EXECUTIVE SUMMARY
Recommendation to approve the conveyance of a utility easement on County property to the City of
Naples for utility services at the Gordon River Greenway Park.
OBJECTIVE: To convey infrastructure and a utility easement to the City of Naples to allow it access
for ownership, maintenance and service of utility infrastructure serving the Gordon River Greenway Park.
CONSIDERATION: The Parks and Recreation Department is constructing the Gordon River Greenway
Park. Within the projected scope of work, the project included the installation of new irrigation quality
water lines to make connections to the City of Naples' main on Goodlette-Frank Road.
The City of Naples Utilities Department currently provides the utility services in the area and will be
providing the utility services to the Gordon River Greenway Park. As a condition to providing these
services, a Utility Easement must be conveyed to the City of Naples to allow it access for ownership,
maintenance and service.
Location of these lines is identified on the Exhibit attached to the Utility Easement.
FISCAL IMPACT: The total cost for recording the Utility Easement will not exceed $20. Funds in the
amount of$20 are available in the Parks & Recreation Department Capital Improvement fund 306 under
Project 80065.1.
GROWTH MANAGEMENT IMPACT: No Growth Management impact is associated with this
action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for approval.—JAB
RECOMMENDATION: That the Board approves the Utility Easement; authorizes the Chairman to
execute the aforementioned document; and directs the County Manager or his designee to proceed to
follow all appropriate closing procedures and record the aforementioned document in the Public Records
of Collier County, Florida.

UTILITY EASEMENT
THIS UTILITY EASEMENT, made and entered into this day of
2014, by COLLIER COUNTY, a political subdivision of the State of Florida, whose post
office address is 3335 East Tamiami Trail, Suite 101, Naples, Florida 34112, hereinafter
referred to as "Grantor", to the City of Naples, a municipal corporation of the State of
Florida, its successors and assigns, whose post office address is 735 8r" Street South,
Naples, Florida 34102,hereinafter referred to as "Grantee".
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its
successors and assigns, a perpetual,non-exclusive easement,license, and privilege for
utility purposes, on the following described lands located in Collier County, Florida, to
wit:
See attached Exhibit"A"which is incorporated herein by reference.
Subject to easements,restrictions, and reservations of record.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to
enter upon said land, excavate, and place or remove materials for the purpose of
constructing, operating, and maintaining utility facilities thereon. Grantor and Grantee
are used for singular or plural,as the context requires.
IN WITNESS WHEREOF,the Grantor has caused these presents to be executed the
date and year first above written.
