EXECUTIVE SUMMARY
Recommendation to ratify and approve a stipulated Final Judgment as to Publix's interest
in Parcels 113FEE and 113TCE as part of the US-41 / Collier Boulevard Intersection
Improvement project(Project No.60116) Fiscal Impact: $4,768.
OBJECTIVE: To settle the lawsuit styled Collier County v. New Plan Florida Holdings, et al,
as to Publix's interest in Parcels 113FEE and 113TCE and eliminate exposure to further costs
arising out of extended Iitigation.
CONSIDERATIONS: Parcels 113FEE and 113TCE were taken by Collier County for the
purpose of constructing at-grade improvements to the intersection of US-41 and Collier
Boulevard. The parent tract property is a shopping center known as Freedom Square which is
home to many businesses, one of which is a Publix supermarket.
Publix is the holder of a reciprocal access easement over New Plan Florida Holdings shopping
center property from which Parcels 113FEE and 113TCE were taken. As such Publix had to be
served as a party defendant in the eminent domain lawsuit styled Collier County v. New Plan
Florida Holdings, et al, and was therefore entitled to hire counsel and expert witnesses for the
purpose of exercising their right to make an apportionment claim on the proceeds from the
County's deposit.
Publix has agreed to resolve their entitlement to apportionment for the total sum of $4,768
inclusive of attorney fees and expert witness costs
FISCAL IMPACT: Funds in the amount of$4,768 are available in the US-41/Collier Blvd
Intersection Improvement Project (#60116). Source of funds are impact fees. There are no on-
going maintenance or repair costs associated with the acquisition of right-of-way for the project.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with the approval of this agenda item.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and
requires a majority vote for Board approval. -ERP
RECOMMENDATION: That the Board of County Commissioners of Collier County,Florida:
Approves entry of the attached Stipulated Final Judgment with the Circuit Court.

THIS CAUSE having come before the Court upon Joint Motion made by Petitioner,
COLLIER COUNTY, FLORIDA, by and through its undersigned counsel, and Respondent,
PUBLIX SUPER MARKETS, INC., through its undersigned counsel, for entry of a Stipulated
Final Judgment as to Parcels 113FEE and 113TCE, for Project 68056, and it appearing to the
Court that the parties are authorized to make such Motion, and the Court being fully advised in
the premises thereof, it is thereupon
ORDERED AND ADJUDGED that:
1. Respondent, PUBLIX SUPER MARKETS, INC. does have and recovers from
Petitioner, COLLIER COUNTY, FLORIDA, the total sum of Four Thousand, Seven Hundred
Sixty-eight and No/100 Dollars ($4,768.00)in settlement of all claims,including attorney's fees
and expert fees and costs incurred in defense of this case.
2. That within thirty (30) days hereof, Petitioner, COLLIER COUNTY, FLORIDA,
shall pay Four Thousand, Seven Hundred Sixty-eight and No/100 Dollars ($4,768.00)to

counsel for Respondent, GAYLORD MERLIN LUDOVICI & DIAZ, and forward same by

3. That upon payment of the aforesaid sum this suit shall stand dismissed with
regard to PUBLIX SUPER MARKETS, INC., as to Parcels 113FEE and 113TCE and the same
shall be removed from the service list for this case.
4. Title to Parcel 113FEE and 113TCE, being fully described in Exhibit "A"
attached hereto and incorporated herein, which vested in Petitioner pursuant to the Order of
Taking dated March 13, 2013, and the deposit of money heretofore made is approved, ratified,
and confirmed.
