EXECUTIVE SUMMARY
Recommendation to waive the after 5 p.m. requirement for one of the two scheduled public
hearings to consider the 2014 Land Development Code Amendment Cycle - Level 1, for
amendments which change the actual zoning map or the actual list of permitted, conditional and
prohibited uses in a zoning category.
OBJECTIVE: To provide the option for the Board of County Commissioners (Board) to hold
both required hearings for the 2014 Land Development Code Amendment Cycle 1 — Level 1
during daytime regularly scheduled hearings on Tuesday, June 24 and Tuesday, July 8, 2014.
This option requires the Board to waive the night hearing by a supermajority vote.
CONSIDERATIONS:, The current LDC amendment cycle includes proposed changes which
amend the zoning atlas and amendments which propose changes to the actual list of permitted,
conditional, or prohibited uses of land within several zoning categories. These amendments
require public notice pursuant to Section 125.66,FS and LDC section 10.03.06 K.
Section 125.66(4)(b),FS provides:
"In cases in which the proposed ordinance or resolution changes the actual list of permitted,
conditional, or prohibited uses within a zoning category, or changes the actual zoning map
designation of a parcel or parcels of land involving 10 contiguous acres or more, the board of
county commissioners shall provide for public notice and hearings as follows:
1. The Board of County Commissioners shall hold two advertised public hearings on the
proposed ordinance or resolution. At least one hearing shall be held after 5 p.m. on a weekday,
unless the Board of County Commissioners, by a majority plus one vote, elects to conduct that
hearing at another time of day..."
It should be noted that the Collier County Planning Commission held a public hearing on
Monday, May 19th at 5:05 p.m. All of the amendments were reviewed and recommendations
provided at this meeting.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
LEGAL CONSIDERATIONS:, This item is approved as to form and legality. An affirmative
vote of four is required for Board approval. --HFAC
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
RECOMMENDATION: For the Board to waive the after 5 p.m. requirement for one of the two
scheduled public hearings to consider the 2014 Land Development Code Amendment Cycle-
Level 1.
