EXECUTIVE SUMMARY
Recommendation to approve an extension of two years for completion of Site Development Plan
(SDP) improvements associated with Tenchitas Convenience Store (SDP AR- 14305) pursuant to
Section 10.02.03 H of the Collier County Land Development Code.
OBJECTIVE: To have the Board of County Commissioners (Board) approve a one year extension
for the completion of Site Development Plan (SDP) improvements associated with Tenchitas
Convenience Store.
CONSIDERATIONS: On June 4, 2009, the Engineering Services Department approved the Site
Development Plan (SDP) Tenchitas Convenience Store and the pre - approval letter was issued which
started the developers construction period. The owner never paid the required impact fees; therefore,
the approval letter was never issued. The owner has now paid the required impact fees and wishes to
begin construction. Section 10.02.03 H of the Land Development Code requires that upon approval, a
SDP must be completed within 36 months. The Code also allows for 2, two year extensions which
the developer had not requested. Since an additional three year extension has been requested after the
expiration date, the Board of County Commissioners must approve the request. The project
technically expired on June 4, 2012.
FISCAL IMPACT: The County will realize revenues as follows:

Revenue generated by this project: Total: $300.00 Extension Fees
LEGAL CONSIDERATIONS: This item has been approved as to fonn and legality, and requires a
majority vote for Board approval. - SAS
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this Executive Summary.
RECOMMENDATIONS:
1. That the Board accepts the applicant's extension request together with the appropriate fees.
Approve a three year extension until June 4, 2015 for Tenchitas Convenience Store (SDP AR
14305) so the developer may be in compliance with the time limit requirements of the Land
Development Code.
3. The extension approval is subject to the terms and conditions contained in the original approval
letter.

Engineering and Environmental Services Department has reviewed the Final Site Development
Plan for the referenced project and has no objection to the construction of water, sewer, paving
and drainage aspects of the preject subject to the following stipulations:
By receipt and acceptance of this approval, the petitioner acknowledges that a pre - construction
meeting is required by, code for this project. If the pre-construction meeting is not held prior lo the
beginning of construction, the project will be cited and shut down until the required meeting is
held. Please call the Engineering Inspections Supervisor at 2.39- 2:52 -2403 to schedule a
pre - construction meeting at a minimum of 48 hours prior to the start of construction. Even with an
