EXECUTIVE SUMMARY
Recommendation to approve the conveyance of a utility easement on County property to the City of
Naples, together with the related utility infrastructure associated with the Gordon River Greenway
Park project.
OBJECTIVE: To convey infrastructure and a utility easement to the City of Naples to allow it access
for ownership, maintenance and service of utility infrastructure serving the Gordon River Greenway Park.
CONSIDERATION: The Parks and Recreation Department is constructing the Gordon River Greenway
Park. Within the projected scope of work, the project included the installation of new potable water and
wastewater lines to make connections to the City of Naples' mains from Golden Gate Parkway and
Goodlette -Frank Road.
City of Naples Utilities Department currently provides the water and wastewater utility services in the
area and will be providing the utility services to the Gordon River Greenway Park. As a condition to
providing these services, the water line and wastewater force main facilities need to be conveyed by a Bill
of Sale to the City of Naples for ownership, maintenance and service on the lines. A Utility Easement
must be conveyed to the City of Naples to allow it access for ownership, maintenance and service.
Location of these lines is identified on the Exhibits attached to the Utility Easement.
FISCAL IMPACT: The total cost for recording the Utility Easement and Bill of Sale documents will
not exceed $85. Funds in the amount of $85 are available in the Parks & Recreation Department Capital
Improvement fund 306 under Project 80065.1.
GROWTH MANAGEMENT IMPACT: No Growth Management impact is associated with this
action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for approval. — JAB
RECOMMENDATION: That the Board approves the Utility Easement and Bill of Sale, and ancillary
documents necessary to close once approved by the County Attorney's Office; authorizes the Chairman to
execute the aforementioned documents; and directs the County Manager or his designee to proceed to
follow all appropriate closing procedures and record the aforementioned documents in the Public Records
of Collier County, Florida.

UTILITY EASEMENT
THIS UTILITY EASEMENT, made and entered into this day of
2014, by COLLIER COUNTY, a political subdivision of the State of Florida, whose post
office address is 3335 East Tamiami Trail, Suite 101, Naples, Florida 34112, hereinafter
referred to as 'Grantor ", to the City of Naples, a municipal corporation of the State of
Florida, its successors and assigns, whose post office address is 735 81h Street South,
Naples, Florida 34102, hereinafter referred to as "Grantee ".
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its
successors and assigns, a perpetual, non - exclusive easement, license, and privilege for
utility purposes, on the following described lands located in Collier County, Florida, to
wit:
See attached Exhibits "A ", "B" and "C" which are
incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to
enter upon said land, excavate, and place or remove materials for the purpose of
constructing, operating, and maintaining utility facilities thereon. Grantor and Grantee
are used for singular or plural, as the context requires.
IN WITNESS WHEREOF, the Grantor has caused these presents to be executed the

BILL OF SALE

THIS BILL OF SALE evidencing the sale and conveyance of the utility facilities described
herein is made this day of 2014, by COLLIER COUNTY, a political subdivision
of the State of Florida (hereinafter referred to as "SELLER "), and the CITY OF NAPLES, its
successors and assigns (hereinafter referred to as "BUYER ").
WITNESSETH:
That said Seller, for and in consideration of the sum of Ten Dollars ($10.00) and other
good and valuable consideration to said Seller in hand paid by the said Buyer, the receipt
whereof is hereby acknowledged, has granted, bargained, sold, transferred, set over and
delivered, and by these presents does grant, bargain, sell, transfer, set over and deliver unto the
Buyer, and the Buyer's heirs, successors and assigns forever, all those certain utility facilities lying
within the following described land, together with appurtenant easement right for the operation,
installation and maintenance of said facilities, situate, lying and being in Collier County, Florida,
to -wit:
Exhibits "A ", "B ", and "C" as attached.
The Seller, for itself and its successors, hereby covenants to and with the Buyer and its
successors and assigns that it is the lawful owner of the said goods and chattels herein referred
to as utility facilities; that it has good right, title and authority to sell same, and that it will warrant
and defend the some against the lawful claims and demands of all persons whosoever. Seller
and Buyer are used for singular or plural, as the context requires.
IN WITNESS WHEREOF, SELLER has caused these present to be executed the date and
year above written.
