Warranty Deed and Bill of Sale
erroneously conveyed facilities over a much larger legal description.
These conveyance documents were recorded after preliminary acceptance of the utility facilities for the
project, in accordance with the Utility Facility Standards and Procedures Ordinance No. 2004 -31.
However, prior to Avalon of Naples, LLC requesting the Board of County Commissioners final approval
and acceptance of these utilities facilities, the Development Review Division discovered that the recorded
Utility Facilities Warranty Deed and Bill of Sale erroneously included all of the potable water and
sanitary sewer located within the Avalon of Naples development project. Therefore, the attached Quit-
Claim Deed and Bill of Sale will reconvey all of the potable water and sanitary sewer utility facilities that
are not located within the utility easement, back to Avalon of Naples, LLC.
Avalon of Naples, LLC is aware of the error and has agreed to accept reconveyance of these utility
facilities.
FISCAL IMPACT: There is no fiscal impact associated with this action.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval - SAS
