EXECUTIVE SUMMARY
Recommendation to approve a Final Judgment for Parcel Nos. 135RDUE and 135SE in the
amount of $71,100 in the lawsuit styled Collier County v Kaye Homes, Inc-, et aL, Case No.
10- 2680 -CA for the Collier Boulevard road improvement project. (Project No. 68056)
(Fiscal Impact $44,770).
OBJECTIVE: That the Board approve the attached Stipulated Final Judgment for payment of
full compensation, for the taking of Parcel Nos. 135RDUE and 135SE in Collier County v. Kaye
Homes, et al., Case No. 10- 2680 -CA, Collier Boulevard Project No. 68056.
CONSIDERATIONS: Collier County condemned 37,659 square feet for a perpetual, non-
exclusive, road right -of -way, drainage, and utilities easement (Parcel 135RDUE) and 2,387
square feet for a slope easement from the property owner, Pine Ridge Holdings, LLC. The
County's original offer was $70,700 for both parcels. An updated appraisal reflected a reduction
in the value of the Parcels of $43,600. An Order of Taking hearing was held on October 19,
2010 and the County deposited the sum of $26,500 into the Court Registry. The parties have
since negotiated a settlement of $71,100: $70,100 for full compensation to the property owner
and $1,000 in attorney's fees.
In addition to the full compensation, if this final judgment is approved, the County agrees to
allow a right -of -way access off of Weber Boulevard and off of White boulevard at the locations
depicted in Exhibit B of the Final Judgment, upon proper application by the property owner. As
well, the County will agree to formally acknowledge the lot split of Tract 150 (the parent tract).
Staff finds this settlement to be reasonable and recommends approval. If the attached Final
Judgment is approved, the County will be responsible for the following costs:

Attorney's Fee: 1,000
Clerk's Deposit Fee: 170
TOTAL $ 44,770
FISCAL IIKPACT: Funds in the amount of $44,770 are available in Impact Fees.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and
requires a majority vote for Board approval. - ERP
GROWTH MANAGEMENT EAPACT: None.
RECOMMENDATION: That the Board of County Commissioners authorize the Final
Judgment as to Parcels 135RDUE and 135SE and authorize payment of the funds as stated.

FINAL JUDGMENT
THIS CAUSE having come before this Court upon Joint Motion made by Petitioner,
COLLIER COUNTY, FLORIDA, and Respondent, PINE RIDGE HOLDINGS, INC., by and
through their undersigned counsel, for entry of a Final Judgment as to Parcels 135RDUE and
135SE for Project No. 68056, and it appearing to the Court that the parties are authorized to
make such Motion, the Court finding that the compensation to be paid by Petitioner is the full
compensation due the Respondent, PINE RIDGE HOLDINGS, INC., and the Court being fully
advised in the premises, it is therefore
ORDERED AND ADJUDGED that:
1. Respondent, PINE RIDGE HOLDINGS, INC., have and recover from Petitioner,
COLLIER COUNTY, FLORIDA, the total sum of Seventy Thousand One Hundred Dollars
and No /100 ($70,100) for Parcels 135RDUE and 135SE, as full compensation for the property
taken, inclusive of severance damages, costs to cure, improvements, business damages and all
other damages and costs relating to the taking of these parcels.

2. Petitioner, COLLIER COUNTY, FLORIDA, is entitled to a credit for the good
faith estimate of value previously deposited into the registry of the Clerk of the Circuit Court in
the amount of Twenty -Six Thousand Five Hundred Dollars and 00 /100 ($26,500.00) pursuant
to an Order of Taking dated October 19, 2010.
3. Within thirty (30) days hereof, Petitioner, COLLIER COUNTY, FLORIDA shall
pay the sum of One Thousand Dollars and 00/100 ($1,000) to the COLEMAN
YOVANOVICH & KOESTER TRUST ACCOUNT, c/o Richard D. Yovanovich, Esquire, 4001
Tamiami Trail North, Suite 300, Naples, Florida 34103 as full settlement and satisfaction of all
attorney's fees, including all supplemental attorney's fees, litigation costs, monetary benefits,
and non - monetary benefits.
4. Within thirty (30) days hereof, Petitioner, COLLIER COUNTY, FLORIDA, shall
deposit into the Court Registry the amount of Forty -Three Thousand Six Hundred Dollars
and 00 /100 ($43,600.00) in additional compensation to those funds currently on deposit as
described in Paragraph 2 above relating to the taking of Parcels 135RDUE and 135SE.
5. Within 15 days of the deposit described herein, the clerk shall disburse the funds
of Seventy Thousand and One Hundred Dollars and No /100 ($70,100.00) and any interest
accrued to date to the Yovanovich & Koester Trust Account, c/o Richard D. Yovanovich,
Esquire, 4001 Tamiami Trail North, Suite 300, Naples, Florida 34103.
6. Parcel 135RDUE, a Perpetual, Non - Exclusive Road Right -of -Way, Drainage and
Utility Easement and Parcel 135SE, a Slope Easement, being fully described in Exhibit "A"
attached hereto and incorporated herein, which vested in Petitioner, COLLIER COUNTY,
FLORIDA, pursuant to the Order of Taking dated October 19, 2010, and the deposit of money
heretofore made, is approved, ratified, and confirmed.

7. The County hereby acknowledges and recognizes that Tract 150, Golden Gate
Estates, Unit No. 27, according to the map or plat thereof, as recorded in Plat Book 7, Page 17,
Public Records of Collier County, Florida, has been properly split into two parcels. The parcels
are legally described as follows:
Parcel A- The West one half (1 /2))of Tract 150, Golden Gate Estates Unit No. 27, according to
the plat thereof, as recorded in Plat Book 7, Page 17, Public Records of Collier County, Florida,
And
Parcel B- The East one half (1/2) of Tract 150, Golden Gate Estates Unit No. 27, according to
the plat thereof, as recorded in Plat Book 7, Page 17, Public Records of Collier County, Florida.
8. Upon proper application made by Respondent, PINERIDGE HOLDINGS, INC.,
driveway connection permits (a/k/a "right -of -way permits ") will be issued for connection from
Tract 150, Golden Gate Estates Unit No. 27, to the County road network on White Boulevard
and on Weber Boulevard in the locations identified in Exhibit `B ". It is the intent of the parties
that Parcels A and B share access to White Boulevard and that Parcel B has additional access to
Weber Boulevard with the driveway apron being located as close as practicable to the northern
boundary line of Parcel B. The access to Parcel B along Weber Boulevard shall remain a full
access unless and until such time as Collier County, acting within its police powers to regulate
traffic and access to the public road network in the interest of public safety and/or road way
capacity, shall require a modification of said access.

9. The Court shall retain jurisdiction for apportionment of the funds held in the
Court Registry.
10. The Notice of Lis Pendens filed in the above - styled cause and recorded in Official
Records Book 4559 Page 1167, et seq. of the Public Records of Collier County, Florida be,
dismissed as to Parcels 135RDUE and 135SE.
11. This Order disposes of all claims arising out of the taking of Parcels 135RDUE
and 135SE and that have or could have been asserted in this cause.
