WHEREAS, THE Collier County Board of CounW Commissioners adopted Ordinance 03-46 for the Aaesa Pointe Planned Unit Development PUD on September 23, 2003; and WHEREAS, following said action in adopting said Ordinance, a zoning atlas map number was omi~ed and such omission constitutes a scrivener's e~or. NOW, THEREFORE, BE IT ORDA~ED, BY the Board of CounW Commissioners of Collier CounW, Florida that: SECTION ONE: SCRIVENER'S ERROR AMENDMENT The title of Ordinance No. 03-46, the Artesa Pointe PUD, is hereby amended to read as follows: AN ORDINANCE AMENDING ORDINANCE NUMBER 91-102, THE COLLIER COUNTY LAND DEVELOPMENT CODE WHICH INCLUDES THE COMPREHENSIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF COLLIER COUNTY, FLORIDA BY AMENDING THE OFFICIAL ZONING MAPS NUMBERED 1603S AND 1603N AND BY CHANGING THE ZONING CLASSIFICATION OFTHE HEREIN DESCRIBED REAL PROPERTY FROM "RSF-3" TO "PUD" PLANNED UNIT DEVELOPMENT KNOWN AS ARTESA POINT PUD FOR PROPERTY LOCATED ON TIlE EAST SIDE OF COLLIER BOULEVARD (CR-951) AND THE SOUTH SIDE OF U.S. 41 (TAMIAMI TRAIL) EAST, IN SECTION 03, TOWNSHIP 51 SOUTH, RANGE 26 EAST, COLLIER COUNTY, FLORIDA, CONSISTING OF 82+ ACRES PROVIDING FOR THE REPEAL OF ORDINANCE NUMBER 02-1-5, THE HENDERSON CREEK PUD; AND BY PROVIDING AN EFFECTIVE DATE. SECTION TWO: SCRIVENER'S ERROR AMENDMENT Section One of Ordinance No. 03-46, the Artesa Pointe PUD, is hereby amended to read as follows: SECTION ONE: The zoning classification of the herein described real property located in Section 3, Township 51 South, Range 26 East, Collier County Florida, is changed from "RSF-3" and "PUD" to "PUD" Planned Unit Development in accordance with the Artesa Pointe PUD Document, attached hereto as Exhibit "A", which is incorporated by reference herein and by reference made part hereofi The Official Zoning Atlas Maps numbered 1603S and 1603N, as described in Ordinance Number 91-102, am~ the Land DeveloPment Code, is hereby amended accordingly. SECTION THREE: EFFECTIVE DATE This Ordinance shall become effective upon filing with the Department of State.
