n EXECUTIVE SUMMARY
Recommendation to approve a Stipulated Final Judgment in the amount of$38,500 for the
acquisition of Parcels 170DE(R)and 170TCE in the lawsuit styled Collier County, Florida v.
Holistic Health Healing, Inc., et al., Case No. 12-CA-1756 (US 41 Ditch/Naples Manor
Canal/LASIP Project#51101). (Fiscal Impact: $13,300)
OBJECTIVE: That the Board approves a Stipulated Final Judgment for full and final
compensation to be paid for the acquisition of Parcels 170DE(R) and 170TCE in the Lawsuit
styled Collier County, Florida v. Holistic Health Healing, Inc., et al., Case No. 12-CA-1756 (US
41 Ditch/Naples Manor Canal/LASIP Project#51101).
CONSIDERATIONS: The County acquired the subject property by entry of an Order of Taking
on September 28, 2012 and subsequently depositing the amount of$25,200.00 into the Court
Registry. The taking of Parcels 170DE(R) and 170TCE was acquired from Lloyd Bowein. The
County and Respondent negotiated a settlement of$38,500.00 for full compensation including
statutory interest, all claims related to real estate and business damages, and all attorney's fees,
experts' fees,and costs.
Attached is the Stipulated Final Judgment providing for the above-stated funds.
FISCAL IMPACT: Funds in the amount of$13,300.00 are available in the Stormwater US 41
Ditch/Naples Manor Canal/LASIP Project (#51101). Source of funds is a General Fund (001)
transfer. There is no incremental maintenance cost associated with this action.
GROWTH MANAGEMENT IMPACT: None.

LEGAL CONSIDERATIONS: This item has been approved as to form and legality and
requires a majority vote for Board approval. -ERP
RECOMMENDATION: That the Board of County Commissioners approves the Stipulated
Final Judgment and approves the expenditure and disbursement of funds as stated.

STIPULATED FINAL JUDGMENT
THIS CAUSE having come before the Court upon Joint Motion made by Petitioner,
COLLIER COUNTY, FLORIDA, by and through its undersigned counsel, and Respondent,
LLOYD BOWEIN, by and through his undersigned counsel, for entry of a Final Judgment as to
Parcels 170DE(R) and 170TCE for Project 51101, and it appearing to the Court that the parties
are authorized to make such Motion, the Court finding that the compensation to be paid by
Petitioner is the full compensation due the Respondent, LLOYD BOWEIN, and the Court being
fully advised in the premises thereof, it is thereupon
ORDERED AND ADJUDGED that:
1. Respondent, LLOYD BOWEIN have and recover from Petitioner, COLLIER
COUNTY, FLORIDA, the total sum of Thirty-Eight Thousand Five Hundred and No/100
Dollars ($38,500.00) for Parcels 170DE(R) and 170TCE, as full compensation, including
severance damages, cost to cure, statutory interest, business damages, all attorney's fees,
including supplemental attorney's fees,expert fees, and for all other damages in connection with
the taking of said parcels and the construction of the proposed improvements by Petitioner.
2. Petitioner, COLLIER COUNTY, FLORIDA, previously deposited into the Court
Registry for the benefit of Respondent Twenty-Five Thousand Two Hundred and No/100
Dollars ($25,200.00) as a good faith estimate of value pursuant to the Order of Taking dated
September 28,2012.

3. Within thirty(30)days hereof, Petitioner, COLLIER COUNTY, FLORIDA, shall
pay an additional Thirteen Thousand Three Hundred and No/100 Dollars ($13,300.00) to
Moore, Bowman & Rix, P.A. Trust Account, do Jackson R. Bowman, Esquire, 300 West Platt
Street, Suite 100, Tampa, Florida 33606.
7. Title to Parcels 170DE(R) and 170TCE being fully described in Exhibit "A"
attached hereto and incorporated herein, which vested in Petitioner pursuant to the Order of
Taking dated September 28, 2012, and the deposit of money heretofore made is approved,
ratified,and confirmed.
8. The Notice of Lis Pendens filed in the above-styled cause and recorded in Official
Record Book 4796, Page 1152, et seq., of the Public Records of Collier County, Florida be
dismissed as to Parcels 170DE(R)and 170TCE.
10. The Court reserves jurisdiction to enforce the terms of this Final Judgment.
11. This Final Judgment is to be recorded in the Official Records of Collier County,
Florida.
