Agenda 02/13/2018 Item #16A1002/13/2018 EXECUTIVE SUMMARY Recommendation to hear Land Development Code Amendments at two regularly scheduled daytime hearings and waive the nighttime hearing requirement. OBJECTIVE: To present to the Board of County Commissioners (Board) Land Development Code (LDC) amendments that change the actual list of permitted and conditional uses within several zoning districts and several Zoning Atlas maps at two hearings during regularly scheduled daytime hearings on Tuesday, April 10, 2018, and Tuesday, April 24, 2018. This waiver requires the Board to waive the nighttime hearing by a supermajority vote. CONSIDERATIONS: The current LDC amendment cycle includes proposed changes that amend the zoning atlas and the actual list of permitted, conditional, or prohibited uses of land within several zoning categories. These amendments require public hearings and notice pursuant to LDC section 10.03.06 K. This LDC section states that two Board meetings are required, and at least one hearing shall be held after 5:00 p.m. on a weekday, unless by super majority vote the Board elects to conduct the hearing at another time of day. The amendments that require a night hearing propose the following changes to the LDC: 1) To establish martial arts, gymnastics, and dance as permitted uses in C-3 and Industrial Zoning Districts. 2) To modify the list of exotic species in Big Cypress Area of Critical State Concern (ACSC) and several Zoning Atlas maps within Township 52, South, Range 30 East to address changes to the State’s ACSC designation. The Development Services Advisory Committee (DSAC) reviewed the amendments on December 6, 2017. The Collier County Planning Commission (CCPC) reviewed the amendments on January 18, 2018, and February 7, 2018. Both Committees have recommended approval of these amendments to the Board, and to date, no objections to these amendments have been raised by the public. However, if any amendments require additional public input after the first hearing, the Board may choose to reschedule the second hearing to hold a meeting after 5:00 p.m. FISCAL IMPACT: There are no fiscal impacts associated with this action. LEGAL CONSIDERATIONS: This item is approved for form and legality, and it requires a supermajority vote for approval. (HFAC) GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. RECOMMENDATION: To hold two regularly scheduled daytime hearings to consider LDC amendments. This option waives the night meeting requirement as provided for in LDC section 10.03.06 K.
