Recommendation for approval of an excavation permit to allow offsite removal of up to 100,000 cubic yards of fill from property described in the Lely Resort PUD as Lely Resort — Signature Club EXP- PL20140001110. The excess fill is a result of previously approved development lake excavation within Lely Resort and the material is also tied to current and proposed excavations. OBJECTIVE: To approve the removal of excess fill from the last phase of the Lely PUD. CONSIDERATIONS: The Lely Resort PUD is an older PUD without the current standard provision for removal of excess fill from the site. The Lely Resort DRI (84 -3C) was approved as a PUD on December 9, 1986. It covers 2,892.5 acres. The latest PUD Amendment was Ordinance 92 -15 approved on March 10, 1992. There are approximately 25 separate excavation permits, many with modifications, for projects within the 2,892.5 acres of Lely Resort and many of them are for multiple lakes. Several millions of cubic yards of fill have been excavated within Lely Resort and spread for roads and building pads. There were two requests to allow the removal of approximately 75,000 and 700,000 cubic yards of stockpiled fill that were previously approved by the BCC because Lely Resort is running out of places to stockpile fill in the middle of residential neighborhoods. The petitioner estimates that they need permission to remove up to 100,000 cubic yards of excavated material. During the earlier phases of construction, the developers were able to stockpile fill on cleared sites for later use, but that is becoming less of an option as the project nears completion. For reference, a ten -wheel dump holds the equivalent of roughly 14 cubic yards of compacted fill, so 100,000 cubic yards represents about 7,150 truckloads. At roughly 12 trucks per hour (one every five minutes) working ten -hour days, it would take approximately 60 days to haul 100,000 cubic yards of fill offsite. The petitioner has requested a lake excavation depth of 12 feet (Code allows up to 20 feet of depth). The attached construction plans are provided for reference. A commercial excavation permit is needed because the 100,000 cubic yards of fill to be hauled offsite exceeds the thresholds for development excavation permits. The offsite hauling shall be conducted in accordance with the Collier County Excavation Regulations in Section 22 -106 et. seq. of the Code of Laws. The Collier County Planning Commission (CCPC) review is not required per Section 22 -110 (b) (2) of the Code of Laws. Packet Page -671- 6/24/2014 16.A.13. FISCAL IMPACT: The petitioner has paid $3,662.69 to amend the existing Private Excavation permit to a Commercial Excavation permit. The petitioner has also agreed to pay the road impact fee of $5.62 per 1,000 cubic yards for the proposed removal of 100,000 cubic yards of material ($562.00). LEGAL CONSIDERATIONS: This item is consistent with Section 2.12 of Ordinance 92- 15, Lely Resort PUD, which allows for offsite removal of excavated fill subject to the provisions of the Collier County excavation ordinance. This item has been approved as to form and legality, and requires a majority vote for Board approval. - SAS GROWTH MANAGEMENT IMPACT: There is no growth management impact. The northwest section of Lely Resort accesses Rattlesnake Hammock Road and Collier Blvd (CR 951) from Grand Lely Drive, so there is minimal traffic through local neighborhoods. Lely Resort is a vested DRI. RECOMMENDATION: That the Board of County Commissioners (BCC) approve Commercial Excavation permit PL20140001110 to allow the offsite removal of up to 100,000 cubic yards of fill within the Lely Resort PUD. The excavation shall be limited to a bottom elevation of -7.4 ft. NGVD. All disturbed areas proposed for lake excavation shall be excavated to a minimum elevation of -1.4 ft. NGVD. 2. The lake littoral zone shall be created and planted as indicated on the Plan of Record and in accordance with County Ordinance 91 -102 Section 3.05 -10 as amended. 3. Off -site removal of material shall be limited to 100,000 CY. 4. All provisions of Collier County Ordinance No. 04 -55, Section 2.E. shall be adhered to. 5. Where groundwater is proposed to be pumped during the excavating operation, A Dewatering Permit shall be obtained from the South Florida Water Management District, and a copy provided to Engineering Review Services for approval prior to the commencement of any dewatering activity on the site. 6. No blasting will be permitted unless issued a separate permit by Collier County Engineering Services Department. 7. If trees are to be removed as a result of the excavating operation, a Vegetation Removal Permit, required by Land Development Code, Division 3.05 as amended shall be obtained from Collier County Environmental Services Department before work shall commence. 8. A 20 ft. maintenance easement shall be provided around the perimeter of the lake and a 20 ft. access easement to it shall be provided from a right -of -way. The easement shall be accessible to all maintenance vehicles. 9. Stockpile side slope shall be at a maximum of 4:1 unless fencing is installed around the entire perimeter of the stockpile area. Since we are in receipt of the excavation cash bond check #21258 in the amount of $39,240.00 and the permit/review fee in the amount of $1,426.76, this letter is your authorization to proceed with the excavation project in accordance with your plans and the above - mentioned stipulations. This permit is valid for (1) year and must be renewed on the anniversary date of permit issuance.
