EXECUTIVE SUMMARY
Recommendation to adopt a Resolution amending Resolution No. 2013-227, the Collier
County Domestic Animal Services Fee Policy, to provide for the limited waiver of fees
where necessary and no alternative exists.
Objective: To uphold the Board-approved mission of the Domestic Animal Services
Department: To ensure compliance with local and State animal-related laws; to return strays to
their owners and promote the adoption of homeless animals to new families; and to work toward
ending the community problem of pet overpopulation.
Considerations: The purpose of the Board-approved Domestic Animal Services Fee Policy is to
uniformly and consistently assess user fees which will partially offset the cost of providing
domestic animal services to the taxpayers of Collier County. At times the Department's business
needs, specifically with respect to its mission of protecting public safety and preventing animal
suffering, do not align with the Fee Policy's strict prohibition against the waiving of fees.
No animal should be allowed to suffer nor member of the public be exposed to undue risk due to
an animal owner's inability to pay fees. Therefore, to correct this misalignment, staff
recommends amending the policy to allow for waiver of fees by the DAS Director when doing so
will prevent the suffering of an animal or ensure public safety and no reasonable alternative to
waiving the fee exists. Each waiver will be subsequently ratified by presenting a quarterly report
to the Board for approval.
An amendment to the existing fee policy (Exhibit A of Resolution 2013-227) is being suggested
as follows:
A. . Waiving of Fees. The Board of County Commissioners
shall set all fees and charges. No fees may be waived, except as stated herein. Fees may
be waived in accordance with policies articulated herein, such as under certain conditions
upon reclaim, when fees are sponsored by donors, and fees for service animals and
animals in safekeeping. Fees may be waived by the Director when to do so will prevent
the suffering of an animal or ensure public safety and no reasonable alternative to
waiving the fee exists. Such waivers shall be brought before the Board in quarterly
reports for after-the-fact ratification.
Fiscal Impact: The amount of fees that can be waived under the described circumstances will
result in an insignificant reduction in revenue for DAS.
Growth Management Impact: None
Legal Considerations: This item has been approved as to form and legality and requires a
majority vote for Board approval. —ERP

all fees and charges. No fees may be waived, except as stated herein. Fees may be waived in
accordance with policies articulated herein, such as under certain conditions upon reclaim, when

be brought before the Board in quarterly reports for after-the-fact ratification.
B. Non-Fee-Related Policies. The Director of Animal Services, or designee, may
waive enforcement or application of any department policies or restrictions provided such waiver
does not conflict with applicable local, state, or federal laws and does not interfere with public
safety.
C. Promotional Sales and Advertisements. Fees may be reduced from time to time
for special promotional sales and advertisements if approved by the Director of Animal Services
and such a reduction is applied in a consistent and time-limited manner. Examples may include
but are not limited to: Two-for-one cat adoptions in June to recognize National Adopt-A-Cat
Month, or reduced adoption fees in February for senior citizens.
D. Sponsored Fees. The department may accept cash donations to sponsor fees for

be redeemed at the time of the fee-incurring transaction. Redemption of sponsored fee gift
certificates will be at the director's discretion in accordance with the following general guidelines:
1. A customer cannot benefit from sponsored fees more than once in a twelve-month period; 2. A

caretaker, and that animal is claimed by the owner, next of kin, or otherwise authorized party at
the first available opportunity, impound fees may be waived. This exception does not apply to
