EXECUTIVE SUMMARY
Recommendation to approve a release of a code enforcement lien with an accrued value of
$177,830.57 for payment of $530.57, in the code enforcement action entitled Board of County
Commissioners v. Edgar Perez, Code Enforcement Board Case No. CESD20090010573, relating to
property located at 3445 56th Avenue NE, Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners (Board) accept an offer to release a
code enforcement lien with an accrued value of $177,830.57 for payment of $530.57, in relation
to Code Enforcement Board Case No. CESD20090010573.
CONSIDERATIONS: As a result of a code violation at 3445 56th Avenue NE, consisting of the
unlawful modification of electrical and plumbing to the main structure and fence, and an invalid
permit for a horse barn without issuance of a certificate of completion, the Code Enforcement
Board ordered the imposition of a lien against Edgar Perez, in Case No. CESD20090010573.
The lien was recorded in the Official Public Records on July 12, 2012, at O.R. Book 4816, Page
1534, and it encumbers all real and personal property owned by Edgar Perez. The lien amount of
$177,830.57 is based on 711 days of accrued fines at $250 a day (from May 27, 2012 through
May 7, 2014), plus $80.57 in operational costs.
Following a foreclosure (Case No. 2011 -CA- 1764), a Certificate of Title was recorded on July
23, 2013 in favor of Nationstar Mortgage LLC. The property was then sold to Como Ventures,
LLC on March 14, 2014. The new owner brought the property into compliance on May 7, 2014,
approximately 54 days after taking title, after considerable effort and expense (including around
$60,000 in abatement expenses). A more detailed explanation of these efforts is contained in the
attached hardship letter.
Pursuant to Resolution No. 2012 -46, a request for waiver of fines may be considered when a
code enforcement lien encumbers property that is under new ownership, fines accrued prior to
transfer of title, and compliance has been achieved. The property is in compliance and the new
owner has paid $530.57, representing $450 in fines, and $80.57 in operational costs. Como
Ventures, LLC is requesting a waiver of $177,300 in accrued fines.
FISCAL IMPACT: Payment of $530.57 in fines has been made. If approved by the Board,
accrued fines in the amount of $177,300 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and
approved it as to form and legality. Majority support is required for approval. This item
conforms to the Board's policy contained in Resolution 2012 -46. KN

amount of $177,300; accept payment of $530.57, release the lien, and authorizes the Chairman to

Dear Mr. Wright:
I am enclosing a copy of my initial e-mail dated 5/7/14 to Ms. Burgos, which
requested a waiver of the accrued daily fines in the amount of $6,000 regarding the
captioned property. In response to my email, Ms. Burgos sent me an e- mailed dated
5/8/14 with a cc to your e-mail.
I will now provide to you additional facts and supporting documentation,
which were not included in my 5/7/14 email. I respectfully request that this e-mail
to you be used as my formal petition for hardship to request a full waiver of the
accrued fines in the amount of $6,000.
In the e-mail dated 5/8/14 Ms. Burgos acknowledged the deed was recorded
on 3/14/14 and the case was compliant as of 5/7/14. But the owner has 30 -days
after the recording date to obtain full compliance. The new owner was not able to
timely comply, so a daily fine of $250 was imposed on new owner from 4/14/14
thru the compliance date of 5/7/14, a period of 24 days, and totaling $6,000 in fines.
A hardship to the new owner arises because it is impossible to obtain full
compliance within the requisite 30 days post recording date. The deed was
recorded on 3/14/14, and in general takes 2 -5 business days to be processed and
available to the public. I timely applied for two permits shortly after the deed was
recorded and made available to public. I am enclosing a copy of permit
#PRBD20140307422 dated 3/21/14 and was issued 11 days later on 4/2/14. On
4/2/14 numerous contractors, which I previously hired, started their work. This
unavoidable delay only allowed the various contractors 12 days to completed their
work because 18 days of the requisite 30 day period had already elapse waiting for
the recording process and the issuance of the permits.
As you can see from the enclosed permits each contractor's work was
inspected on several occasions. Work delay typically occurs waiting for inspection
to commence and pass before another series of work can commence. These delays
occurred throughout the 8 inspections. Furthermore, the home required
substantial work to bring it back to its original state.

I am also enclosing a copy of permit #20140307408 dated 3/21/14, which
was issued one week later on 3/28/14. The second permit was timely applied for
but was issued one week later. This permit also required inspection of the work.
Based on the issuance dates of the two permits 4/2/14 and 3/28 /14,
respectively, all the numerous contractors completed their work with periodic
inspections within 35 days of the last permit issuance date. The owner was very
proactive in the hiring, scheduling and monitoring of the various contractors to
obtain full compliance within 35 days from the commencement of work. To suggest
that all the work and inspections could be scheduled and completed within the
remaining 12 days of the requisite 30 -day period to avoid non - compliances fines
would impose an extreme hardship on the owner because it would be impossible to
comply within the 30 -day period.
In conclusion, I respectfully request that the accrued daily fine of $6,000 be
waived because it was clearly impossible to obtain full compliance within 30 days of
the date for the recorded deed and furthermore, I as the owners made every
reasonable effort to obtain full compliance as expeditiously as possible.

Attached you will find a compliance notification for the property
located at 3445 56th Ave NE.
Since I purchased this property l have been in constant communication
with code enforcement and investigator Jim Davis by giving updates on
permitting and the construction process for abating code violations.
I have invested over 60,000 dollars in repairs and improvements to the
property all in an effort to make the property conform with building
codes. My General contractor, John Melton with Integral Building
Corporation did his very best to expedite abating violations and
submitted the permits the same week the deed was recorded. There were
numerous inspections and different companies and contractors to
perform required work. Unfortunately we were unable to get all work
and inspections completed prior to 30 days of the deed being recorded.
Please consider these special circumstances and waive daily fines for
this code case. Thank you for your consideration. Please contact me
