EXECUTIVE SUMMARY
Recommendation to reject the only proposal received for Request for Proposal No.14-6294 All
Terrain Vehicle (ATV) site identification, which the proposing vendor has withdrawn, and re-
establish the ATV Ad Hoc committee through December 12,2015.
OBJECTIVE: To reject Request for Proposal (RFP) No. 14-6294 All Terrain Vehicle (ATV) site
identification and to continue to pursue short and long term options for a suitable ATV riding location for
Collier County residents.
CONSIDERATIONS: In 2011, Collier County and the South Florida Water Management District
entered into a Settlement Agreement wherein the District paid Collier County $3 million to dispose of
litigation arising out of a 2003 Agreement between the parties in which the District was to convey 640
acres to Collier County for recreational ATV use. Since that settlement, the Collier County Growth
Management Department and the Collier County Parks and Recreation Division have been tasked with
searching for land appropriate and suitable for an ATV Park site. Public information meetings were held
in fall of 2011 and spring of 2012 to solicit input from ATV users/stakeholders.
An ATV Park Site Ad Hoc Committee was formed with the Board's approval on June 12, 2012. The
seven-member committee plus two alternate members has assisted staff in exploring and identifying
potential ATV park sites, with the goal of providing citizen recommendations to the Board. After an
exhaustive search,no land suitable for an ATV Park in Collier County was found at that time.
In 2014, the Board directed staff to issue a Request for Proposal (RFP)to vendors and landowners in and
proximate to Collier County who might be interested in developing a suitable property into an ATV
riding facility. The RFP was publicly advertised on June 11, 2014. Email notices were sent to 1,146
vendors, 14 RFP packages were downloaded, and one firm responded by the due date of July 11, 2014. A
Selection Committee meeting was held on August 7, 2014 and after review, scoring and discussion of the
proposal, by consensus of the members, Florida Tracks and Trails(FT&T)was given a passing score.
The FT&T proposal called for the County to pay them all of the money in the ATV Settlement Fund prior
to the opening of the park in exchange for a promise that Collier County residents would receive a 50%
discount on their admissions to the ATV riding area and that Collier residents would be allowed to ride
one Friday per month for free.
Negotiations with Florida Tracks & Tracks have been slow and unfruitful. Staff informed FT&T early on
that the County was not prepared to pay all of the proceeds in advance of the citizens receiving any
benefit. Subsequent conversations have failed to produce mutual agreement.
Given this, staff and the ATV Ad Hoc Committee recommend that the Board reject the single proposal for
RFP No.14-6294. In addition, by email correspondence from FT&T's attorney dated May 21, 2015,
FT&T withdrew its proposal from further consideration.
The ad hoc committee is scheduled to sunset on June 12, 2015. The committee is requesting that it be re-
established for six more months until December 12, 2015, during which time the search for ATV park
options would include, but not limited to the following.
1) Look for smaller parcels than contemplated in the RFP that could be purchased or leased and
developed within or proximate to Collier County; and

2) Determine whether there is interest among existing ATV parks located outside of Collier County in
developing Collier resident discount pricing agreements.
FISCAL IMPACT: There is no fiscal impact associated with the rejection of RFP No. 14-6294.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATION: This item is approved as to form and legality, and requires majority vote
for Board approval.—SRT
RECOMMENDATION: That the Board of County Commissioners rejects the proposal received from
Florida Tracks & Trails in response to RFP No. 14-6294 for All Terrain Vehicle (ATV) site
identification, which the proposing vendor has withdrawn, and re-establishing the existing ATV Ad Hoc
committee to through December 12, 2015.

RESOLUTION NO. 2015-
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, RE-ESTABLISHING THE COLLIER
COUNTY ATV PARK AD HOC COMMITTEE, AND RE-APPOINTING
THE CURRENT MEMBERS TO SAID COMMITTEE FOR AN
ADDITIONAL SIX MONTHS.
WHEREAS, in 2011, Collier County and the South Florida Water Management District
entered into a Settlement Agreement wherein the District paid Collier County $3 million to
dispose of litigation arising out of a 2003 Agreement between the parties in which the District
was to convey 640 acres to Collier County for recreational ATV use; and
WHEREAS, it has been the desire of the Board of County Commissioners to utilize
these funds to locate and establish an ATV Park; and
WHEREAS, the Collier County Parks and Recreation Division has worked with the
previous committee to solicit input from stakeholders and ATV riders in this search for land
suitable for an ATV Park site; and
WHEREAS, Collier County Ordinance No. 2001-55, as amended, provides that the
Board of County Commissioners may, by resolution, appoint an ad hoc or task force committee
for a specific project, if the duration of the committee does not exceed three years duration; and
WHEREAS, the Board of County Commissioners desires to re-establish an ATV Park
Ad Hoc Committee to assist the Board in identifying lands appropriate and suitable for an ATV
Park.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: Creation and Purpose of the ATV Park Ad Hoc Committee.
Pursuant to the provisions of Collier County Ordinance No. 2001-55, as amended, the
Board of County Commissioners hereby establishes the Collier County ATV Park Ad Hoc
Committee (Committee) to assist the Board in researching and identifying lands based on
acreage and amenities that are appropriate and suitable for an ATV park.

SECTION TWO: Appointment of Members, Terms of Office, Failure to Attend
Meetings.
There shall be seven members to this Committee, who shall serve a one year term.
Additional and replacement members shall, to the extent possible, be comprised of community
members who are ATV riders and who have demonstrated a substantial interest in working with
Collier County staff to determine a potential site for the ATV Park.
If any member of the Committee is absent from two or more consecutive meetings
without satisfactory excuse, such member's position may be declared vacant by the Board as
prescribed by Collier County Ordinance No. 2001-55,as amended,or its successor ordinance.
SECTION THREE: Officers,Quorum, and Composition.
At the Committee's first meeting, the membership shall elect a Chair and Vice-Chair.
The presence of a majority of the memberships shall constitute a quorum. The Committee shall
follow Robert's Rules of Order for the transaction of business and shall keep records of the
meetings, findings and determinations. The members of the Committee shall serve without
compensation, but may be reimbursed for travel, mileage, and/or per diem expenses if approved
in advance by the Board.
SECTION FOUR: Functions,Powers,and Duties of the Committee.
The functions, powers, and duties of this Committee shall be to aid and assist the Board
in researching and identifying lands appropriate and suitable,based on acreage and amenities,for
an ATV park. Additionally, the Committee may evaluate options for the use of private land for
the establishment of an ATV Park. These options include but are not limited to:
A. Purchase or lease of private land;
B. Easements for the establishment of ATV trails over private land to connect with
lands of other property owners;
C. Private/public partnerships where private property owners develop and operate an
ATV Park on their land with possible assistance and/or funding by the County;
and

D. Volunteer assistance and funding from the ATV community.
SECTION FIVE: Dissolution of Committee.
Unless extended by Resolution of the Board, this Committee shall automatically sunset
without further action one year from the date of this Resolution.

same, this day of , 2015.
