Environaental Science and Pollution Control Director Lorenz
requested the continuance and expansion of services of the former ad-
hoc Ground Water Protection Technical Advisory Committee by creating
another such committee and appointing its members.
Mr. Lorenz
indicated that the purpose of the committee is to assist in the deve-
lopaent of a comprehensive well construction regulatory program: to
assist in dratting a comprehensive ground water protection ordinance:
to provide technical assistance to County statf during the wellfield
computer aodelin; program: to provide Opportunities tor public
input to the development of the ground water protection ordinance and
to provide public education on the critical need for aquifer and
wellfield protection.
He stated that due to the resignation of Dr.
Gregg Brooks, he is recommending the appointment of Steve Means to
fill the vacancy.

Water Management Director Boldt stated that Agnoli, Barber «
Brundage Inc. prepared a Preliminary Engineering Study tor the Naples
Park Drainage System.
Mr. Boldt referred to the general overview of
the Study delineated in the "Briet Suaaary Sheet".
He advised that to
the South is the 8th Street Drainage tor which an 84 inch pipe
enclosure i. proposed: a 30-72 inch pipe enclosure is proposed from
91st Avenue to 100th Avenue with a total estiaated cost of $1,950,000.
He noted that estiaate~ cost involves iaprovements to the outtall north of
I11th Avenue and totals approxiaately $100,000: improvements to 8th
Street froa 101st Avenue to I11th Avenue, includes enclosing the open
drain sy.tea with 24-84 inch pipes.
In regard to the Vanderbilt Lagoon Drainage Basin, Mr. Boldt
stated that the proposed improvements include the installation of 38 -
18 inch and 24 inch street culverts: the approximate cost is $360,000.
Mr. Boldt summarized the Improvements to the Secondary System by
stating that the study indicated that reworking 25-3S~ of the roadside
swales and existing culverts in critical areas would result in an
estiaated cost of $2 million, however, public input pertaining to this
iaproveaent is necessary at some future date.
He noted that imposing
curtailaent of the practice of enclosing swales across lot trontages
would also have to be considered at a tuture date.
He indicated that

the Waples Park area would be benetiting trom the recoamended impro-
Vements; the initial study was funded by an MSTU, and Start recommends
that the Connor's Vanderbilt Beach Estates be removed trom the Special
Asses...nt Taxing District since they will not be receiving any signi-
ficant benetits: however the Pavilion/Beachwalk area will be receiving
ainor benetits, and, therefore, should be included in the proposed
district.
In order to fund the prop~~~~ project, Mr. Boldt indicated that
the Taxing District could be continued, or a Special Assessment
District could be set up based on tront footage, flow rate, square
footage, cost per individual basin, or cost per combined basins can be
iapleaented.
Be further indicated that Staff recoaaends that the cost
spread be combined among the three basins involved based on parcel
and equivalent areas along the commercial strip along U.S. 41 and
Pavilion/Beachwalk.
Be noted that Staff proposes to have a series of
workshops with the affected residents to collect input, thus con-
sidering the adoption of an ordinance to create the Naples Park
Special Drainage Assessaent District.
Mr. Richard Wood, resident ot Naples Park, stated that h. sup-
ports the Naples Park Drainage Prograa, but has reservations on the
method ot funding.
Mr. Wood asked if the Growth Management Plan
proposed $26.9 million drainage bond prograa includes the Haples Park
area?
Public Works Administrator Archibald responded that the study
conducted identified the Naples Park area as a benefitted area, and

was not presently included in the bond program.
Mr. Archibald stated that after public participation in the
proposed workshops to b. held in Kaples Park, staff will be able to
determine implementation and tinancing ot the drainage improvements.
Mr. Archibald clarified for Coaai8sioner Saunders that all County
residents would be taxed equally under the utility tax system,
however, if the prograa was conducted by "basin" for those benefitted,
assessaents would be initiated once.
Mr. Archibald confirmed for Coaai8sioner Hasse that the Growth
Management Plan has identified a series of improvements primarily to
the Lely Ba8in.
Mrs. Lorene Wood and Mrs. Lucy Veccia stated that they concur with
the study. and are hopeful that the proposed improvements to the
Kaples Park Drainage District will proceed as scheduled.
Kaples Park resident Robert L. Nilson, stated that he, too, con-
curs with the study as it will be advantageous and will create a pro-
pitious effect to the area.
Due to adverse flooding conditions, and the inconspicuous 92nd
Avenue outtall ditch, Hr. David Borden 8uggested that the proposed
study be implemented, and another Special Assessment Taxing District
be established to fund the engineering aspect of the project.
Co..issioner Pi.tor stated that the implementation ot another
taxing district was not budgeted for in the budget: Mr. Archibald con-

dents responded positively to the imple.entation of such a district,
staff would draft an ordinance to that etfect and present it to the
Board for their approval.
In response to Coaaissioner Pistor, Mr. Archibald indicated that
the County has aade improvements to the 8th Street and 91st/92nd
Avenue outtalls by installing drainage pipes to increase the capacity
of the outfalls.

Mr. Huber noted that on March
22, 1988, the Board directed that an Econoaic Study be conducted to
determine fair share payment based on benefits derived tor the Marco
Island Beach Renourishaent Program.
Mr. Huber noted that subsequent
to the atoreaentioned, the Board approved the selection ot Regional
Research Associates, Inc. on june 7, 1988 to perform the study, and

authorized staff to negotiate a contract with same.

He indicated that
in the process of negotiation and preparation ot the contract docu-
aents, the question of "Analysis of eligibility tor Federal and State
Funding for the project" arose.
He stated that two options are
thereby presented for consideration: one is -Exhibit A" which includes
the latter, and the other option is -Exhibit B" which does not.
He
requested that the Board approve the Agree8ent tor Professional
Services with Regional Research Associates, Inc. and designate the
inclusion of an "Exhibit", as previously described.

Marco Island residents?
Mr. Huber advised that he contacted several
residents, and Mr. Archibald had advised the Advisory Committee that a
public hearing was scheduled to discuss the issue in question.
CØ88issioner Pistor stated that he preferred the inclusion of eli-
gibility ot Federal and State funding, "Exhibit A-, and advised that
work CO88enced last week.
Mr. Steve LeBrie, representing Citizens for Sensible Marco Beach
Iaproveaent, presented the Board with a letter which expressed his
views on Staff's recomaendations of the Economic Study conducted by
Regional Research Associates, and the Board's efforts ot obtaining
State and Federal tunding to renourish County beaches.

Public Works Administrator Archibald stated that a threshold
inspection is required for the Health and Public Services Building
according to Florida Statute 553, adding that the Statute requires
that the owner provide for threshold inspection ot all building 8truc-
ture coaponents by a certified inspector.
He stated that Staff is
reCO88ending that an eaergency be declared and the bidding process be
waived in order to avoid delays in any construction activities.
He
stated that the firm ot .7enkins« Charland, Inc. is being recommended
subject to tinal approval of the contract by the County Attorney and
the Risk Manager.
Co..i.sioner Pis tor questioned why the BUilding Department could
not perform this inspection, to which County Manager Dorrill stated
that as the result of a recent Florida Statute, the owner is required
to contract tor a threshold inspection above a certain nuaber of
stories.
He noted that this type of engineering service has nothing
to do with building code inspections.

Public Services Administrator O'Donnell stated that this item is
to approve a Meaorandua of Understanding for $200,000 that has been
appropriated by the Legislature to help with construction ot the
Agriculture Center.
He noted that they were asked to appropriate
$300,000 but the Legislature agreed to $200,000 and the Department ot
Agriculture has agreed to advance the $200,000 which will be deposited
in a separate account and aay be invested.
He indicated that all
investaent earnings shall be returned to the Department of Agriculture
and Consuaer Services.
He noted that the money from the Legislature
will help reduce the cost ot construction and there will be an oppor-
tunity to go back to the Legislature next year and request additional
funds 80 long as the initial $200,000 is being expanded and progress
is being aade toward the construction of the building.
He indicated
that an architect has currently been contracted with tor the design of
the building and site excavation work is already underway.
He noted
that the Florida Departaent of Agriculture and Consumer Services does
not have any specific requirements in regard to building design, con-
figuration or size, but does require these monies to be expanded only
for the design and construction ot an Agriculture Center in Collier
County.
He stated that he is requesting approval of this Memorandum
of Understanding Agreeaent.

Public ServiceD Adainistrator O'Donnell stated that he is
requesting that this bid be rejected a. they came in $300,000 over
what was expected.
He noted that Wilson, Miller, Barton, SolI «Peek,
Inc. reviewed the bids and have reco...nded that they be rejected as
they feel that they are inadequate and do not meet the requirements.
He indicated that he is asking that the project be re-bid.
Coaaissioner Pistor stated that he understands the reason for
rejecting this bid, but questioned how much of a delay this will make
on the opening of the park, to which Public Services Administrator
O'Donnell stated that this would delay the opening by about two

Co..issioner Saunders questioned if the Parks and Recreation
Advisory Board has reviewed this matter and if their recommendation is
to reject this bid, to which Mr. O'Donnell replied affirmatively.

Public Services Administrator O'Donnell stated that this item is
to advise the Board that the Park Ranger has completed the 40 hours ot
certification which would allow hi. to operate as a Park Ranger.
He
noted that rules and regulations regarding codes tor the parks will
need to be changed and he is asking that Statt work with the County
Attorney to define the authority and prepare the necessary ordinances
that will allow these rangers to operate in the parks.
County Attorney CUyler stated that there are Special Acts that
authorize County employees to issue citations, but these Acts will
have to be reviewed and he will need to discuss this matter with Parks
«Recreation Department.
County Manager Dorrill stated that it is the intent to have non-
sworn, non-araed but duly authorized park rangers to enforce the
County ordinances at parks with regards to parking, consumption ot
alcohol, glass containers, etc.

Legal notice having been published in the Naples Daily Mews on
July 5, 1988, as evidenced by Atfidavit ot Publication filed with the
Clerk, bids were received tor Bid #88-1265 for construction of a
replaceaent kennel section at the Animal Control Center until 2:30
P.M. .7uly 20, 1988.
Public Services Administrator O'Donnell stated that in August,
1987, the ATC Construction Company was awarded a bid of $32,250 for
the reaoval ot the existing deteriorated section of the kennel and the
replaceaent with a new design and construction.
He stated that sub-
sequent to awarding the bid and prior to construction start, a request
was aade by the developers of the Bridget Lake POD tor an easement for
the widening of Orange Blossoa Drive along County property utilized
by Animal Control.
He indicated that Public Works Administrator
Archibald noted that the easeaent would be necessary for the improve-
aent of Orange Blossom Drive to service the traffic requirements of
the proposed new housing development in the area and the cost of the
widening is to be borne at the expense of the developers.
He stated
that the planned location of the kennel would have been within 8 teet
of the proposed road right-of-way when the easement was granted and
according to zoning regulations, there is a 30 foot setback require-
aent.

He noted that the bid that has been submitted by
Collier Builders is lower, but it does not include a bid bond deposit
as required in the bid specifications.
He noted that Staff did not
consider the fact that Cornerstone General Contractors failed to in i-
tially include the number of calendar days to complete the project,
but has since submitted in writing that the project will be completed
in 130 calendar days.
He noted that the low bid was Cornerstone
General Contractors with a hid in the amount of $81,000 and the next
low bidder was Tamiami Builders, who had a bid of $81,900.
He indi-
cated that Taaiaai Builders submitted a bid protest noting that their
bid aet all the specitications including the total calendar days to
complete the project.
He indicated that the Transportation Fund will
be transferring $46,280 to the Animal Control Building Fund and $4,836
will be transferred from the Animal Control Fund to the Animal Control
Building Fund.
He concluded by stating that he ia recoaaending that
Bid .88-1265 be awarded to Cornerstone General Contractors in the
aaount of $81,000 as being the low bidder.
In answer to Commissioner Hasse, Public Services Administrator
O'Donnell stated that the new kennel structure will be built at the
north end of the building away troa the roadway.
He indicated that
part of the existing cat room will be re-structured and moved to the
north end also.
Co..issioner Pistor questioned if Cornerstone General Contractors
did not complete the bid requirements, why are they being considered,

to which Mr. O'Donnell stated that they felt that it the omission of
the calendar days was reason enough to reject the bid.
County Manager Dorrill stated that there was an omission in the
docuaent, but before the contract is signed, the calendar days for
coap18tion will be included.
Purchasing Director Carnell stated that the Board has the right to
waive irregularities in bids that have been subaitted.
He noted that
it is the position of staff that this is a minor irregularity and can
be waived by the Board.
C088issioner Glass stated that if a bid is rejected because their
is no bond, then an omission should also be rejected, adding that
aaybe the entire project should be re-bid.
Mr. Brian Jones of Tami..i Builders stated that their bid was the
only complete bid of the three, adding that he was the only one at the
pre-bid conference also.
He indicated that his bid may be a little
higher than the other bid because he included a tie-beam in his bid
that was not called for but it is needed in order to comply with code
requireaents as it is a 12 foot high wall.
He indicated that he is
the lowest complete and responsive bidder and it the Board is going to
waive irregularities, then the bid should be awarded to the contractor
that is $12,500 less and have him supply the bond.
Comaissioner Saunders stated that there is a standard policy that
says that the County can waive irregularities and that is to benefit
the County in order to accept bids that do not meet all the require-

there is a principle involved with regards to the County accepting the

He stated that the Board has the ability to waive the
minor irregularity and aware this bid.
County Manager Dorrill stated that the Board should not be so
rigid with the requirements and should be more flexible in taking
advantage of the best and .ost responsive bid.
He stated that the

Utilities Administrator Crandall stated that he is asking that
this agreement be approved for cost participation in the construction
cost of a 16- water main running north on U.S. 41 from Bentley Village
entrance to and through Audubon Country Club.
He noted that the cost
will be one-halt the cost of the project not to exceed $180,000 and he
would like approval.
Coaaissioner Hasse questioned if this water main is going to solve
the probleas in north Maples, to which Utilities Administrator
Crandall stated that this is a piece of the puzzle in regards to
solving the problem.
Clerk Giles questioned what sort of documentation Staft will have
with regards to cost and also questioned how the Board knows the cost
of the contract, to which Utilities Administrator Crandall when

County Manager Oorrill stated that last Friday there was a request
to use a construction real estate sales trailer at the Vineyards, but
the aandatory conveyance of the water and sewer utilities has not been
coapleted.
He stated that the office trailer was red tagged at the
Vineyards and they would like to be able to us. it for the 801. pur-
pose of pre-construction sales.
He stated that he has put this item
on the agenda at the request of the developer and i8 requesting a
determination fro. the Board with regards to allowing for temporary use
of this trailer conditioned on the documents being brought back to the
Board of County Commissioners after the review of the County Attorney.
County Attorney Cuyler stated that he would recommend that this be
denied unless there is soaething that Statf has done in-house that
would cause a problem.
County Manager Dorrill stated that they tried to co.plete the
transaction of the documents last week, but the necessary information
to aeet the requireaents that the County Attorney requested is not
complete.
He stated that the obligations of the developer has not
been fulfilled at this ti.e, which is why the request ie for temporary
use of the trailer.
County Attorney Cuyler stated that the developer should be fami-
liar with this situation and there is no reason that the documents

should not be ready.
Mr. Wataa A.saad stated that the system was completed in March and
it is functional, but has not been accepted by the County at this
point.
He stated that the water and sewer is regulated by the PSC and
to further complicate the issue, the water lines were dedicated to the
County, but the sewer lines are held by the utility company but a deed
i. given to the County that can be held in escrow.
He indicated that
all this effects the rate structure which means that the documentation
that i. received i. a little acre coaplicated and more unusual than
other developments which creates a little more attention.
He noted
that the documents were submitted to the appropriate department and
there were certain suggestions made and those corrections were made
and tiled again with the appropriate departments.
He noted that then
SOae0n8 indicated that this was not the way the documents should have
been done, adding that they were done correctly the first time, but
then they were changed and then after that, someone discovered the
fact that they needed to be revised again.
He indicated that the
County Attorney's oftice has the documents at this time and he is
working very closely with them on the documents.
He noted that the
sales trailer has passed all the Building Department inspections,
adding that the problem is that the water line and the sewer lines
have not been officially accepted by the Board and he is looking tor
permission to be able to do business for a certain period of time
until the documents are accepted by the County Attorney.

coaaissioner Saunders questioned if the Vineyards are being pro-
vided any s~cial treat.ent that other developers have been retused in

Vineyards, then it cannot be refused to other developers.

cated that this is why he brought this aatter to the Board.
Coaaissioner Saunders stated that if this is approved it is
setting a precedent by saying that under siailar circumstances, the
Board would grant temporary "CO's- pending sewer or water line accep-
tance.
County Manager Dorrill stated that there is no such thing as a
teaporary -CO', adding that the Coaaission in the past has issued con-
ditional -CO's" where there is indication that all basic code and
related require.ents have been .et.
eoaaissioner Saunders questioned if there is anything in the uti-
lity acceptance agreement that is still subject to negotiation, to
which Utilities Administrator Crandall replied negatively.
Mr.
Crandall stated that the tacilities are in the ground and hooked in
properly, adding that the only hold-up is the paperwork.
eoaaissioner Glass stated that he does not feel that the Board is
setting any precedent whatsoever.

this courtesy to other developers in a similar situation, then he has

considered to avoid water use.

the County and by developers as an approach to saving water for the

Public Works Administrator Archibald stated that with regards to
aedian beautification. the north trail and east trail of U.S. 41 are
currently in one ot a number of design phases.
He stated that there
are plans underway on the north trail to design the six-laning of that
road and as a result ot that, he has discouraged any .edian improve-
aents.
He noted that the same thing is true tor the East Trail, even
though it is under a .ore preliminary stage.
Co..unity Developaent Adainistrator Ollitf stated that the Board
approved a joint City/County contract with A. Gail Boorman about three
aonths ago and the County and City staff are working jointly to do two
road segments: Goodlette Road to Pine Ridge Road and Golden Gate
Parkway to Golden Gate City.
He indicated that these designs are
using xericscape ideas, adding that there is a landscape committee
that is putting together a xeric.cape type landscape ordinance.
Coaais.ioner Saunders stated that he would like to ask the Board if
they would go on record in supporting the xericscape concept and
directing staff to .ove along with this ordinance and also to contact
the SPMMD for input fro. them.
He stated that he feels that this
could be a priority as there will be water shortages in the tuture and
it would be a good idea for the Commission to move forward on this
aatter.
