9/8/2015 17.A. EXECUTIVE SUMMARY This item requires that ex parte disclosure be provided by Commission members. Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve Petition VAC- PL20150001030, to disclaim, renounce and vacate the County and the public interest in three (3) Utility Easements as shown and recorded in Official Record Book 4101, page 701, Official Record Book 4171, page 634 & Official Record Book 5065, page 1479 and two (2) Drainage Easements as shown and recorded in Official Record Book 5121, page 1593 & Official Record Book 5121, page 1734, all in the public records of Collier County, Florida, located in Section Township 48 South, Range 26 East, Collier County, Florida. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in three (3) Utility Easements as shown and recorded in Official Record Book 4101, page 701, Official Record Book 4171, page 634 & Official Record Book 5065, page 1479 and two (2) Drainage Easements as shown and recorded in Official Record Book 5121, page 1593 & Official Record Book 5121, page 1734, all in the public records of Collier County, Florida, located in Section 7, Township 48 South, Range 26 East, Collier County, Florida. CONSIDERATIONS: Petition VAC- PL20150001030 has been received by the Development Review Division, Growth Management Department from David V. Willems, P.E., of Waldrop Engineering, P.A., as agent for the property owner, to vacate three (3) Utility Easements as shown and recorded in Official Record Book 4101, page 701, Official Record Book 4171, page 634 & Official Record Book 5065, page 1479 and two (2) Drainage Easements as shown and recorded in Official Record Book 5121, page 1593 & Official Record Book 5121, page 1734, all in the public records of Collier County, Florida, located in Section 7, Township 48 South, Range 26 East, Collier County, Florida. The property owner proposes to replace the vacated easements with substantially simi ar easements that were dedicated in the Corsica at Talis Park Replat, which was approved by the Board on June 9, 2015. The proposed vacation will not cause a public detriment because the replacement easements will not have adverse effects on the existing drainage system and public utilities. The Development Review Division has reviewed this petition and found no reason for objection. Letters of no objection were received from FP &L, Comcast, CenturyLink, Collier County Sheriff's office, Talis Park HOA and Talis Park CDD. FISCAL IMPACT: Growth Management Department, Development Review Division staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition.
