EXECUTIVE SUMMARY
That the Board of County Commissioners reimburse Commissioner Hiller for the legal fees
incurred in successfully defending against two Ethics Complaints.
OBJECTIVE: To obtain reimbursement of legal fees and costs incurred in successfully
defending against two ethics complaints.
CONSIDERATIONS:
1. By letter dated January 17, 2014, I was advised by the State of Florida Commission on Ethics
that a complaint had been filed against me by John Lundin involving my official duties. A copy
of this letter and the complaint is included as back -up to this agenda item. At this time I was
assisted by the County Attorney. Mr. Lundin's later attempt to withdraw the complaint was
denied by the Commission. With that denial, the County Attorney advised me that I should
obtain expert counsel to defend me. On March 11, 2015, the Commission on Ethics issued a
Public Report and Order which fully exonerated me, a copy of which is also included.
2. By letter dated December 23, 2014, I was advised by the State of Florida Commission on
Ethics that a complaint had been filed against me by Randy Johns. A copy of this letter and the
complaint is included as back -up to this agenda item. The matter involved my decision to abstain
on a vote to accept certain documents into the official record, and my failure to file Form 8B
(Memorandum of Voting Conflict). The County Attorney was of the opinion that I did not need
to file Form 8B as there was no voting conflict, and afterwards advised me to use outside counsel
as he was a potential witness. On April 22, the Commission on Ethics issued a Public Report and
Order which fully exonerated me, a copy of which is also included.
FISCAL IMPACT: $16,000. Funding source is Fund 516 (self - insurance fund)
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: The Board's policy with respect to providing a legal defense
and paying legal expenses for County Commissioners and Staff is set forth in Resolution No. 95-
632, which with respect to ethics charges provides in relevant part as follows:
5. The County shall pay legal fees and /or costs incurred by County persons in cases involving
formal ethics charges subject to the Iimitations provided herein:
a. The ethics charges arose from conduct related to the perfonnance of official duties and while
serving a valid public purpose. (citation omitted)
Condition met. Both ethic charges arose out of the performance of Commissioner Hiller's
official duties. See accompanying complaints.
b. The County person has prevailed and successfully defended against the ethics charges.

c. The legal fees and /or costs charged are reasonable in amount.
Condition met. The County Attorney has reviewed the costs and believes that they are very
reasonable. Commissioner Hiller has advised me that she was able to negotiate the lowest
possible rate.
d. The County person has first notified the County administration and legal staff of the
pendency of the charges and has permitted the County the opportunity to either directly provide
counsel or allow said County person to choose his/her own counsel.
Condition met. Both the County Manager and the County Attorney were consulted by
Commissioner Hiller. The County Attorney worked closely with Commissioner Hiller on both
matters, until there came a point in the proceedings when the County Attorney advised the
Commissioner it was now time for her to obtain her oven counsel.
e. The charges have not resulted from the willful failure of the County person to follow the
legal advice furnished by the Office of the County Attorney, unless the Board of County
Commissioners specifically finds, at a public meeting, that said failure to follow legal advice was
for the reasons within the County person's scope of employment and served a valid public
purpose.
Condition met.
f. The legal fees and /or costs incurred by a County person during the investigatory, pre - charge
stages of an ethics complaint shall be paid by the County only for proceedings involving
potential civil and /or ethics sanctions for the County person and where the allegations are
ultimately determined to be unfounded and to have arisen from conduct related to the
performance of official duties and while serving a valid public purpose. (remainder omitted)
Condition met.
Typically, requests for representation to defend against legal charges would first go to the
Board. The procedure for Ethics complaints, sets forth above, does not involve the Board until
the successful defense of the complaint. The reason for this is that by law an ethics complaint, as
well as all of the procedures and records relating to the complaint, is confidential and exempt
from the public records law unless waived by the person against whom the complaint was filed.
In order to better defend, Commissioner Hiller wished these matters to be kept confidential until
the conclusion of these proceedings.
With the above noted, this item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK

A RESOLUTION SETTING FORTH THE POLICY OF THE BOARD
OF COUNTY COMMISSIONERS WITH REGARD TO PROVIDING A
LEGAL DEFENSE A2M PAYING LEGAL EXPENSES OF COUNTY
COMMISSIONERS, COUNTY STAFF AND COUNTY ADVISORY
BOARD MEMBERS.
WHEREAS, the Board of County Commissioners and the Collier
County management and legal staff are constantly presented with
the necessity for making decisions regarding all phases of
County policy, management and legal counsel, respectively; and
WHEREAS, local governments and their employees have
recently become subject to increasing numbers of lawsuits based
upon state and federal laws; and
WHEREAS, it is essential to the effective operation of
County government that policy, management and legal decisions
be made competently, in the public interest, and with the
threat of personal liability for board and staff members for
making said decisions being maintained at a minimum so as to
avoid the "chilling effect" on the proper and diligent
performance of public duties recognized by the Florida Supreme
Court in Thornber v. City of Fort Walton Beach, 568 So.2d. 914
(1990); and
WHEREAS, Florida statutory and case law, as well as
Attorney General opinions (hereafter referred to as "AGO "), set
forth the requirements and discretion which are afforded to the
local governing body to formulate a policy regarding the
provision of counsel and payment of legal expenses for Board
members, County staff and advisory board members who are
involved in litigation arising out of or in connection with the
performance of official duties and while serving a valid public
purpose; and -
WHEREAS, Collier County insurance policies currently
include County employees as well as Board members and members
of the Administrator's and County Attorney's staff within the
scope of coverage, provided that said persons are acting within
the scope of their employment and do not act criminally or
fraudulently; and

WHEREAS, the Board of County-Commissioners (hereafter also
referred to as "Board ") desires to hereby set forth and
formalize its policy with regard to the provision of legal
counsel and the payment of legal expenses incurred by County
Commissioners and administrative and legal staff so as to
promote competent decisions and conduct in the public interest
while reducing the threat, intimidation and chilling effect on
performance of official duties created by potential personal
liability for County Commissioners and County staff members
while acting in the scope of their official duties and while
serving a valid public purpose.
WHEREAS, the various advisory boards, quasi - judicial
boards and regulatory boards (hereafter also collectively
referred to as "advisory boards) ") formed by the Board of
County Commissioners, and the members thereof who are appointed
by the Board of County Commissioners, serve a critical function
with regard to the operation of Collier County Government; and
WHEREAS, the members of such boards serve on a volunteer'
basis without compensation for the time spent in performing
their duties and functions; and
WHEREAS, said boards and board members are regarded by 'the .
Board of County Commissioners as being within the umbrella of
legal protection afforded to the Board of County Commissioners
and other Collier County employees; and
WHEREAS, the Board hereby desires to set forth and
formalize its policy with regard to the provision of legal
counsel and the payment of legal expenses incurred by advisory
board members so as to promote competent decisions and conduct
in the public interest while reducing the threat, intimidation
and chilling effect on performance of official duties created
by potential personal liability for advisory board members
while acting in the scope of their official duties and while
serving a valid public purpose.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:

1. Definition' of "County person s) "t As used in this
Resolution, the term „County person(s)" shall mean and include
the members of the Board of County Commissioners, the County
Administrator and his staff, the County Attorney and his staff,
all employees of the Board of County Commissioners as well as
the Collier County Airport Authority Director and his staff,
the Director and staff of any other County- created authority,
the officers and staff of any dependent or other special
district for which the Collier County Board of County
Commissioners is the governing body or ex- officio the governing
body thereof, and any person appointed by the Board of County
Commissioners to a Collier County Advisory Board,
quasi- judicial board or regulatory board formed by the Board of
County Commissioners of Collier county, Florida.
2. Pursuant to Section 111.07, Florida Statutes, and
Thornber v. City of Fort Walton Beach, 568 So.2d 914 (Fla.
1990), the Board hereby resolves to provide legal
representation to County persons in civil actions and in civil
rights actions subject to the limitations set forth herein.
a. Legal representation shall be provided in civil
actions and in civil rights lawsuits only if the
litigation involving the County person to be
represented arises out of or in connection with
the performance of official duties and while
said County person was serving a valid public
purpose. No representation shall be provided in
tort actions if the County person acted or
failed to act in bad faith, with malicious
purpose, or in a manner exhibiting wanton and
willful disregard of human rights, safety or
property. No representation shall be provided
to any County person in a civil action or civil
rights action where said County person acted or
failed to act with intent to harm. No
representation shall be provided in any case

where the County person has willfully failed to
follow the legal advice furnished by the Office
of the County Attorney, unless the Board of
County Commissioners specifically finde,•.at a
public meeting, that said failure to follow
legal advice was for reason(s) within the County
person's scope of employment and served a valid
public purpose.
b. Collier County shall at all times have the
discretion to determine whether to directly
represent such individual through the County
Attorney's office or to select counsel to
represent said County person in the civil action
or civil rights action. If a County person
chooses to obtain private legal counsel without
prior authorization from Collier County, all
fees and /or costs incurred by such person shall
be the sole responsibility of said person and
Collier County shall accept no responsibility
for payment of legal fees and /or costs.
C. Any legal fees and /or costs properly payable
under this Policy must be reasonable in amount.
d. Pursuant to Section 111.07, .Florida Statutes,
any attorney's fees and /or costs paid or
incurred by the County for any County person who
is found to be personally liable by virtue of
acting outside the scope of employment, in bad
faith, with malicious purpose, or in a manner
exhibiting wanton and willful disregard of human
rights, safety or' property, may be recovered by
the County in a civil action against such County
person.
e. Notwithstanding anything else stated in this
section or this Resolution, the Board shall have
the sole and absolute discretion allowed by

Section 111.07, Florida Statutes, as well as by
applicable case law, to not provide legal
representation and to instead reimburse any
County person for reasonable attorney-. fees
and /or costs in the event 'that said County
person prevails in the civil or civil rights
action.
3. Pursuant to Sections 111.071 and 111.072, Florida
Statutes, the County shall pay for final judgments, settlements
and /or costs involving County persons in civil actions and in
civil rights actions subject to the limitations provided
herein.
a. Collier County shall pay final judgments,
settlements and /or costs involving County
persons only where the litigation arose out of
or in connection with the performance by the
County person of official duties and while
serving a valid public purpose. No final
judgment, settlement or costs shall be paid for
by the County in a civil action or a civil
rights action if the County person against whom
the final judgment, settlement and /or costs have
been imposed has acted or failed to act with
intent to harm. The County shall not pay any
final judgment, settlement and /or costs in tort
actions where a County person has acted or
failed to act with bad faith, malice or with
wanton and willful disregard of human rights,
safety or property. No judgment and /or costs `
shall be paid in any case where the County
person has willfully failed to follow the legal
advice furnished by the Office of the County
Attorney, unless the Board of County
Commissioners specifically finds, at a public
meeting, that said failure to follow legal

advice was for reasons within the County
person's scope of employment and served a valid
public purpose.
b. Any final judgments, settlements and /or 'costs
paid or incurred by the County shall be in
strict adherence with the sovereign immunity
recovery limits set forth in Section 768.28,
Florida Statutes.
C. If the County person has had private legal
representation in the case, contrary to the
provisions of Section (2)(b) of this Policy,fany
final judgment, settlement and /or costs imposed
shall be the sole responsibility of said person
and Collier County shall accept no
responsibility for payment of the final
(� YJudgment, settlement and /or costs.
d. Pursuant to Section 111.071(4), this section is
not intended to be a waiver of sovereign
immunity or a waiver of any other defense or
immunity to such lawsuits.
4. In cases where a County person is formally charged
with a criminal violation, the County shall pay the legal fees
and /or costs incurred by said County person only under the
following circumstances:
a. The charges against the County person arose out
of or in connection with the performance of
official duties and while serving a valid public
purpose.
b. The County person has been acquitted or the
charges dismissed. Lomelo v. City of Sunrise,
423 So. 2d. 974 (4th DCA 1982), pet. for rev.
dismissed at 431 Sc.2d. 988 (Fla. 1983), and AGO
89 -33.
C. The legal fees and /or costs charged are
reasonable in amount.

The bounty person has first notified the County
administration and legal staff of the pendency
of the charges and has permitted the County the
opportunity to either directly provide counsel
or to allow said County person to choose his /her
own counsel.
e.
The charges have not resulted from the willful
failure of the County person to follow the legal
advice furnished by the Office of the County
Attorney, unless the Board of County
Commissioners specifically finds, at a public
meeting, that said failure to follow legal
advice was for reasons within the County
person's scope of employment and served a valid
.public purpose.
f.
The legal fees and /or costs incurred by a County
person during the investigatory, pre— charge
stages of a criminal case shall be paid by the
County only for proceedings involving potential
criminal liability for the County person and
where the allegations are ultimately determined
to be unfounded and to have arisen from conduct
related to the performance of official duties
and while serving a valid public.purpose. AGO
94 -11. The provisions of Subsections 4b, c, d
and a of this Resolution shall also govern these
cases.
g.
In the event that the County person has been
provided legal representation by the County and
the County person is found guilty of a criminal
charge, the County may recover from the county
person in a civil action all legal fees and /or
costs paid or incurred by the County.

Commission or other appropriate tribunal having
Jurisdiction over the case to have committed
ethical violations, the County may recover from
the County person in a civil action all legal
fees and /or costs paid or incurred by the
County.
h. Nothing in this section shall be construed to
preclude the County Attorney from requesting
formal or informal ethics opinions on behalf of
one or more commissioners.
6. The County shall pay legal-fees and /or costs incurred
by County persons in cases involving non - county administrative
and /or regulatory proceedings and /or formal charges subject to
the limitations provided herein:
a. The proceedings and /or charges arose from
conduct related to the performance of official
duties and while serving a valid public purpose.
b. The County person has prevailed and successfully
defended against the proceedings and /or charges.
C. The legal fees and /or costs charged are
reasonable in amount.
d. The County person has first notified the County
Administration and legal staff of the pendency
of the proceedings and /or charges and has
permitted the County the opportunity to directly
provide counsel or to allow said County person
to choose his /her own counsel.
e. The charges and /or proceedings have not resulted
from the willful failure of the County person to

follow the legal advice furnished by the office
of the County Attorney, unless the Board of
County Commissioners specifically finds, at a
public meeting, that said failure to follow
legal advice was for reasons within the County
person's scope of employment and served a valid

The legal fees and /or costs incurred by the
County person during the pendency of the
proceedings and /or the investigatory, pre- charge
stages of an administrative or regulatory case
shall be paid by the County only for proceedings
and /or charges involving potential civil and /or
criminal liability and /or administrative/
regulatory sanctions for the County person and

other "County person" defined in section 1 of
this Resolution.

The Board member must prevail in said
litigation.

The legal fees and /or costs are reasonable in
amount.

The Board member shall have first notified the
Board of County Commissioners, the County

Administrator and the County Attorney prior to
the commencement of -the litigation and shall
have permitted the County the opportunity to
either directly provide counsel or to allow said
Commissioner to choose his /her own counsel.
f.
The litigation has not resulted from the willful
failure to follow the legal advice furnished by
the office of the County Attorney, unless the

Board of County Commissioners specifically
finds, at a public meeting, that said failure to
follow legal advice was for reasons within the
Commissioner's scope of employment and served a
valid public purpose.
g.
In the event that the Commissioner has been
provided legal representation by the County and
the Commissioner does not prevail in the
litigation, then the County may recover from the
Commissioner in a civil action all legal fees
and /or costs paid or incurred by the County.

implementing this policy shall initially be made by the County
Administrator and /or his designee and the Office of the County
Attorney in cooperation and consultation with each other's
respective offices. Both offices are hereby delegated the
power to make any lawful and reasonable investigation and
evaluation of cases arising under this policy. Said evaluation
shall take into account all available relevant information in
addition to the nature, type, number and substance of the
allegations contained in any pleadings filed and /or served in
any legal proceeding. All final determinations regarding the
implementation and administration of this policy shall be made
only by the Board of County Commissioners which is in
accordance with AGO's B5 -51, 89 -22, 90 -74 and 91 -58. The Board
shall also make all final determinations regarding the
provision of a legal defense and /or paying legal expenses of
County persons for any type of legal claim or suit arising from
• County person's performance of official duties while serving
• valid public purpose if said type of claim or suit is not
specifically addressed by this Resolution.
9. Collier County Board of County Commissioners
Resolution Nos. 85 -126 and 85 -178 are hereby repealed and
superseded in their entirety.
This Resolution adopted after motion, second and majority
vote favoring same.

jurisdiction of the Commission: The Commission on Ethics has the authority to review and
investigate complaints concerning possible breaches of the public trust (violations of the State's ethics
laws) by public officers, public employees, and similar persons involved with state and local government
in Florida, including Executive Branch lobbyists. Complaints about the actions of Judges should be
brought to the Judicial Qualifications Commission, and complaints against attorneys in private practice
should be made to The Florida Bar.
Procedures followed by the Commission: The Commission follows a three -stage process when it
considers complaints.
The first stage is a determination of whether the allegations of the complaint are legally
sufficient, that is, whether the complaint indicates a possible violation of any law over which the
Commission has jurisdiction. If the complaint is found not to be legally sufficient, the Commission
will order that the complaint be dismissed without investigation and all records relating to the
complaint will become public at that time.
If the complaint is found to, be legally sufficient, the investigative staff of the Commission
will begin an investigation. The second stage of the Commission's proceedings involves this
investigation of the complaint and a decision by the Commission of whether there is probable cause
to believe that there has been a violation of any of the ethics laws. If the Commission finds that
there is no probable cause to believe that there has been a violation of the ethics laws, the
complaint will be dismissed and will become public at that time.
If the Commission finds that there is probable cause to believe there has been a violation of
the ethics laws, the complaint becomes public and enters the third stage of proceedings. The third

Attorney's Fees: If the complaint is dismissed, the person against whom the complaint is filed can file
a petition to have the complainant pay his or her attorney's fees, which will be awarded after a hearing
if the Commission finds that the complaint was made with a malicious intent to injure the off'icial's
reputation, the complainant knew that the statements made about the official were false or made the
statements about the official with reckless disregard for the truth, and the statements were material.
Confidentiality: The Commission cannot accept anonymous complaints and cannot keep the identity
of the complainant or any witness confidential. A complaint, as well as all of the Commission's
proceedings and records relating to the complaint, is confidential and exempt from the public records
law either until the person against whom the complaint is made waives confidentiality, or until the
complaint reaches a stage in the Commission's proceedings where it becomes public. The
Commission's procedures on confidentiality do not govern the actions of the complainant or the person
against whom the complaint is made.

On Nov. 13, 2013, I sent an email to the Naples Daily News, critical of Republican
Collier County Commissioner Georgia Hiller I "carbon copied" the email to
Commissioner Hiller. (See attached email)
Commissioner Hiller responded by forwarding my email to Collier County
Manager Leo Ochs, requesting that the county government IT department "illegally
hack" my emails in order to obtain any "blind copy" email addresses, not listed on
the emails, and to forward the email lists to her for personal use.
The protection of email from unauthorized access and inspection is known as
electronic privacy. Email is equated with letters and thus legally protected from all
forms of eavesdropping. The interception of email transmission is a federal crime
under the Electronic Communications Protection Act (ECPA) (18 U.S.C.A
2517(4). The Fourth Amendment to the United States Constitution prohibits
unreasonable searches and seizures and requires any warrant to be judicially
sanctioned and supported by probable cause.
Commissioner Hiller has violated Florida Statutes 112.313 "Standards of conduct
for public officers, employees of agencies, and local government attorneys."
(6) MISUSE OF PUBLIC POSITION. —No public officer, employee of an agency,
or local government attorney shall corruptly use or attempt to use his or her official
position or any property or resource which may be within his or her trust, or
perform his or her official duties, to secure a special privilege, benefit, or
exemption for himself, herself, or others. This section shall not be construed to
conflict with s. 104.31.
(8) DISCLOSURE OR USE OF CERTAIN INFORMATION. —A current or
former public officer, employee of an agency, or local government attorney may
not disclose or use information not available to members of the general public and
gained by reason of his or her official position, except for information relating
exclusively to governmental practices, for his or her personal gain or benefit or for
the personal gain or benefit of any other person or business entity.

ORDER DENYING WITHDRAWAL OF COMPLAINT
On Friday, June 6, 2014, the Commission on Ethics met in executive session '.and
considered the request for withdrawal of this complaint filed by the Complainant, John Lundin.
The Commission voted to deny withdrawal pursuant to Commission Rule 34- 5.0025,
F.A.C., 1 for the following reasons:
1. The Complainant has filed a request for withdrawal of the complaint (copy
attached hereto) stating:
1 The Rule provides:
34- 5.0025 Withdrawal of Complaints. After a complaint has been filed
with the Commission, the Commission may permit the complainant(s) to
withdraw the complaint only for good cause shown. Withdrawal shall be
requested in writing, signed by the complainant(s) and witnessed by a notary
public, stating the facts and circumstances constituting good cause. The Executive
Director shall prepare a written recommendation regarding disposition of the
request which shall be given to the Commission together with the request. "Good
cause" shall be determined based upon the legal sufficiency or insufficiency of the
complaint to allege a violation of the Code of Ethics or other breach of public
trust, the stage in disposition of the complaint arrived at before the request was
received, and the reasons given by the complainant(s) for wishing to withdraw the
complaint. If withdrawal is permitted, the Commission shall order the complaint
dismissed and shall proceed in accordance with Rule 34 -5.002 as if the complaint
had been found insufficient under that rule.

I request to withdraw Complaint No. 14 -011. Upon further review of the
evidence submitted in the complaint, while there is probable cause to believe
there is a violation of the State of Florida Ethics Laws, the evidence is not legally
sufficient for the Commission to investigate, or to recommend a penalty, or to
conduct a public hearing.
2. The complaint is adequate as to its sufficiency to allege possible violation of
Section 112.313(6), Florida Statutes (misuse of public position), and Section 112.313(8), Florida
Statutes (disclosure or use of certain information), by the Respondent, and an order to investigate
has been issued.
3. Further, the complaint is not in a very early stage of disposition. The order to
investigate has been issued and the investigation has been assigned to a Commission
investigator.
4. Thus, in view of the reasons for withdrawal offered by the Complainant, the
sufficiency of the complaint to allege possible violations, and the stage of disposition of the
complaint, the Commission finds that good cause for withdrawal has not been shown.
Accordingly, the request for withdrawal is denied.

In 2010, Georgia Hiller, Republican Party candidate for Collier Board of County Commissioners,
campaigned on a platform of reform and transparency in government. Now up for re- election in
2014, Commissioner Hiller has voted to repeal County Resolutions 93-43 and 99 -410, which require
board approval of all commissioner reimbursements for a valid public purpose, such as the cost of
attending community events and travel expenses.
Republican Commissioner Tom Henning, who was fined by the Florida Ethics Commission earlier
this year for filing false financial statements, requested that payment for the individual itemized
expenses be removed from public meeting agendas, to now be hidden in an annual budget report,
approved by county staff, accessible only by burdensome public records requests.
Ever since Commissioner Hiller became chairwoman last December, there has been a slow pattern
of corruption in Collier County government; the $536,000 Blocker payoff for campaign donations,
gutting of the Ethics Ordinance, firing of the Airport Director, censorship of Public Comment, the
Golden Gate Estates oil drilling controversy, and now the public concealment of commissioner
expenses.

In 2010, Georgia Hiller, Republican Party candidate for Collier Board of County Commissioners,
campaigned on a platform of reform and transparency in government. Now up for re- election in
2014, Commissioner Hiller has voted to repeal County Resolutions 93-43 and 99 -410, which require
board approval of all commissioner reimbursements for a valid public purpose, such as the cost of
attending community events and travel expenses.
Republican Commissioner Tom Henning, who was fined by the Florida Ethics Commission earlier
this year for filing false financial statements, requested that payment for the individual itemized
expenses be removed from public meeting agendas, to now be hidden in an annual budget report,
approved by county staff, accessible only by burdensome public records requests.
Ever since Commissioner Hiller became chairwoman last December, there has been a slow pattern
of corruption in Collier County government; the $538,000 Blocker payoff for campaign donations,
gutting of the Ethics Ordinance, firing of the Airport Director, censorship of Public Comment, the
Golden Gate Estates oil drilling controversy, and now the public concealment of commissioner
expenses.

NBC2 first showed you exclusive video of a Collier County administrator, who was pulled over in his
county vehicle after consuming alcohol.
He was pulled over by Collier County deputies and given a field sobriety test, then allowed to drive
home with a warning.
Digging deeper - NBC2 found there's no county policy that prohibits drinking then driving a county
vehicle.
"Every job I've had in my life, it's very strict policy that you're not allowed to drink and use a company
vehicle," said John Lundin of Collier County.
We're not naming the county employee involved in this incident because he wasn't cited or arrested.
But on Tuesday at Collier County Commission, the incident came up during public comment and
now a change to county policy is in the works.
"I think many of us here in this audience saw the video and it involves drinking and driving. As a
citizen, taxpayer, I just have my concerns about that," said Doug Fee of Naples.
It fueld a fire for a change in county policy.
"I think the Board of County Commissioners might take the opportunity to submit some kind of letter
or piece saying to the citizens here that really isn't acceptable and that you don't want your
employees to be doing this," said Fee.
Only Commissioner Tom Henning spoke out about the incident in regards to county policy - noting
he and County Manager Leo Ochs talked one -on -one.
"I asked him if he'd have a problem if the board directed him to create an update to the County
Manager Administrative Procedures on those vehicles. He says, 'Commissioner, I'm working on it
right now, "' Henning said.
Drinking and driving a county vehicle in the future could soon be banned in Collier County.
"I want to just make sure it complies to all laws and he didn't have a problem with that - he's doing it
because of perception, not reality so I commend him for that," Henning said.

Jurisdiction of the Commission: The Commission on Ethics has the authority to review and
investigate complaints concerning possible breaches of the public trust (violations of the State's ethics
laws) by public officers, public employees, and similar persons involved with state and local government
in Florida, including Executive Branch lobbyists. Complaints about the actions of Judges should be
brought to the Judicial Qualifications Commission, and complaints against attorneys in private practice
should be made to The Florida Bar.
Procedures followed by the Commission: The Commission follows a three -stage process when it
considers complaints.
The first stage is a determination of whether the allegations of the complaint are legally
sufficient, that is, whether the complaint indicates a possible violation of any law over which the
Commission has jurisdiction. If the complaint is found not to be legally sufficient, the Commission

Please investigate two Possible violations of law.
Section 286.012, F.S., provides:
No member of any state, county or munkipa governmental board, commission, or agency
who is present at any meeting of any such body at which an official decision, ruling., or
other official act is to be taken or adopted may abstain from voting ... a vote shall
be recorded or counted for each such member present, except when, with respect to any_
such member, there is or appears to be, a possible conflict of interest under ... s.112.311,
s. 112.313, or s. 112.3143, F.S. (e.s.)
1123143 Voting conflicts. —
(1) As used in this section:
(a) "Principal by whom retained" means an individual or entity, other than an agency as defined in
s. 112.312(2), that for compensation, salary, pay, consideration, or similar thing of value, has permitted
or directed another to act for the individual or entity, and includes, but is not limited to, one's client,
employer, or the parent, subsidiary, or sibling organization of one's client or employer.
(b) "Public officer" includes any person elected or appointed to hold office in any agency, including
any person serving on an advisory body.
(c) "Relative" means any father, mother, son, daughter, husband, wife, brother, sister, father -in -law,
mother -in -law, son -in -law, or daughter -in -law.
(d) "Special private gain or loss" means an economic benefit or harm that would inure to the

following factors must be considered when determining whether a special private gain or loss exists:

2. The nature of the interests involved.

the Commission's Advocate, the Commission on Ethics finds that there is no probable cause to
believe the Respondent, as a member of the Board of County Commissioners of Collier County,
violated Section 112.313 (6), Florida Statutes, by using or attempting to use County resources to
obtain email addresses for her personal use, and finds that there is no probable cause to believe
the Respondent violated Section 112.313 (8), Florida Statutes, by using information not available
to the general public and obtained because of her public position, as alleged in this complaint.
Accordingly, this complaint is dismissed with the issuance of this public report.

PUBLIC REPORT AND ORDER DISMISSING COMPLAINT
On Friday, April 17, 2015, the Commission on Ethics met in executive session and
considered this complaint for legal sufficiency pursuant to Commission Rule 34- 5.002, F.A.C.
The Commission's review was limited to questions of jurisdiction of the Commission and of the
adequacy of the details of the complaint to allege a violation of the Code of Ethics for Public
Officers and Employees. No factual investigation preceded the review, and therefore the
Commission's conclusions do not reflect on the accuracy of the allegations of the complaint.
The Commission voted to dismiss the complaint for legal insufficiency, based on the
following analysis:
1. This complaint was filed by Randy Johns of Naples. Florida.
2. The Respondent, Georgia Hiller, senn-es as a member of the Board of County
Commissioners of Collier County.
3. The complaint alleges that the Respondent introduced an item or measure to
accept into the official record (presumably., of the Board) certain banking services documents:
that the Respondent abstained from the vote on. the measure, but that no CE Form 8B,
Memorandum of Voting Conflict, was presented as an item on the agenda of the Board meeting
following the meeting at which the banl.-ing services documents were an item; and that on a

following date the Board "voted to approve the Agenda absent of Commissioner Hiller Form 8B
Memorandum of Voting Conflict." And, the complaint cites Sections 112.3143 and 286,012,
Florida Statutes. Further, pursuant to Commission on Ethics Rule 34- 5.002(1), Florida
Administrative Code, staff' of the Commission wrote the Complainant seeking additional
information regarding the allegations of the complaint; however, rather than providing
information responsive to staffs written contact, the Complainant wrote back:
in regard to Complaint No. 14 -244, I believe Georgia Hiller's actions may
not fall under Section 112 of the Florida Statutes (the Code of Ethics for Public
Officers and Employees) but rather [under] Section 286.012 (Voting Requirement
at Meetings of Governmental Bodies). As a result, I would like to withdraw my
complaint of an - Ethics Violation at this time.
4. The Complainant's desire to withdraNv his complaint does not comport with the
requirement of Commission on Ethics Rule 34- 5.0025, Florida Administrative Code, that
requests for withdrawal be notarized. Staff sent a letter to this effect to the Complainant,
explaining how to put his request in proper form. Also, staff telephoned the Complainant at the
telephone number listed for the Complainant on his complaint filing, after receiving the
comments from the Complainant quoted above, :and left a voice message for the Complainant to
return staffs call; but staff has received no response to either communication.
5. Despite citation to the statute, the complaint substantively fails to indicate a
possible violation of Section 112.3143(3)(a), Florida Statutes' (the portion of the voting conflicts
' Section 112.3143(3)(a) provides:
VOTING CONFLICTS. —No county, municipal, or other local public
officer shall vote in an official capacity upon any measure which would inure to
his or her special private gain or loss; which he or she knows would inure to the
special private Cain or loss of any principal by whom he or she is retained or to
the parent organization or subsidiary of a corporate principal by which he or she is
retained, other than an agency as defined in s. 112.312(2); or which he or she

law applicable to local, elected public officers such as county commissioners). When a local,
elected public officer is presented with a conflicting measure, the law requires three things of the
officer: statement of the officer's interest in the matter, abstention from the vote on the matter,
and completion and timely filing of a voting conflict memorandum (CE Form 8B). Assuming in
argument that the alleged measure presented the Respondent with a voting conflict, the
complaint does not allege that the Respondent failed to state her interest, failed to abstain, or
failed to complete and timely file the memorandum.' Rather, at most, the complaint indicates
that the Respondent may have not cast a vote when required to do so by Section 286.012, Florida
Statutes, a law which is not within the jurisdiction of the Commission on Ethics, which expresses
no penalty for noncompliance, and which allows abstention in a broader universe of items than
that requiring abstention under Section l 12.3143(3)(a).
Accordingly, this complaint is hereby dismissed for failure to constitute a legally
sufficient complaint with the issuance of this public report.
