EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve the
offsite removal of up to 101,000 cubic yards of surplus fill from Isles of Collier Preserve
(Commercial Excavation Permit Application PL20150001313) to Treviso Bay.
OBJECTIVE: To approve the removal and transport of 101,000 cubic yards of surplus fill from
the Isles of Collier Preserve approximately 0.36 miles along US 41 to Treviso Bay. This
quantity includes the 20,000 cubic yards which are allowed to be removed pursuant to the Sabal
Bay PUD.
CONSIDERATIONS: The Isles of Collier Preserve development ( Sabal Bay PUD) allows for
20,000 cubic yards (cy) of surplus fill to be removed from the site, unless the project is issued a
commercial excavation permit.. The Sabal Bay PUD, Ord. 05 -59 was approved on November
15, 2005. It covers 2,416 +/- acres. The latest PUD Amendment was Ordinance 12 -12 approved
on March 13, 2012.
The Code of Laws Chapter 22, Article IV, Section 22 -110 (b) (2) requires petitioners to file for a
Commercial Excavation Permit for removal of surplus fill associated with a previously approved
Development Excavation Permit. Commercial excavation permits require approval by the
Board. Development Permit No 60.080.3 PL20140001035 was previously approved
administratively on July 15, 2014. Development Permit No 60.080.3 PL20140001035 allows for
excavation up to a maximum depth of 20 ft. The excavation associated with this petition was
reduced to 12 feet to limit the amount of excess fill generated while preserving the functional
water quality standards of the water management system.
The petitioner estimates the total lake excavation onsite of Isles of Collier Preserve is
approximately 4,600,000 cy. The petitioner estimates that they need permission to remove up to
101,000 cy of excavated material offsite. For reference, a ten -wheel dump holds the equivalent
of roughly 14 cy of compacted fill, so 101,000 cy represents about 7,215 truckloads. At roughly
12 trucks per hour (one every five minutes) working ten -hour days, it would take approximately
66 days to haul 101,000 cy of fill offsite. They excavated less than what was allowed under the
permit, yet still ended up with surplus fill.
The material under consideration equates to 2.2% of the total lake excavation for Isles of Collier
Preserve. The proposed removal of 101,000 cy is minor compared to the total lake excavation
quantity of 4,600,000 cy. The proposed haul route is attached for reference and is also
considered minor - approximately 0.36 miles each way on US 41.
The current and proposed excavation are in substantial conformance with the approved Sabal
Bay PUD Master Plan. The attached construction plans are provided for reference.
FISCAL IMPACT: The petitioner has paid $5,560.00 to amend the existing Development
Excavation permit to a Commercial Excavation permit. The petitioner has also paid the road

impact fee of $8.00 per 1,000 cubic yards for the proposed removal of 101,000 cubic yards of
material ($808.00).
GROWTH MANAGEMENT PLAN (GMP) IMPACT: There are no growth management
impacts associated with this Executive Summary. The proposed haul route will be from Isles of
Collier Preserve approximately 0.36 miles on Tamiami Trail East (US 41) to the Treviso Bay
development.
ENVIRONMENTAL ISSUES: Offsite hauling of excess fill, if done properly, will have no
Environmental impact.
LEGAL CONSIDERATIONS: Pursuant to Ch. 22, Art. IV, Section 22- 110(d), approval by the
Engineering Services Director, or his designee, and the Board, shall be granted only upon
competent and substantial evidence submitted by applicant that the applicant has complied with
the following:
(1) The excavation will not interfere with the natural function of any sanitary, storm or drainage
system, or natural flow way, whether public or private, so as to create flooding or public health
hazards or jeopardize the functions of the natural resources and environment of Collier County.
(2) Dust or noise generated by the excavation will not cause a violation of any applicable
provisions of this article. Rock crushing operations or material stockpiles that will be adjacent to
any existing residential area may require separate county approval.
(3) The excavation will not adversely affect groundwater levels, water quality, hydro period or
surface water flow ways. The county manager or designee may require the applicant to monitor
the quality of the water in the excavation and adjacent ground and surface waters. Under no
circumstances shall the excavation be conducted in such a manner as to violate Collier County or
applicable State of Florida water quality standards.
(4) The excavation will be constructed so as not to cause an apparent safety hazard to persons or
property.
(5) The excavation does not conflict with the growth management plan or land development
regulations adopted pursuant thereto, nor does it conflict with existing zoning regulations.
Special criteria and approval procedures may be necessary for projects within the Big Cypress
Area of critical state concern.
(6) In cases where a wetland is no longer capable of performing environmental functions or
providing environmental values or in cases where it is determined that no reasonable alternative
exists other than disrupting a wetland, certain alterations may be allowed, except as otherwise
authorized through previous county review processes.
(7) Flow of water within and through preserved wetlands shall not be impeded.

n (8) Appropriate sediment control devices (hay bales, silt screens, etc.) shall be employed to
prevent sedimentation within the wetland pursuant to the design requirements of Section
10.02.02 of the Land Development Code. Any building site adjacent to a wetland and elevated
by filling, must employ the same erosion control devices. Fill must be stabilized using sod, seed,
or mulch.
This item has been approved as to form and legality, and requires a majority vote for Board
approval -- SAS
RECOMMENDATIONS: That the Board of County Commissioners (BCC) approves the
offsite removal of up to 101,000 cubic yards of fill from the Isles of Collier Preserve to Treviso
Bay pursuant to Commercial Excavation permit PL20150001313.

Dear Mr. Coleman:
THIS IS YOUR PERMIT AND MUST BE POSTED ON SITE
In accordance with the authority given in County Ordinance No. 04 -55, Section 2.E., Article IV, Sections
22- 106 -22 -119, as amended, your application for a Development Excavation is hereby approved subject
to the following stipulations:
1. The excavation shall be limited to a bottom elevation of -17.3 ft. NAVD. All disturbed areas
proposed for lake excavation shall be excavated to a minimum elevation of -6.3 ft. NAVD.
2. No excavated material shall be removed from the project site.
3. The lake littoral zone shall be created and planted as indicated on the Plan of Record and in
accordance with County Ordinance 91 -102 Section 3.05 -10 as amended.
4. All provisions of Collier County Ordinance No. 04 -55, Section 2.E. shall be adhered to.
5. Where groundwater is proposed to be pumped during the excavating operation, A Dewatering
Permit shall be obtained from the South Florida Water Management District, and a copy provided to
Engineering Review Services for approval prior to the commencement of any dewatering activity on
the site.
6. No blasting will be permitted unless issued a separate permit by Collier County Engineering
Services Department.
7. If trees are to be removed as a result of the excavating operation, a Vegetation Removal Permit,
required by Land Development Code, Division 3.05 as amended shall be obtained from Collier
County Environmental Services Department before work shall commence.
8. A 20 ft. maintenance easement shall be provided around the perimeter of the lake and a 20 ft.
access easement to it shall be provided from a right -of -way. The easement shall be accessible to
all maintenance vehicles.
9. Stockpile side slope shall be at a maximum of 4:1 unless fencing is installed around the entire
perimeter of the stockpile area

/0-N 10. Any stockpile in place for a period exceeding 60 days shall be seeded and mulched and erosion
control devices installed.
Since we are in receipt of the excavation performance guarantee in the amount of $222,180.80 and the
permit/ review fee in the amount of $3,180.46, this letter is your authorization to proceed with the
excavation project in accordance with your plans and the above - mentioned stipulations.
This permit is valid for (1) year and must be renewed on the anniversary date of permit issuance.
The Plan of Record for this excavation is titled "The Isles of Collier Preserve Phase 3" Sheets 1.0 - 4.0,
8.1, 11.0 - 11.3, 14.0, 15.0 prepared by Barraco and Associates, Inc., signed and sealed by Timothy B.
Gavin, P.E. dated June 30, 2014.
