PITAL, LLC, (hereinafter referred to as "Mortgagee-), in favor of the BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER
COUNTY, AND AS EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY WATER-
SEWER DISTRICT, its successors and assigns (hereinafter referred to as "County").

collectively be referred to herein as the "Mortgage":

Official Records Book 2437, Page 1791, of the Public Records of Collier County,
Florida, as modified.
A certain Assignment of Leases and Rents from Pelican Strand, Ltd. in favor of Credit
Suisse First Boston Mortgage Capital, LLC, recorded in Official Records Book 2437,
Page 1834, of the Public Records of Collier County, Florida.
A certain UCC-1 Financing Statement from Pelican Strand, Ltd. in favor of Credit Suisse
First Boston Mortgage Capital, LLC, recorded July 6, 1998 in Official Records Book
2437, Page 1848, of the Public Records of Collier County, Florida.
WHEREAS, County has requested and received from the fee simple owner of the
Encumbered Property non-exclusive easements for the installation and maintenance of water
and sewer utility facilities over and across a portion of the encumbered premises legally
described in Exhibit "A" attached hereto and incorporated herein by virtue of this reference,
which premises are hereinafter referred to as the "Easement Property".

WHEREAS, County has requested that Mortgagee consent to, join in and subordinate
its Mortgage to the interest that County has in the Easement Property to which request
Mortgagee has agreed.
NOW, THEREFORE, in consideration of TEN ($10.00) DOLLARS and other good and
valuable consideration, the receipt of which is hereby acknowledged, the Mortgagee does
hereby consent to, join in and subordinate the lien of its Mortgage to the grant of that certain
easement described herein over, under, and across the Easement Property and any interest of
the County in any water and sewer utility facilities located therein or affixed thereto. Except
as subordinated to the easement described herein over, under, and across the Easement
Property or any water and sewer utility facilities located therein or affixed thereto, said
Mortgage shall remain otherwise in full force and effect.

did say that all of the persons, firms, and corporations, including the general contractor and
all subcontractors, who have furnished services, labor or materials according to plans and
specifications, or extra items, used in the construction or repair of water and sewer utility
facilities on the real estate hereinafter described, have been paid in full and that such work has
been fully completed and accepted by the owner.
Affiant further says that no claims have been made to the Owner by, nor is any suit

in this affidavit through June 26, 2000, including but not limited to, information
requested from the Florida Secretary of State relative to any Uniform
Commercial Code financing statements.
The record owner of some of the real property described herein is THE STRAND,
LTD., a Florida limited partnership, formerly known as PELICAN STRAND, LTD.
(hereinafter "Owner"). The Owner acquired record title to the subject real
property by instruments recorded at Official Records Book 2117, Pages 654 and
657, of the Public Records of Collier County, Florida, attached hereto as Exhibit
The record owner of the balance of the real property is THE LINKS AT THE
STRAND DEVELOPMENT CORPORATION, a Florida corporation ("The Links").
Copies of recorded deeds to The Links are attached hereto as Exhibit "B-1 ."
The Affiant has examined the partnership information for THE STRAND, LTD.,
a Florida limited partnership, and is of the opinion that the same is current and
active within the State of Florida, and is currently authorized to do business in
the State of Florida.
The sole general partner of THE STRAND, LTD. is The Strand Development
Corporation of Naples, a Florida corporation, formerly known as PELICAN
STRAND DEVELOPMENT CORPORATION. The undersigned has reviewed
corporate information for said corporation, and is of the opinion that it is duly
organized under the laws of the State of Florida, and is authorized to execute
documents on behalf of the partnership.

This is to inform you that the above referenced project has been
granted preliminary approval by Engineering Review in compliance
with Collier County Land Development Code, Section 3.2.6.5.2.
All water and sewer facilities approved and accepted and required
to be maintained by Collier County shall be conveyed to the
County pursuant to the provisions set forth in Collier County
Ordinance No. 97-17, as amended.
You are reminded that it is your responsibility to petition the
Development Services Director for final approval of the
improvements upon the expiration of the minimum one (1) year
maintenance period. After satisfactory completion of all final
inspections, the Board of County Commissioners shall adopt a
resolution giving final approval of the required improvements,
acknowledging the dedication(s) of the final subdivision plat and
establishing County responsibility for maintenance of the
required improvements if it is the Board's desire to accept and
maintain the facilities.

WARRANTY
The Undersigned, Port of the Islands Construction, Inc., does hereby warranty and/or guarantee the
Sanitary Sewer facilities of The Links at the Strand, to be free from defects in material and workmanship
for a period of one (1) year from the date of acceptance by the Collier County Board of County
Commissioners. The undersigned party further agrees that they will, at their own expense, repair and
replace all such defective work and all other work damaged by said defective work under this Warranty-
Guaranty.
It is further understood that the consideration for the giving of this warranty and/or guarantee is
required by the General Conditions and Specifications under which the contract was let.

Sewer Line Testing and Inspection
To Whom It May Concern:
Based on our review of the sewer videotapes, video reports, field inspections and lamping, the
sanitary sewer system has been found to be in accordance with Collier County Land Development
requirements. The sanitary sewer system for this phase of construction has been lamped and
found to be in acceptable condition. Infiltration tests have been performed and found to be
acceptable. No further testing was deemed necessary.
