1/14/2014 9.A. EXECUTIVE SUMMARY This item requires that ex parte disclosure be provided by Commission members. Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to adopt a Resolution to disclaim, renounce and vacate the County and the Public interest in a portion of Mamie Street south of Chokoloskee Drive, being a part of Section 36, Township 53 South, Range 29 East,Chokoloskee, Collier County, Florida. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of Mamie Street south of Chokoloskee Drive, being a part of Section 36, Township 53 South, Range 29 East, Chokoloskee, Collier County, Florida. CONSIDERATIONS: Pursuant to a settlement agreement with the underlying and nearby property owners approved by the Board on July 9, 2013, Item #16.x.1, Collier County has requested, on its own behalf, to vacate the right-of-way over a portion of Mamie Street south of Chokoloskee Drive, for public road right-of-way, being a part of Section 36, Township 53 South, Range 29 East, Collier County, Florida. This vacation has been advertised as required by §336.10 and Resolution Number 2006-160. Neighboring property owners have been given notice. Letters of no objection and letters of objection were received from neighboring property owners. FISCAL IMPACT: Fees associated with the vacation application process have been waived. Cost of advertising will be approximately$400.00. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - ERP RECOMMENDATION: That the Board of County Commissioners: 1) Approves the attached Resolution which will vacate the County and the public interest in a portion of Mamie Street south of Chokoloskee Drive, being a part of Section 36, Township 53 South, Range 29 East, Chokoloskee, Collier County, Florida, being more specifically shown in Exhibit A; and 2) Directs the Clerk to the Board to record a certified copy of the Resolution in the Public Records. RESOLUTION NO. 2013- A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, TO DISCLAIM, RENOUNCE AND VACATE THE COUNTY AND THE PUBLIC INTEREST IN A PORTION OF MAMIE STREET SOUTH OF CHOKOLOSKEE DRIVE, BEING A PART OF SECTION 36, TOWNSHIP 53 SOUTH, RANGE 29 EAST, CHOKOLOSKEE, COLLIER COUNTY,FLORIDA. I have lived in Chokoloskee since 1976. I have watched through the years the island that used to be covered in woods and undeveloped property to hardly any woods anymore and a lot of development. It looks nothing like what I remember growing up as a kid, a lot of the ambiance gone. I have also watched the transformation of Smallwood Store which as a kid was a fun place to go visit Thelma Smallwood to look through all of the antiques and eat penny and nickel candy, along with a coke in a bottle out of the machine. After Ms. Smallwood died the store was closed to the public until 1990 when it was opened up as a museum to the public. This museum is on the National Register of Historic Places, Ref#7400612. How can the County even consider giving this access road to Florida-Georgia Grove and cut off the only access to this National Museum? Florida-Georgia Grove has done nothing but cause frustration and aggravation for the residents of Chokoloskee since purchasing the property adjacent to Mamie Street, starting first by closing off the access road to Smallwood Store Museum. This museum is visited daily by numerous tourists visiting our area interested in the history our area has to offer. My family has used Mamie Street as a Public access road as early as the 1940's now for about 70 years,. Still today with our families visiting us on our Island, I love driving down Mamie Street to visit the Smallwood Museum or just shooting the Breeze on the wooden deck talking about ole days when Nancy Smallwood was Postal Clerk and ran the Store, her niece Lynn Hancock McMillin owns it now. Ted Smaliwood's Family, AC & Nancy Hancocks were our close friends owning the Blue Heron Motel where we loved staying while fishing. Objection letter When I purchased my property,which is directly adjacent to the west side of Florida Georgia Grove's parcel I assumed that Mamie Street was"a road". It has a street sign and it is the only means to get to the Smallwood store which is a nice little slice of Florida history. I was only made aware of Mamie Street not being on county right of way when I went to my property and there was a construction fence along my eastern property line. I was upset,until while doing research, I found this on Florida Georgia Grove's Deed: 2. Easement for utilities granted to The City of Everglades City by instrument recorded June 4, 1997,in Official Records Book 2319,Page 2291, Public Records of Collier County, Florida; 3. Encroachment of Mamie Street over a portion of the aforedescribed real property, and the rights of others to use Mamie Street over a portion of the subject real property; "and the Right of others to use Mamie Street") When I researched this, I then thought that this issue had already been addressed, and that Mamie Street was to remain intact. Furthermore, I knew that the owner had purchased this piece of property with knowledge of this stipulation on the deed. They either did not care, or they intended to"Brow beat"someone into relinquishing it. If it was the later, I for one respond poorly to that sort of tact. If it was the prior, then the real estate market/south Florida economy was so good that it didn't matter what encumbrances the property contained. It is my opinion that if they were going to build on the property they would have started 3 years ago when construction prices were 50%of what they should be. They built the sea wall because a permit was expiring and they are simply trying to move Mamie Street so that they can sell and get more money. Florida has suffered enough real-estate greed this decade to last a lifetime. I do not think that we need anymore. Packet Page-106- 1/14/2014 9.A.- I object to the vacation and abandonment of any portion of Mamie Street because of the following: • This reduces the usefulness and value of my property • If I wish to upgrade the mobile home I will have to demolish the existing one and take it out in dumpsters.Every property owner's structure along Mamie Street faces Mamie Street. • Much more limited access in the case of a fire. • The taxpayer having to pay to move the road and the continuing motion of this process. • How would you address the relocation of access to the Smallwood store? I believe an Environmental Impact Study would have to be conducted if you were to consider relocating access across the mangrove marsh at the south end of Calusa Drive. New road construction will require a South Florida Water Management permit;a storm water detention pond would also need to be constructed. Peprin, In response to your letter Dated September 10, 2013. Not only do I object to the abandonment of a portion of Mamie Street I strongly object and oppose such action. The abandonment of any portion of Mamie street adjacent to the homes bordering Mamie will put those in homes harm's way and residents in grave danger by limiting all emergency vehicles and personal access to said home and resident. In addition the abandonment of access could and will cause a bottle neck by limiting egress in case of an emergency evacuation. Furthermore as a result some homeowners may not be able to maintain their insurance in its present state and or premium. Such action would not only be irresponsible but criminal. Klatzkow and Emily R. Peprin, In response to your letter Dated September 10, 2013. Not only do I object to the abandonment of a portion of Mamie Street I strongly object and oppose such action. The abandonment of any portion of Mamie street adjacent to the homes bordering Mamie will put those in homes harm's way and residents in grave danger by limiting all emergency vehicles and personal access to said home and resident. In addition the abandonment of access could and will cause a bottle neck by limiting egress in case of an emergency evacuation. Furthermore as a result some homeowners may not be able to maintain their insurance in its present state and or premium. Such action would not only be irresponsible but criminal.
