EXECUTIVE SUMMARY
Recommendation to direct the County Attorney to advertise an Ordinance creating the
Emergency Medical Services Advisory Council and sunsetting the Public Safety Authority.
Obiective: To bring back for a full public hearing an advertised Ordinance which creates the
Emergency Medical Services Advisory Board and abolishes the Public Safety Authority.
Considerations: During General Communications at the January 28, 2014 Board meeting, the
Board discussed the Public Safety Authority. Direction was given to the County Manager to
abolish the Public Safety Authority and reconstitute the Emergency Medical Services Advisory
Council to consist of interested citizens.
In keeping with the Board direction and discussion, the proposed Ordinance provides that this
advisory board would have the following duties:
1. To work to improve and enhance pre - hospital emergency medical care within Collier
County with thorough study, education, and system -wide participation by the response
agencies and the local medical community.
2. To make its special knowledge and expertise available to any and all agencies upon
request when so charged during regular board meetings.
3. To make recommendations, as warranted, regarding first responder programs, training
programs, communication systems, and other appropriate facilities and services that
positively impact the delivery of emergency medical services.
4. The Council may convene technical working groups from the community periodically to
address the following:
(a) Community education and awareness.
(b) Emergency medical dispatch.
(c) Field coordination and operational concerns.
In further keeping with the Board direction and discussions, the proposed Ordinance provides
that this advisory board will be comprised of the following members:
1. A resident from each of the County Commissioner Districts. Residents shall not be
employed by an agency that supplies Emergency Medical Services or is closely or
fiscally associated with same. All residents are voting members.
2. A representative of the Collier County Medical Society as a non - voting member.
The EMS Chief or designee will serve as staff liaison and advisor.

Legal Considerations: This item has been reviewed by the Count Attorney, is approved as to

Staff Recommendation: That the Board of County Commissioners directs the County Attorney
to advertise the attached Ordinance which creates the Emergency Medical Services Advisory
Board and abolishes the Public Safety Authority.

ORDINANCE NO. 2014 -
AN ORDINANCE CREATING THE COLLIER COUNTY EMERGENCY
MEDICAL SERVICES ADVISORY COUNCIL; PROVIDING FOR
CREATION, PURPOSE, POWERS AND DUTIES; PROVIDING FOR
APPOINTMENT AND COMPOSITION, TERMS OF OFFICE,
ATTENDANCE AND FILLING OF VACANCIES; PROVIDING FOR
REMOVAL FROM OFFICE; PROVIDING FOR OFFICERS, QUORUM
AND RULES OF PROCEDURE; PROVIDING FOR THE SUNSET OF
THE COLLIER COUNTY PUBLIC SAFETY AUTHORITY AND REPEAL
OF ORDINANCE NO. 2012 -23, AS AMENDED; PROVIDING FOR
INCLUSION IN CODE OF LAWS AND ORDINANCES; PROVIDING
FOR CONFLICT AND SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, by Ordinance No. 2012 -23, the Board of County Commissioners (Board)
created the Collier County Public Safety Authority and sunsetted the Collier County Emergency
Medical Services Policy Advisory Board; and
WHEREAS, at this time the Board believes that a reconstituted Collier County
Emergency Medical Services Policy Advisory Board would better serve the public with respect
to advising the Board on all aspects of emergency medical services in Collier County; and
WHEREAS, it is the intent of the Board to recreate the Collier County Emergency
Medical Services Policy Advisory Board as set forth below while simultaneously sunsetting the
Collier County Public Safety Authority.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE. Creation, Purpose, Powers and Duties of the Collier County Emergency
Medical Services Advisory Council.
There is hereby created the Collier County Emergency Medical Services Advisory
Council (hereinafter the "Council "). The Council is created as an advisory board to the Board of
County Commissioners and shall have the following purposes, powers and duties:
1. To work to improve and enhance pre - hospital emergency medical care within Collier
County with thorough study, education, and system -wide participation by the response agencies
and the local medical community.

2. To make its special knowledge and expertise available to any and all agencies upon
request when so charged during regular board meetings.
3. To make recommendations, as warranted, regarding first responder programs, training
programs, communication systems, and other appropriate facilities and services that positively
impact the delivery of emergency medical services.
4. The Council may convene technical working groups from the community periodically
to address various issues, including the following:
(a) Community education and awareness.
(b) Emergency medical dispatch.
(c) Field coordination and operational concerns.
5. To perform or assist with any other function or duty as requested by the Board.
SECTION TWO. Appointment and Composition; Terms of Office; Attendance and Filling
Vacancies.
The six - member Council shall be composed as follows:
1. A resident from each of the five County Commissioner Districts. Residents shall not
be employed by an agency that supplies Emergency Medical Services or is closely or fiscally
associated with same. All residents shall be voting members.
2. A representative of the Collier County Medical Society will serve as a non - voting
member.
Terms for all Council members shall be for four years. For staggering purposes only, for
the initial term of office, two Council members shall serve a two -year term. The EMS Chief or
designee will serve as staff liaison and advisor.
SECTION THREE. Meetings.
1. Regular Meetings. The Council shall meet quarterly and at other times as necessary.
2. Special Meetings. Special Meetings of the Council may be called by the Chairperson,
or at the request of a majority of the appointed members.
SECTION FOUR. Removal from Office; Failure to Attend Meetings.
Removal from office and attendance requirements shall be governed by Ordinance No.
01 -55, as amended, or by its successor ordinance.

SECTION FIVE. Officers; Quorum; Rules of Procedure.
At its earliest opportunity, the membership of the Council shall elect a chairman and vice
chairman from among the members. Officers shall serve for a one -year term with eligibility for
reelection.
The presence of three or more voting members shall constitute a quorum of the Council
necessary to take action and transact business.
The Council shall, by majority vote of the entire membership, adopt by -laws for doing its
work and conducting its business. The by -laws shall include, but not be limited to, its general
procedure and transaction of business. The Council shall operate in the Sunshine, and shall keep
a written record of meetings, resolutions, findings, and determinations. Copies of all of the
Council minutes, resolutions, reports, and exhibits shall be filed with the Board of County
Commissioners and or its Clerk when appropriate.
SECTION SIX. Sunset of Public Safety Authority and Repeal of Ordinance 2012 -23
The Collier County Public Safety Authority shall immediately discontinue meeting.
Ordinance 2012 -23, as amended, which created the Collier County Public Safety Authority, is
hereby repealed and of no further force or effect.
SECTION SEVEN. Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or re-
lettered to accomplish such, and the word 'ordinance" may be changed to "section," "article," or
any other appropriate word.
SECTION EIGHT. Conflict and Severability.
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.

SECTION NINE. Effective Date.
This Ordinance shall become effective upon filing with the Florida Department of State.
PASSED AND DULY ADOPTED by the Board of County Commissioners of Collier
County, Florida, this day of 92014.
