EXECUTIVE SUMMARY
Recommendation to approve reimbursement to Collier County's Department of Housing and Urban
Development (HUD) line of Credit for a FY 2007-2008 Emergency Shelter Grant (ESG) project that
exceeded the ESG essential services cap. Repayment in the amount of$28,972.54 will require the use
of HHVS Client Services funds (001-155930) and related budget amendments.
OBJECTIVE: To clear two HUD monitoring findings related to a FY 2007-2008 ESG project.
CONSIDERATIONS: In 2007, an ESG monitoring finding report was issued by HUD Miami during a
routine monitoring visit. The subject of this executive summary is two of the findings that the Department of
Housing,Human and Veteran Services(HHVS) staff responded to and sought waivers for in May of 2008.
Findings:
Finding #1: Certain ESG expenditures were misclassified under the line item for essential services and
should have been classified under operations and/or administration.
Finding #2: Certain ESG funds were used for an ineligible activity (i.e., fringe benefits/insurance for
Immokalee Friendship House shelter employees that did not work on the ESG program).
The findings were issued because benefits were paid to emergency shelter employees, but whose positions
were not specifically listed in the scope of the subrecipient agreement; thereby exceeding the 30% cap on
essential services allowed by the grant regulations.
Because HUD did not request further information nor inform them that the waivers were not approved, we
believe former HHVS staff believed the findings to be closed.
On May 21, 2012, following a HUD Miami field monitoring visit, HHVS received correspondence,
identifying the two findings as open and requiring reimbursement of non-federal funds to the ESG line of
credit in order to clear the findings. HUD requested submittal of a calculation of disallowed costs for review
prior to reimbursement to the line of credit. Staff provided HUD with the calculation and was advised
verbally by our HUD Miami representative on November 18, 2013 that it was acceptable and repayment to
the line of credit should be made. The amount that will need to be paid back to the line of credit is
$28,972.54. Approval of this item will authorize HHVS to use departmental general funds to comply with
HUD's request. HHVS is working with the County Attorney's Office to pursue recovery of the funds from
the subrecipient.
FISCAL IMPACT: The repayment discussed in this executive summary will require a budget amendment
reducing the HHVS Client Assistance budget (001-155930-631990) in order to make funds available for
transfer to the Urban Improvement Grants Fund (121-138755-882100-348061) for reimbursement to US
Housing and Urban Development. The impact on the client assistance budget is $28,972.54. These funds
are sourced from the rental assistance program portion of the budget. Recent utilization trends for rental
assistance dollars are lower than anticipated thus making these monies available for the recommended
reimbursement.
LEGAL CONSIDERATIONS: This issue has only recently been presented to the County Attorney's
Office. We will work with staff to pursue the money from the subrecipient and if legal action is needed, an
item will be presented to the Board requesting same. Any funds recovered will be returned to the HHVS
general operating fund. Accordingly, this item has been approved for form and legality and requires a
majority vote for Board action. -JAB

GROWTH MANAGEMENT IMPACT: There is no Growth Management impact with this item.
RECOMMENDATION: To approve and authorize the reimbursement to Collier County's Department of

Client Assistance budget and approve necessary budget amendments.
