EXECUTIVE SUMMARY
Recommendation to approve a Resolution superseding Resolution No. 2013 -28 establishing New
Bike Locker Rental Fees, Policies and Procedures at the Collier Area Transit Intermodal
Transfer Facility located at the Government Center.
OBJECTIVE: To allow for the rental of bike lockers at the Collier Area Transit Intermodal
Transfer Facility located at the Government Center.
CONSIDERATION: During construction of the Intermodal Transfer Station at the
Qovernment Center, coordination occurred with the Metropolitan Planning Organization's
(MPO) Pathway Advisory Committee (PAC). The PAC was specifically interested in the
options for bicyclists at the new facility. The Alternative Transportation Modes Department
incorporated bicycle lockers into the construction of the facility. The bike lockers are to be used
to store bicycle and bicycle related equipment that can be reasonably contained within the
lockers, such as helmets, jackets, packs or pumps. In order to offset the administrative cost for
the locker rentals, staff is proposing fees to be assessed for. the locker rentals. Staff assessed the
rental structure in other areas to determine the customary rental fees. Revenue received from the
bike locker rentals would be reinvested into the fixed route transit system. The proposed bike
locker rental fees are as follows:

FISCAL IMPACT: Approval of this item may result in approximately $870.00 of additional
revenue for the Collier Area Transit System within the Collier Area Transit Operating Fund 426.
This amount is based on annual rental of all six bicycle lockers.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires
majority vote for Board approval. —SRT

with this Executive Summary.

A RESOLUTION SUPERSEDING RESOLUTION
NUMBER 2013 -028, WHICH ESTABLISHED THE
COLLIER AREA TRANSIT (CAT) BUS FARES AND
TRANSIT FEE POLICY, TO AUTHORIZE THE
ESTABLISHMENT OF BIKE LOCKER RENTAL
FEES.
WHEREAS, the Board of County Commissioners has the authority to approve
the Collier Area Transit (CAT) bus fares and transit fee policy; and
WHEREAS. in July 2013, the Intermodal Transfer Station at the Government
Center was opened and included new bike lockers, which require the establishment of
locker rental fees, policies and procedures.
WHEREAS, on February 12, 2013 and after due consideration on its agenda and
majority vote, the Board adopted Resolution 2013 -028 establishing the CAT bus fares
and transit fee policy;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY THAT:
1. Collier Area Transit (CAT) is hereby authorized to set bus fares in accordance with the

Bike Locker Policies and Procedures Manual
Policy: Bicycle Lockers

OVERVIEW
Collier Area Transit (CAT) has six (6) bicycle lockers available for rental to its transit passengers.
A valid Government issued Photo Identification (ID) must be provided for bicycle locker rental.
Rental fees are available quarterly or annually plus a $50 refundable key deposit.
Bicycle lockers are located at the southern end of the CAT Intermodal Transfer Station located
at 3355Tamiami Trail East.
POLICY
Bicycle Locker Space Lease and Key Deposit Agreements may be picked up at the Customer
Service Office at the CAT Intermodal Transfer Station.
PROCEDURE(S)
1. Complete the Bicycle Locker Space lease and Key Deposit Agreement.
2. Pay cashier behind the customer service area at the Intermodal Transfer Station for the
application fee, key deposit and rental fee.
3. Go to the ATM Department (ATM) — 3299 Tamiami Trail East, Suite 1013, to pick up
bicycle locker key and to submit the completed lease and Agreement.
Provide notice to the ATM Department of intent to renew the lease within 10 days prior to the
expiration date. if lease is not renewed, when the key is returned, the ATM Department will
complete an inspection of the locker and process a check request for return of the key deposit.

Bicycle Locker Agreement
THIS AGREEMENT is entered into between Collier County, Florida, hereinafter referred to as the
"County," and the user of a bicycle locker, hereinafter referred to as "User." The User attests
that he or she is at least 18 years of age and presented government issued identification to the
County at the time of executing this Agreement.
In consideration of the benefits of using a bicycle locker and the mutual covenants contained
herein, the County and the User agree as follows:
Deposit and Fees: This Agreement commences on and expires on unless
payment for a subsequent rental period is received by Collier County Alternative Transportation
Modes Department within ten (10) days prior to the aforementioned expiration date. User
agrees to pay a $50 refundable key deposit to Collier County in connection with signing this
Agreement. The user also agrees to pay a one -time application fee of $10; the application fee
will be waived for consecutive renewals. Upon expiration or termination of this Agreement, the
County will refund to the user the key deposit, provided that: (1) the key is returned, (2) the
interior of the locker is clean, and (3) the locker has not been damaged. The User will be
issued one key and agrees that no duplicates will be made. in the event a key is lost or stolen,
the User forfeits their key deposit and must pay an additional key deposit to receive a
replacement key.
Termination or Cancellation: The County reserves the right to terminate this Agreement with
the User at any time. Upon termination by action of the County, the User must return the key
and remove all items from the locker within thirty (30) calendar days from the mailing date of
notice. The User may terminate this agreement at any time and request the deposit refund by
returning the locker key along with written notice of termination to: Collier County Alterative
Transportation Modes Department, Bicycle Locker Program, 3299 Tamiami Trail East, Suite
103, Naples, Florida 34112. All or a portion of the deposit may be kept to contribute toward
the cost of cleaning, repairing, or replacing the key, lock or locker. No interest on the deposit
shall be paid to the User. Permitted Use: The assigned bicycle locker shall be used only for the
purpose of storing a bicycle and bicycle- related equipment which can be reasonably contained
within the locker such as a helmet, jacket or other outer clothing, pack, pump and other cyclist
equipment. In the event items other than those specifically permitted are stored in the locker,
the County reserves the right to terminate this Agreement with the User immediately. Upon
such termination, the County has the right to empty the locker of any property stored within.
Any property permitted under this section shall be held for fourteen (14) days after the
effective date of the revocation or expiration. Thereafter, the County and its respective
employees, agents, or representatives shall dispose of all such contents as unclaimed property,
or take other such action as may be necessary and as may be authorized by applicable law.

Right to Inspect: The User agrees that no part of the interior or exterior of the assigned locker
is considered private space and that there is no expectation of privacy as to anything place in or
on the locker. The User hereby acknowledges and agrees that the County, the Bicycle Program
Coordinator, and their respective employees, agents, or representatives may inspect the locker
at any time with or without cause or prior notice.
Removal of Property: If the property of the user is to be removed for any reason authorized by
this agreement, or as otherwise authorized by law; such removal of property shall be conducted
in accordance with all applicable law in effect at the time of removal.
Responsibilities: It is the responsibility of the User to keep the interior of the docker free of
debris and any other material that may contribute to the attraction of insects, vermin, etc. The
County shall have, responsibility of maintaining the locker exterior, including the structure,
locking mechanism, and pavement.
Release of Liability: The County is not responsible for any fire, theft, loss, or damage to the
User's bicycle or any bicycle- related equipment stored in the locker. The User is responsible for
insuring the locker is locked at all times. The User assumes all risk of, and releases the County
and its respective officials, employees and agents from any liability for any harm, injury,
damage, theft or loss that may occur, whether foreseen or unseen, arising out of the use of the
locker; and shall indemnify, defend and hold harmless the County against any actions, claims
and /or damages arising out of or in connection with this Agreement.
