EXECUTIVE SUMMARY
Recommendation to approve the conveyance of two Underground Easements (Business) to Florida
Power & Light Company for electrical service at the Marco Island Executive Airport located at
2001 -2005 Mainsail Drive, Naples, Florida.
OBJECTIVE: To convey two easements for installation of electric infrastructure installed on County
property.
CONSIDERATIONS: On September 9, 2013, Agenda Item 16G4, the Board of County Commissioners
(BCC) approved the after - the -fact submittal of a grant application to the Federal Aviation Administration
(FAA) for construction of the rehabilitation of Runway 17 -35 and associated Aircraft Aprons at the
Marco Island Executive Airport. On September 24, 2013, Agenda Item 14A3, the BCC approved the
acceptance of a FAA grant for this project.
In order for FPL to extend electrical service to the area of the Marco Island Airport identified on
Location Map 41, it will be necessary for the County to execute and record the attached Underground
Easement (Business) required by FPL (Underground Easement #1). Underground Easement #1 covers
new underground infrastructure and a transformer, and measures a total of 1.08 acres, more or less, as
shown and described on Exhibit "A" of Underground Easement 41.
In order for FPL to provide electrical service to the area of the Marco Island Airport identified on
Location Map 42 for a new airport rotating beacon, it will be necessary for the County to execute and
record the attached Underground Easement (Business) required by FPL ( "Underground Easement #2 ").
This easement measures a total of 2,759.16 square feet, more or less, as shown and described on Exhibit
"A" of the Underground Easement #2.
FISCAL IMPACT: The total cost will not exceed $100 for certified copies and recording of both
Underground Easements (Business) which funds are available in the Airport Authority Marco Island
Executive Airport project #33301 (Funds 498 and 499). A portion (90 %) of the expenditures will be
requested for reimbursement for the FAA (which will include time from the Real Property Management
for assistance with this activity) while the balance will be funded with local match.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for Board approval. - JAB
GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth Management
Plan.
RECOMMENDATION: That the Board approves the attached Underground Easements (Business) and
authorizes the Chairman to execute both documents; and, also directs the County Manager or his designee
to proceed to follow all appropriate closing procedures; and, to record both Underground Easements
(Business) in the Public Records of Collier County, Florida.

The undersigned, in consideration of the payment of $1.00 and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to
Florida Power & Light Company, its licensees, agents, successors, and assigns ( "FPL °), a non-
exclusive easement forever for the construction, operation and maintenance of underground
electric utility facilities (including cables, conduits, appurtenant equipment, and appurtenant above
ground equipment) to be installed from time to time; with the right to reconstruct, improve, add to,
enlarge, change the voltage, as well as, the size of and remove such facilities or any of them within
an easement described as follows:

Together with the right to permit FPL to attach wires to any facilities hereunder and lay cable and
conduit within the easement and to operate the same for FPL's communications purposes; the
right of ingress and egress to the Easement Area at all times; the right to clear the land and keep it
cleared of all trees, undergrowth and other obstructions within the Easement Area; to trim and cut.
and keep trimmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the
easement area which might interfere with or fall upon the lines or systems of communications or
power transmission or distribution; and further grants, to the fullest extent the undersigned has the
