between Collier County Housing, Human and Veteran Services and Habitat

language: Pursuant to a HUD letter dated January 8, 2014 from Labor
Relations Specialist Steven A. Bales, this project is not required to meet
Davis Bacon requirements unless HOME funds are utilized in the project,
for 12 or more HOME assisted units pursuant to 24 CFR 92.354 (Staff request)
Item 16H4: Executive Summary title corrected to read: Recommendation to approve an Interlocal
Agreement(ILA)with Golden Gate Fire Control and Rescue District(GGFD)providing that the
County assume fire plans review duties on behalf of ENYD GGFD and the County's dependent fire
districts,including Isles of Capri,Ochopee and Collier Fire District One,and authorizing the
ENFD Fire Chief or his designee to act as the approving authority over fire plans review for the
County's dependent fire districts. (Staff's request)

EXECUTIVE SUMMARY
Recommendation to approve the First Amendment to the subrecipient agreement with Habitat for
Humanity for the Community Development Block Grant Faith Landing Infrastructure Project to
clarify the project scope and reporting requirements.
OBJECTIVE: To promote the development of affordable housing for low income persons in Collier
County.
CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) Community
Development Block Grant (CDBG) program funds locally defined needs for programming and
infrastructure. Collier County's CDBG FY2013-2014 Action Plan was approved at the August 13, 2013
In Absentia meeting and ratified at the regular Board of County Commissioners meeting of September 10,
2013 (Agenda item 16F1).
On January 28, 2014, the Board approved the subrecipient agreement with Habitat for Humanity of
Collier County to complete construction of infrastructure for phase 2C of the Faith Landing Development
in Immokalee(Agenda item 16D11).
Concurrent to the subrecipient agreement being prepared for Board approval, staff received technical
assistance from HUD Labor Relations Specialist necessitating changes to the agreement.
Amendment No. 1 to the agreement provides for the following changes:
1. Removes Davis Bacon provisions;
2. Adds project delivery to the scope of work and budget;
3. Extends the effective date from December 31, 2018 to December 31, 2019 for compliance with
Continued Use Certification;
4. Identifies the requirement to develop and submit a Program Income Reuse Plan; -
5. Adds retainage language to Exhibit B;and
6. Revises the project budget line item.
FISCAL IMPACT: This action has no new fiscal impact. This project is budgeted within the Housing
Grants Fund(705),CDBG Project No. 33289 Faith Landing in the total amount of$500,000.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for approval.—JAB
GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this amendments will
further the Goals,Objectives,and Policies with the Housing Element of the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners approves the First Amendment to
the subrecipient agreement with Habitat for Humanity for the Community Development Block Grant
Faith Landing Infrastructure Project.

Faith Landing Infrastructure Improvements
This Amendment is entered into this day of 2014, by and between HABITAT FOR
HUMANITY OF COLLIER COUNTY, INC a private not-for-profit corporation existing under the laws of
the State of Florida, herein after referred to as SUBRECIPIENT and Collier County, Florida, hereinafter to be
referred to as "COUNTY," collectively stated as the"Parties."
RECITALS
WHEREAS, on. January 286 2014, the COUNTY entered into an Agreement with the Community
Development Block Grant Program funds to be used for Faith Landing Infrastructure improvements
Project (hereinafter referred to as the"Agreement"): and
WHEREAS, the Parties desire to amend the Agreement to remove reference to Davis Bacon regulations
as the requirements are not applicable to this project, add project delivery to the scope of work, extend the
effective date for federal compliance (Continued Use Certification) and the Program Income Reuse Plan and
adding retainage language to Exhibit B.
NOW, THEREFORE, in consideration of foregoing Recitals. and other good and valuable
consideration, the receipt and sufficiency of which is hereby mutually acknowledged, the Parties agree to
amend the Agreement as follows:

I. SCOPE OF WORK

B. PROJECT DETAILS
Project Component 1: Environmental Review. Project Delivery and Infrastructure Construction.
The Subrecipient will engage in performing the environmental review, project delivery and
construction of infrastructure for phase 2C of the Faith Landing Development in Immokalee in order to
construct affordable single family homes. Habitat for Humanity will receive an amount up to $500,000
through an allocation of funds to perform the following CDBG activities:
Improvements Federal Funds
Project Component 1: Fund Environmental Review, Project $500,000
Delivery and Construction of the infrastructure for phase 2C of
the Faith Landing Development in Immokalee in order to
construct affordable single family homes in accordance with
Section III of this agreement.

1. Project Tasks
a. Maintain documentation on all households served in compliance with 24CFR 85.42
b. Provide quarterly reports on meeting a CDBG National Objective
c. Provide Environmental Review Assessment
d. Provide Site Design and Specifications
e. Prepare Bid Specifications and Engineer's Cost Estimate
f. Obtain Sealed Bids and provide procurement documentation

h. Submit invoices to HHVS for environmental and construction of the infrastructure costs

5. The SUBRECIPIENT shall maintain records showing compliance with the Davis-Bacon Law,
including files containing contractor payrolls, employee interviews, Davis-Bacon wage rates, and
administrative cross-referencing. SUBRECIPIENT shall maintain records showing contractor
compliance with the Contract Work Hours and Work Safety Law. Similarly, the SUBRECIPIENT
shall maintain records showing compliance with federal purchasing requirements and with other
federal requirements for grant implementation. Pursuant to HUD letter dated January 8, 2014 from
Steven A. Bales. Labor Relations Specialist. this project is not required to meet Davis Bacon
requirements unless HOME funds are utilized in the project.
