Maintenance shall include cutting the grass along the roadway. Developer shall place an overlay layer of asphalt on Massey Road from Vanderbilt Beach Road to the Development entrance as part of its maintenance of Massey Road. (Developer) and Collier County (County) to provide water management and financial contributions for the construction of Tree Farm Road. OBJECTIVE: That the Board of County Commissioners (BCC) approve a DCA that provides for water management and a financial contribution to support the construction of Tree Farm Road from Davilla Street to Massey Street (Project). CONSIDERATION: The Collier Boulevard and Immokalee Road corridors are the primary north-south and east-west corridors in the northeast urban area of Collier County. The continued development of the Tree Farm_ Woodcrest and Massey connection will provide an alternative roadway network and intersection by-pass. The nearest intersection to the east is Wilson Boulevard. winch is five miles away. The Developer's predecessor and County entered into a Developer Contribution Agreement (Agreement) on May 23. 2006 which was recorded in Book 4126. Pages 1463 through 1470, of the Official Records of Collier County Florida to accumulate right-of-way and commitments for the construction of the Tree Farm Road. Woodcrest Drive and Massey Street alternative roadway network. Terms of the Agreement were partially satisfied by the prior owner. The new Developer has agreed to amend and restate the Agreement with a new DCA in order to continue this roadway network. The Developer has agreed to provide for water management and make a cash donation of $900.000 in order to fund a portion of the cost of the Project in place of the unfulfilled commitments from the original .Agreement. The County will use these funds along with prior contributions to complete the next phase of the roadway network. The Project has been entirely funded by cash contributions. prepaid impact fees, donations of right-of-way, and water management acceptance in private systems. FISCAL IMPACT: The Project is identified in the adopted budget. the adopted Capital Improvement Element (CIE), and Annual Update and Inventory Report (ALTIR) as Project »61001 with a current balance of $1.167.962. The Project is estimated at approximately $1.900.000. The $900.000 contribution will fully fund the Project within the limits identified in the exhibits attached. GROWTH MANAGEMENT IMPACT: The Project is consistent with goals and objectives of the Transportation Element of the Growth Management Plan. LEGAL CONSIDERATIONS: This item has been reviewed by the Comity Attorney, is approved as to form and legality, and requires majority vote for approval. It was originally planned that access to the Development would be from Tree Farm Road. which is at least several years from completion. Accordingly. the DCA provides that the Developer Packet Page -807- 4/8/2014 16.A.16. may choose to access Vanderbilt Beach Road via Massey Street while Tree Farm Road is being constructed. Although Massey Street is currently not a publicly maintained or owned County road built to County standards, it is identified in the Long Range Transportation Plan as a future public collector road that will ultimately require the acquisition of public Right -of -Way and a reconstruction to County standards. Developer has assured the County that it has legal access from the Development to Vanderbilt Beach Road along Massey Street, and has agreed to indemniA, the County from any claims of the owners of lots along Massey Street challenging the Development's right to use Massey Street for access. As DR Horton is a multi- billion dollar publicly traded company, the County Attorney is satisfied with these assurances. -JAK RECOMMENDATION: That the Board of County Commissioners of Collier County, Florida: 1. Approve the attached DCA and authorize its Chairman to execute same on behalf of the Board, 2. Authorize the County Manager or his designee to take the necessary measures to ensure the County's performance in accordance with the terms and conditions of the DCA; and 3. Developer has prepaid the required road impact fees to vest the Development with 110 residential single family units. 5. The County shall diligently design, permit and construct the extension of Tree Faun Road from its current terminus to the east as provided herein. It is anticipated that the construction of Tree Farm Road shall be completed within 2 years of approval of this Agreement by the County provided all necessary environmental permits can be obtained in a timely manner. The approximate limits of the Tree Farm Road Construction are set forth on Exhibit "C." Within thirty (30) days of receipt of all necessary permits by the County for the construction of Tree Farm Road, Developer shall pay to the County the sum of $900.000. To secure payment of the $900,000 the Developer shall provide the County with a letter of credit in a form acceptable by the County within thirty (30) days of approval of this Agreement by the County. Developer shall not be entitled to road impact fee credits for the funding provided in this Agreement. 6. In the event state or federal laws are enacted after the execution of this Agreement, which are applicable to and preclude in whole or in part the parties' compliance with the terms of this Agreement, then in such event this Agreement shall be modified or revoked as is necessary to comply with such laws, in a manner which best reflects the intent of this Agreement. This Agreement shall not be construed or characterized as a development agreement under the Florida Local Government Development Agreement Act. 12. Developer shall execute this Agreement prior to it being submitted for approval by the Board of County commissioners. This Agreement shall be recorded by the County in the Official Records of Collier County, Florida, within fourteen (14) days after the County enters into this Agreement.
