EXECUTIVE SUMMARY
Recommendation to accept the jury award and Final Judgments in the eminent domain
case styled Collier County v. RTG, LLC, et al., Case No. 10- CA- 00259, for the taking of
Parcels 116FEE, 116TCE1, 116TCE2, and 116TCE3 for the intersection improvements at
US 951 (Collier Blvd.) and US 41 (Project No. 60116). Fiscal Impact: $5,524,050.00.
OBJECTIVE: To forego any appeal and accept the jury award to the property owner and the
business owner as just compensation and business damages for the taking of Parcels 116FEE,
116TCE1, 116TCE2, and 116TCE3.
CONSIDERATIONS: Utilizing an experienced eminent domain firm, Collier County
condemned Parcels 116FEE, I I6TCE1, 116TCE2, and 116TCE3 from RTG, LLC at an Order of
Taking hearing held March 26, 2013. The parcels were necessary for the construction of the
intersection improvements at Collier Blvd. and US 41. The County previously deposited
$878,600.00 into the Court Registry.
At mediation held on November 13, 2013, the parties were unsuccessful in coming to a mutual
agreement as to the value of compensation and business damages. As a result, the parties went to
trial from January 6th to January 10th.
The property owner, RTG, LLC, originally claimed $4,178,200.00 for the value of land and
damages, and the business owner, Holiday CVS, LLC, alleged a complete business wipeout with
damages of another $3,151,534.00. The owners' claims were based on the loss of 11 parking
spaces closest to the front door of the store along Collier Boulevard. The County's experts
believed that the business and severance damages could be mitigated to a large degree by
relocating the front door of the store to the south side of the building. CVS disagreed and
terminated their lease.
At the completion of trial, the jury returned a verdict within the range of expert testimony
awarding $3,483,000.00 for RTG, LLC, the landowner, and $1,933,000.00 for Holiday CVS,
LLC, the business owner. Statutory attorney's fees result in an additional $599,880.00 for the
landowner's attorney and $386,600.00 for CVS's attorney. The court retains jurisdiction to
award supplemental attorney's fees and expert fees and costs, as well as any interest which
accrues.
According to the analysis of an appeal by outside counsel, as attached hereto, there are numerous
grounds for appeal which could result in a reversal of the judgment and anew trial. However,
because the County is required to pay all fees and costs incurred and there is little incentive for
settlement if the County threatens an appeal, outside counsel concludes that they do not
recommend an appeal of this judgment. See attached email for more details.
FISCAL IMPACT: Entry of the attached final judgments, deposits into the Court Registry and
payments to the trust accounts of the two law firms pursuant to the provisions of the final
judgments amounts in a fiscal impact of $5,523,050.00. Source of funds is Road Impact Fee
Fund (336).

COUNTY ATTORNEY DISCUSSION: The County's position was that CVS could have
substantially reduced the impact of the taking by relocating the front door. CVS disagreed and
terminated their lease, taking the position that the taking rendered their continued operations
untenable. They are currently on a month to month lease with the landlord, pending the start of
construction (which is scheduled to commence in the very near future). The best the County
could hope for on appeal is a new trial. If CVS does indeed close their store, a retrial would not
unlikely reach a similar result. If CVS does not close their store, the matter could be revisited in
a non - eminent domain proceeding, wherein the County will not have to statutorily pay all of their
legal fees and expert costs. -JAK

As you know the County tried the case of Collier County vs. RTG, LLC, this past week in circuit court before the
Honorable Lauren Brodie. This was an eminent domain case that involved the taking of property from the CVS drugstore
at the corner of Collier Blvd. and US 41. The landowner, RTG, claimed $4,178,200.00 in land and damages, and the
business owner, CVS, alleged a complete business wipeout with damages of another $3,151,534.00. The owners' claims
were based on the loss of 24 parking spaces along Collier Blvd. The County felt that much of the damages could be
cured by moving the entrance from one side of the building to the other, renovating the interior and reconfiguring some
parking. The County put on evidence of Land, improvements and damages (including cost to cure) of $519,700.00 along
with and business damages of $235,000.00.
%-� The jury was charged and began deliberations at about 3:30 Friday afternoon, and returned a verdict at 6:45 pm that
same day. The jury returned a verdict of $3,483,000.00 for RTG, the landowner, and $1,933,000.00 for CVS, the business
owner. As you know, the law requires the condemning authority (the County) to pay all of the owners' costs and fees

for trial and appeal. At this time, based on the statutory formula, the land owner's attorneys are entitled to $599,880.00
in fees, and the business owner's attorney is entitled to $386,600.00. 1 do not yet have any information on how much
the owners will claim as compensable litigation costs (mostly expert witness fees).
There are numerous grounds for appeal which could result in a reversal of the judgment and a new trial. However,
because the County would be responsible for any additional fees and costs incurred by the owner on appeal (as well as)
interest on the verdict that would ultimately be returned following appeal, it is my opinion that the owners' attorneys
would not have motivation to negotiate a lower settlement due to a pending appeal. Likewise, following remand and
retrial, due to the nature of eminent domain actions, the County would be responsible for the owners' fees and costs,
along with whatever verdict was finally rendered, plus interest. As a result, we do not recommend an appeal of this
judgment.

IT IS THEREUPON CONSIDERED ORDERED AND ADJUDGED that title to the
property described in attached Schedules I through III, inclusively, which vested in the Petitioner
pursuant to the Order of Taking and Deposit of money heretofore made, is approved, ratified, and
confirmed; and it is further,
ORDERED that within forty-five (45) days following entry of this Final Judgment, the
Petitioner, COLLIER COUNTY, shall deposit the sum of $2,604,400.00 (TWO MILLION SIX
HUNDRED FOUR THOUSAND FOUR HUNDRED AND 00/ 100 DOLLARS) into the registry
of the Court, which sum shall bear interest at the statutory rate, said sum representing the difference
between the full compensation for the real estate taken in this action as determined by the jury's
verdict and the amount previously paid to Respondents ($878,600.00); and it is further,
ORDERED that the amount set forth in the verdict herein enclosed, less any sums
heretofore withdrawn, shall be held in the registry of the Court pending the apportionment thereof
upon the motion of the parties, duly noticed, or upon motion duly noticed by any of them; and it is

ORDERED that Respondent, RTG, LLC, 2300 S. 48th Street, Lincoln, NE 68506, hereby
recovers from Petitioner, COLLIER COUNTY, attorneys' fees pursuant to Florida Statute
73.092(1), the amount of $599,880.00 (FIVE HUNDRED NINETY NINE THOUSAND EIGHT
HUNDRED EIGHTY AND 00 /100 DOLLARS) which shall bear interest at the statutory rate; and
it is further,
ORDERED that Petitioner shall, if no appeal is taken within 30 days of the date of this
judgment, within forty-five (45) days of the date of this judgment issue a check in the amount of
$599,880.00 as attorneys' fees set forth in paragraph 1 above, made payable to the Trust Account of

IT IS THEREUPON CONSIDERED ORDERED and ADJUDGED that title to the
property described in attached Schedules I through III, inclusively, which property vested in
the Petitioner pursuant to the Order of Taking and Deposit of money heretofore made, is
approved, ratified, and confirmed; and it is further,
ORDERED that within forty-five (45) days following entry of this Final Judgment,
the Petitioner, Collier County, shall deposit the sum of $1,933,000.00 (ONE MILLION
NINE HUNDRED THIRTY -THREE THOUSAND AND 00 /100 DOLLARS) into the
registry of the court, which sum shall bear interest at the statutory rate, said sum representing
the verdict amount for business damages to be paid to Respondent, HOLIDAY CVS, LLC;
and it is further,
ORDERED that upon such deposit, the clerk shall forthwith issue a check in the
amount of $1,933,000.00 (ONE MILLION NINE HUNDRED THIRTY -THREE
THOUSAND AND 00 /100 DOLLARS), made payable to the Trust account of Buell &
Elligett, P.A., as counsel for Respondent HOLIDAY CVS, LLC, and shall be mailed to
Mark P. Buell, Esquire, Buell & Elligett, P.A., 3003 W. Azeele Street, Suite 100, Tampa,
Florida 33609; and it is further
ORDERED that Respondent, HOLIDAY CVS, LLC, hereby recovers from
Petitioner, COLLIER COUNTY, 3299 Tamiami Trail East, Naples, Florida 34112,
attorneys' fees pursuant to Florida Statute 73.092(1), in the amount of $386,600.00
(TI]REE HUNDRED EIGHTY-SIX THOUSAND SIX HUNDRED AND 00 /100
DOLLARS) which shall bear interest at the statutory rate; and it is further,
ORDERED that Petitioner shall, if no appeal is taken within 30 days of the date of
