EXECUTIVE SUMMARY
Recommendation to approve Third Amendment to Agreement with the Collier County Housing
Authority, Inc. (CCHA) for a Tenant Based Rental Assistance Project to extend the project
completion date
OBJECTIVE: Expend HOME funds for the Tenant Based Rental Assistance program (TBRA) to
provide safe, secure housing for low income individuals /families.
CONSIDERATIONS: The FY2011 -2012 HUD Annual Action Plan allocated $300,000 for CCHA to
implement a TBRA. The agreement for CCHA was approved at the October 25, 2011 the Board of
County Commissioners (Agenda Item #I 6D2) meeting. TBRA provides rental assistance, along with
utility assistance and security deposits, for low income individuals /families to have safe, secure housing.
Since the initial agreement was executed there have been two other agreement amendments for this
project as follows:

Prior to amendment #2 being approved Housing, Human and Veteran Services identified an issue
with the required match obligation. CCHA was unable to meet the required obligation and 'it
became necessary to suspend the program until a resolution was achieved. HHVS met with HUD
technical assistance and received • direction on other allowable options to meet the match
requirement. In response, Amendment #2 as approved by the BCC removed the match
requirement from the CCHA agreement and achieved match compliance through the use of the
state SHIP program. An additional time extension from January 31, 2014 to July 31, 2014 is set
forth in the Third Amendment to allow CCHA to fully expend all remaining grant funds and re-
institute the program to meet the needs of Collier residents who need rental assistance. CCHA
has performed well to date and has actually served a greater number of beneficiaries than
required under the agreement.
The proposed modifications are allowable under the grant and will not increase the amount of
grant funds or impact the budget for this project.
FISCAL EWPACT: There will be no effect on ad- valorem or general funds dollars. Funds are available
within the housing Grant Fund (705) FY2011 -2012 HOME Projects (33177).
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for approval. - JAB
GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this amendment will
further the Goals, Objectives, and Policies within the Housing Element of the Growth Management Plan.

AND
COLLIER COUNTY HOUSING AUTHORITY, INC.
TENANT BASED RENTAL ASSISTANCE (TBRA) PROJECT
This Amendment is entered into this day of , 2014, by and
between Collier County; a political subdivision of the State of Florida, hereinafter referred to as
"COUNTY ", and the "Collier .County Housing Authority, Inc., a special independent district of the
State of Florida, created in accordance with Florida Statute Section 421.27 et seq.," a private not -for-
profit corporation existing under the lawn of the State of Florida ", herein after referred to as
SUBRECIPIENT , collectively stated as the "Parties ".
RECITALS
WHEREAS, on October 25, 2011 the COUNTY entered into an Agreement with the HOME
Investment Partnerships (HOME) Program funds for the Tenant Based Rental Assistance (TBRA)
Program which will provide assistance to eligible low income persons. (hereinafter referred to as the
"Agreement "); and
WHEREAS, on February 12, 2013 and October 22, 2013 the Agreement was amended.
WHEREAS, the Parties desire to amend the Agreement to include terms required by Chapter
2013 -154, Laws of Florida and make other modifications to the agreement
NOW, THEREFORE, in consideration of foregoing Recitals, and other good and valuable
consideration, the receipt and sufficiency of which is hereby mutually acknowledged, the Parties agree
to amend the Agreement as follows:

III. TIME OF PERFORMANCE
Services of the SUBRECIPIENT shall start on the 25th day of October, 2011 and end on the
31 st day of 3awdef-�-J�, 2014. The term of this Agreement and the provisions herein may be
extended by amendment to cover any additional time period during which the SUBRECIPIENT
remains in control of HOME funds or other HOME assets, including program income.

BUDGET:
Modifications to the "Budget and Scope" may only be made if approved in advance by the
COUNTY. Modifications to the budget and scope will be performed in accordance with CMA
5330. Budgeted fund shifts between cost categories and activities shall not be more than 10%
and does not signify a change in scope. Fund shifts that exceed 10% of a cost category and
activity shall only be made with board approval.

such, is not intended to be used as a payment schedule.
