EXECUTIVE SUMMARY
Recommendation to grant final approval of the roadway and drainage improvements for the final
plat of Marbella Lakes Application Number AR-7386; accept a Quit Claim Deed for Tracts "A-2"
and "A -3A" (Green Blvd.) which were dedicated to the County on the plat; accept maintenance
responsibility for Tracts "A -2", "A -3A', and Tract "J" (Lake); and authorize release of the
maintenance security.
OBJECTIVE: To have the Board of County Commissioners (Board) grant final approval of
the improvements associated with the Marbella Lakes plat, accept a Quit Claim Deed, accept
maintenance of Tracts "A -2 ", A -3A", and Tract "J ", and release the maintenance security in the
amount of $23,843.83.
CONSIDERATIONS:
1) On February 23, 2010, the Environmental and Engineering Services Division granted
preliminary acceptance of the roadway and drainage improvements in Marbella Lakes.
2) The internal roadway and drainage improvements, except Tracts "A -2 ", "A -3A ", and "J ",
will be maintained by the project's homeowners association. Collier County will maintain
the improvements within Tracts "A -2 ", "A -3A and "J" which were dedicated to the
County on the Marbella Lakes plat, Plat Book 46, Page 77. Tracts "A -2" and "A -3A" will
be part of the County road network, so the developer has provided deeds to grant the
County fee simple title to those Tracts. See attached deed which will be recorded upon
approval of this item.
3) The required. improvements have been constructed in accordance with the
Land Development Code. The Environmental and Engineering Services Division has
inspected the improvements and is recommending final acceptance of the improvements.
4) A resolution for final acceptance has been prepared and approved by the County
Attorney's Office. The resolution is a requirement of Section 10.02.05 C.3 of the Land
Development Code. A copy of the document is attached.
5) This project is within the Livingston Village PUD, Ordinance 03 -23, which has been
found to be in substantial compliance.
FISCAL IMPACT: The roadway and drainage improvements, except Tracts "A -2 ", "A -3A ",
and Tract "J" will be maintained by the project's homeowners association. The existing security
in the amount of $23,843.83 will be released upon Board approval. The original security in the
amount _of $4,715,263.71 has been reduced to the current amount .based on the previous work
performed and completed and pursuant to the terms of the Construction and Maintenance
Agreement dated June 18, 2006. Maintenance costs for Tracts "A -2 ", "A -3A", and Tract "J" will
be from the Transportation Services Maintenance budget.

LEGAL CONSIDERATJONS: This item has been approved as to form and legality, and
requires a majority vote for Board approval. - SAS
RECOMMENDATION: To grant final acceptance of the roadway and drainage improvements

1. The Chairman to execute the attached resolution authorizing final acceptance of the
improvements and maintenance responsibility for Tracts "A -2 ", "A -3A" and Tract "J ".
2. Approval of the attached quit claim deed for Tracts "A -2" and "A -3A ".
3. The Clerk of Courts to release of the maintenance security
