EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve an
Easement Use Agreement (Agreement) for Lot 52 according to the plat of Torino Replat as
recorded at Plat Book 52,Pages 76 through 77 of the Public Records of Collier County.
OBJECTIVE: To approve an Easement Use Agreement with the current property owner of Lot
52, Torino Replat.
CONSIDERATIONS: An existing pool deck and proposed screen encroach approximately 4.3
feet into an approximate 24-foot Drainage Easement along the southern boundary of the
property. The subject easement is dedicated to Collier County with no responsibility for
maintenance and to the Torino at Grey Oaks Neighborhood Association, Inc. with responsibility
for maintenance. The Homeowner's Association has provided a letter of no objection to the
encroachment and stated that there remains sufficient area to maintain the easement. There are
no drainage facilities within the easement. The Development Review Division and the County
Attorney's Office have reviewed the Agreement and Exhibits and recommend approval of the
Easement Use Agreement. The original screen permit was issued correctly in 2014; however,
when the owner submitted the spot survey to the County, the encroachment was missed, and thus
this Agreement is necessary.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary. The
property owner will be responsible for the recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and
requires a majority vote for Board approval. SAS
RECOMMENDATIONS:
1. That the Board of County Commissioners approves the Easement Use Agreement with the
current property owner of Lot 52 of Torino Replat, and authorizes the Chairman to execute
the Agreement.
2. Direct the Clerk of Courts to record the Easement Use Agreement.

EASEMENT USE AGREEMENT
THIS EASEMENT USE AGREEMENT ("AGREEMENT") is made and entered
into this _ day of , 2015 by and between Randolph J. Wolfe as Trustee of
the Grey Oaks Torino 52 Trust Agreement Dated May 1, 2015 ("Wolfe") and Collier
County ("County"),a political subdivision of the state of Florida,
RECITALS:
WHEREAS, Wolfe is the record owner of the fee simple interest in and to that
certain parcel of real property known as Lot 52, Torino Replat, as recorded at Plat Book
52, Pages 76-77, of the Public Records of Collier County, Florida, more specifically
shown on Exhibit `A' (the "Subject Property"); and
WHEREAS, pursuant to that certain plat of Torino Replat, recorded at Plat Book 52,
Pages 76-77, of the Public Records of Collier County, Florida, (the "Plat"), County is
record owner of certain non-exclusive drainage easement rights, a portion of which
encumbers the Subject Property(the"Easement Area"); and
WHEREAS, the Easement Area is managed and maintained by the Torino at Grey
Oaks Neighborhood Association, Inc. ("Association"); and
WHEREAS, a paver deck has been installed and a screen enclosure is proposed to be
constructed on the Subject Property, resulting in a 4.2 to 4.5 foot encroachment into the
23.5 to 24.1 foot wide drainage easement along the southern boundary line of the Subject
Property, as shown on Exhibit `33' (the "Encroachment"); and
WHEREAS, there are no other improvements within the easement; and
WHEREAS, the County has no present objection to the continued use of the
Encroachment within the Easement Area, provided that Wolfe agrees to the terms and
conditions set forth below.
NOW THEREFORE, for and in consideration of the Recitals, the sum of TEN
DOLLARS ($10.00) and for other good and valuable consideration the receipt and
sufficiency of which arc hereby expressly acknowledged, the parties hereto agree as
follows:
1. The above recitals are true and correct and are incorporated herein.
2. Wolfe will provide both the County and the Association whatever access they
require to continue their non-exclusive drainage easement rights and further
agrees to waive any claim of damage to the encroaching deck and screen

enclosure arising out of either the County's and Association's maintenance
activities within the Easement Area, whether such damage is intentional or
unintentional.
3. The County agrees that until otherwise notified, Wolfe may continue the use of
the deck and screen enclosure within the Easement Area, to the extent shown on
Exhibit B. The County retains the right, however, in its sole discretion, to demand
by written request that the Encroachment be removed from the Easement Area.

receipt of such request.
4. This Easement Use Agreement shall be recorded in the Public Records of Collier
County, Florida, at Wolfe's sole cost and expense. This Agreement is intended to
bind the Parties, together with their respective successors, assigns and heirs.
IN WITNESS WHEREOF, the parties hereto have caused this Easement Use Agreement
to be executed as of the day, month and year as first above written.
