EXECUTIVE SUMMARY Recommendation that the Board authorize the expenditure of Haldeman Creek MSTU funds to pay for notice by mail to all Haldeman Creek property owners of the proposed Haldeman's Landing Boat Dock Extension project. OBJECTIVE: Authorize the expenditure of MSTU funds to mail a notice to the property owners within the Haldeman Creek MSTU boundaries of a pending Boat Dock Extension application that impacts Haldeman Creek. CONSIDERATIONS: A Boat Dock Extension (BDE) petition is required for docks proposed to extend more than 20 feet into a waterway more than 100 feet in width. A petition is currently under review for docks associated with the Haldeman's Landing project on Haldeman Creek. The project was legally advertised for a public hearing before the Hearing Examiner (quarter- page newspaper ad, 4-foot by 8-foot sign on site, and mailed notices to property owners within 500 feet) according to Chapter 8 of the Administrative Code. After advertising, County Staff received many calls and e-mails requesting additional information. Among these communications were several comments that the 500-foot distance for mail notification was inadequate, since boaters living upstream, outside the mailing area, did not receive notification. At this time, the Hearing Examiner deemed the project as controversial and remanded it to the Collier County Planning Commission (CCPC). The CCPC hearing requires the item to be readvertised. On April 22. 2014, at the request of the Haldeman Creek MTSU Board Members, County Staff made a brief presentation and answered questions at the MSTU Board Meeting. The Board then voted to allocate funds for mail notification of the Haldeman's Landing BDE petition to all property owners within the MSTU. FISCAL IMPACT: Sufficient budget exists within Fund (164) FY 14 budget to satisfy this action. Estimated expenses are 5500.00. LEGAL CONSIDERATIONS: This item has been reviewed by the County attorney. is approved as to form and legality, and requires majority vote for approval. The Haldeman Creek Dredging Municipal Service Taxing Unit was created pursuant to Ordinance No. 2006-60 for the purpose of providing maintenance dredging within the MSTU as determined by the advisory committee. The maintenance tasks shall include but not be limited to: (1) Maintenance dredging; (2) Maintenance of navigational channel markers." This item arises out of an application for a boat dock extension that would impact Haldeman Creek called "Haldeman's Landing." In approving this item, the Board would be making,the implicit finding that if this Project is approved it would potentially impact either the future dredging or navigability of Haldeman Creek, and that as such it is appropriate to utilize these MSTU funds to notify the residents within this entire MSTU of this pending application. -JAK Packet Page -786- 5/27/2014 16.B.1 .
