EXECUTIVE SUMMARY
Recommendation to approve a satisfaction and release of lien for payment of countywide impact
fees.
OBJECTIVE: To support the affordability of housing in Collier County through the Collier County Impact Fee
waiver Program.
CONSIDERATIONS: Prior to the consolidation of the Impact Fee Ordinance waiver of impact fees was allowed
for first time very low income home buyers so long as the home was occupied for 15 years. The program is similar
to the Impact Fee Deferral program codified in Section 74 -401, which allows the County to defer the payment of the
impact fee for any new owner- occupied dwelling unit which qualifies as affordable housing.
The impact fees have been repaid in full. As such, the repayment obligation has been fulfilled and release of the lien
is needed. The following table details the satisfaction and release of lien associated with this item.

* The amount of Impact Fees in the Agreement for Waiver of Collier County Impact Fees is $8,194.34.
The correct amount should have been $6,919.34. When the impact fees were calculated, $1,275 was
assessed for Water and Sewer Impact Fees, but the property was not in the Collier County Water -Sewer
District. Premium Title Services, Inc. has paid $8,194.34 to Collier County to satisfi, the lien.
Accordingly, the over payment of $1,275 will be refunded to Premium Title Services, Inc.
FISCAL IMPACT: Collier County impact fees in the amount of $6,919.34 have been repaid and have been
deposited to the individual impact fee trust funds as required.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive
Summary.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board
approval. — JAB
STAFF RECOMMENDATION: That the Board of County Commissioners approves and authorizes the Chairman
to sign a Satisfaction and Release of lien for payment of countywide impact fees for an owner- occupied affordable
housing dwelling unit.

Tamiami Trail, Naples, Florida 3411.2, the owner(s) and holder(s) of a certain Agreement for Waiver of
Collier County Impact Fees executed by Remercile Isme and Samuel Alzime to Collier County, recorded
on September 5, 2000 in Official Records Book 27.17, Page 2170, of the Public Records of Collier County,
Florida, in consideration of $8,194.34, receipt of which is hereby acknowledged does remise, release, quitclaim,
exonerate and discharge from the lien and operation of the said agreement, that certain portion of the premises

This Agreement for the Waiver of Impact Fees entered into this _ day of 2000, by the
County Manager on behalf of the Hoard of County Commissioners of Collier County, Florida.

and has concluded that it complies with the requirements for an affordable housing waiver of
impact fees as established in the Impact Fee Ordinance; and
WHEREAS, the impact fee waiver shall be presented in lieu of payment of the requisite
impact fees subject to satisfaction of all criteria in the impact Fee Ordinance qualifying the

WHEREAS, by signing this Agreement, the County Manager approved a waiver of these
impact fees for OWNER, and
WHEREAS, the Impact Fee Ordinance requires that the OWNER enter into an
Agreement with the COUNTY.
NOW. THEREFORE, in consideration of the foregoing recitals, the parties covenant and
agree as follows:
1. RECITALS INCORPORATED. The foregoing recitals are true and correct and are
incorporated by reference herein.
2. LEGAL. DESCRIPTION. The legal description of the dwelling unit (the "Dwelling
Unit ") and site plan arc attached hcrcto as EXhibit "A" and incorporated by r<fMncv
herein.
3. TERM. OWNER agree hall remain as affordable housing

affordable housing guidelines established in the appendices to the Impact

d. The Dwelling Unit shall remain as at%rdWic housing for fift5n (1s)
years from the date the certificate of occupancy is issued for the Dwelling
Unit: and
e. OWNER is the owner of record of the Dwelling Unit and owes impact
fees in the total amount of $8.194.34 pursuant to the Impact Fee

Ordinance. In return for the waiver of the impact fees owed by OWNER.
OWNER covenants and agrees to comply with the affordable housing
impact fee waiver qualification criteria detailed in the Impact Fee
ordinance,
5. SUBSEQUENT TRANSFER, if OWNER sells the DwellinS Unit subject to the
impact fee waiver to a subsequent purchasers the Dwelling Unit shall be sold only to households
meeting the criteria set forth in the Impact Fee Ordinance.
6. AFFORDABLE REQUIREMENT, The Dwelling Unit must be utilized for
affordable housing for a fifteen (15) year period after the date the certificate of occupancy is
issued; and if Inc Dwelling Unit ceaacs to btr utilized for that purpose during such p riod, the

9. BINDING EFFECT. This Agreement shall be binding upon the parties to this
Agreement and their respective heirs, personal representatives, successors and Assigns. In the
case of sale or transfer by gift of the Dwelling Unit, the original OWNER shall remain liable for
the impact fees waived until said impact fees are paid in full or until the conditions set forth in
the Impact Fee Ordinance are satisfied. In addition, this Agreement shall run with the land and
shall remain a lien against the Dwelling Unit until the provisions of paragraph 8 are satisfied.
10. RECORDING. This Agreement shall be recorded by OWNER at the expense of
OWNER in the Official Records of Collier County, Florida, within fificen (15) days atier
execution of this Agreement by the County Manager.

It. DEFAULT. OWNER shall be in default of this Agreemen{ (-T) where
fails to sell the Dwelling Unit in accordance with the at%rdablc homing standards and
qualification criteria esta6lished in the Impact Fee Ordinance and thereafter fails to pay the
impact fees due within thirty (30) days of said non - compliance, or (2) where OWNER violates
one of the affordable housing qualification criteria in the Impact Fee Ordinance for a period of
fifteen (15) days after notice of the violation.
12. REMEDIES. Should the OWNER of the property fail to comply with tht~ said
qualification criteria at any time during the fifteen (15) year period, or should OWNER violate
any provisions of this Agreement, the impact fees waived shall be paid in full by OWNER within
thirty (30) days of said non - compliance. OWNER agrees that the impact fees waived shall
constitute a lien on the Dwelling Unit commencing on the effective date of this Agreement and
continuing for fifteen (15) years
