9/22/2015 17.C. EXECUTIVE SUMMARY This item requires that ex parte disclosure be provided by Commission members. Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve Petition VAC-PL20150001516 to vacate a portion of the 25-foot drainage easement being a part of Lot 4, Nature Pointe, as recorded in Plat Book 20, pages 20 through 22, of the public records of Collier County,Florida, also being a part of Section 35, Township 49 South, Range 25 East, Collier County,Florida, being more specifically shown in Exhibit A. OBJECTIVE: To adopt a Resolution to vacate a portion of the 25-foot drainage easement being a part of Lot 4, Nature Pointe, as recorded in Plat Book 20, pages 20 through 22, of the public records of Collier County, Florida, also being a part of Section 35, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A. CONSIDERATIONS: Petition VAC-PL20150001516 has been received by the Development Review Division, Growth Management Department from Richard D. Yovanovich, Esq., of Coleman Yovanovich & Koester, P.A., as agent for the property owner, to vacate a portion of the 25-foot drainage easement being a part of Lot 4, Nature Pointe, as recorded in Plat Book 20, pages 20 through 22, of the public records of Collier County, Florida, also being a part of Section 35, Township 49 South, Range 25 East, Collier County, Florida. The 15-foot wide portion of the drainage easement being vacated is not necessary for the proper function of the water management system and will not affect the adjoining properties as there is no east-west Swale system along the backs of the lots. There will be a yard drain and 8 inch retaining wall that will be installed in the remaining 10 foot of the drainage easement for water runoff. (See attached site plan). There is no public detriment resulting from the vacation of the drainage easement, because the vacation will not adversely affect the stormwater and drainage management of the area. Lots 2 (2014) and 8 (2009) had also vacated the same portion of the drainage easement. See attached Resolutions. The Development Review Division has reviewed this petition and found no reason for any objection. Letters of no objection from abutting property owners have been received from all who responded and a letter of no objection was received from the Nature Pointe Homeowner's Association, who is also a holder of the subject drainage easement. FISCAL IMPACT: The Development Review Division staff has collected a 52.000 "Petition to Vacate' fee from the petitioner which covers the County's cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this Executive Summary. Packet Page -2439- 9/22/2015 17.C.
