EXECUTIVE SUMMARY
Recommendation to approve Amendment No. 3 to the subrecipient agreement with the City of
Naples to provide additional Disaster Recovery Enhancement funds for the George Washington
Carver Apartments area stormwater improvement project.
OBJECTIVE: To mitigate the impact of natural disasters in low-income neighborhoods through the use
of grant funds.
CONSIDERATIONS: Disaster Recovery Enhancement Funds (DREF) are Community Development
Block Grant(CDBG)funds provided through the Department of Economic Opportunity(DEO)to address
specific hurricane repairs or hardening projects within the community. The Board approved DREF
agreement#12DB-P5-09-21-01-K39 between Collier County and the DEO on July 26, 2011.
On April 28, 2015 the Board approved modification #5 to the aforementioned Collier/DEO DREF grant
agreement. The modification added funds to the City of Naples' George Washington Carver Apartments
areas storm water improvement project. The amount of funds now available for the subrecipient for this
project is $189,389.56, an increase of$133,389.56. The City of Naples has requested this amount and
amendment No. 3 to its subrecipient agreement to accommodate the budget change.
The proposed amendment is allowable under the grant and will not impact the amount of grant funds in
the governing Collier/DEO DREF agreement.
FISCAL IMPACT: The proposed action has no new fiscal impact. The funding source for the grant is
DEO. Funds are budgeted within Housing Grants (705),Project 33191.
LEGAL CONSIDERATIONS: On April 28, 2015, Agenda Item 16 D.13, the Board approved a
modification to the DREF agreement with DEO, which increased funding to the City of Naples storm
water improvement project. The modification was submitted to the DEO for approval and is pending
signature. Once the DEO approves the modification, Amendment No. 3 to the subrecipient agreement
may be routed to the Chairman for signature. This item is approved as to form and legality and requires a
majority vote for Board action-JAB
GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this amendment will
further the Goals, Objectives, and Policies within the Housing Element of the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners approves Amendment No.3 to the
subrecipient agreement with the City of Naples providing additional funds for the George Washington
Carver Apartments area stormwater improvement project.

THIRD AMENDMENT TO AGREEMENT BETWEEN COLLIER COUNTY

Stormwater Improvements/George Washington Carver Apartments (GWCA) Area
This Amendment is entered into this day of , 2015, by and between
the "City of Naples" a municipality existing under the laws of the State of Florida herein after
referred to as "SUBRECIPIENT" and Collier County, a political subdivision of the State of
Florida,hereinafter to be referred to as "COUNTY," collectively stated as the"Parties."
WHEREAS, on October 22, 2013, the Board of County Commissioners approved
Modification Number 2 to Subgrant Agreement Contract Number 12DB-P5-09-21-01-K39
between Collier County and the Florida Department of Economic Opportunity (DEO) and the
execution of an associated subrecipient agreement providing Community CDBG/DREF funds
for the George Washington Carver Apartments Area Stormwater project in the City of Naples,
Florida;
WHEREAS, on February 25, 2014 the Board approved an amendment to the
subrecipient agreement to reference Chapter 2013-154, Laws of Florida requirements and extend
the project completion date to the same date as the ending date of Subgrant Agreement Contract
Number 12DB-P5-09-21-01-K39, October 22, 2014;
WHEREAS, September 23, 2014 the Board approved the second amendment to the
subrecipient agreement such that all services required hereunder shall be completed by the
SUBRECIPIENT prior to the end date of the associated Collier/DEO grant agreement #12DB-
P5-09-21-01-K39 as extended by modification.
WHEREAS, the Parties desire to further amend the agreement to increase the amount of
funds from $56,000 to $189,389.56;
NOW, THEREFORE, in consideration of the mutual benefits contained herein, it is
agreed by the Parties as follows:

All references contained throughout the agreement to Housing, Human and Veteran Services
(HHVS)hereinafter shall read Community and Human Services(CHS).

III. AGREEMENT AMOUNT
The COUNTY agrees to make available • - . ! : :. ;,! ! ! One
Hundred Eighty Nine Thousand Three Hundred Eighty Nine Dollars and 56/100
($189,389.56)for the use by the SUBRECIPIENT during the Term of the Agreement
(hereinafter, the aforestated amount including, without limitation, any additional amounts
included thereto as a result of a subsequent amendment(s) to the Agreement, shall be referred to
as the"Funds").
All improvements specified in Section I. Scope of Services shall be performed by
SUBRECIPIENT employees, or shall be put out to competitive bidding under a procedure
acceptable to the COUNTY and Federal requirements. The SUBRECIPIENT shall enter into
contract for improvements with the lowest, responsive and qualified bidder. Contract
administration shall be handled by the SUBRECIPIENT and monitored by HHVS, which shall
have access to all records and documents related to the project. The budget identified for all
improvements is as follows:

Dear Ms. Grant:
By this letter, the City requests a funding increase for Disaster Recovery Enhancement Funds
(DREF) Grant#12DB-P5-09-21-01-K39 from Collier County Community and Human Services.
We are requesting the additional funding due to recent return of a bid solicitation and revised cost
estimates indicating substantial funding short fall under the existing allocation.
A recent bid and cost estimates indicated there are significant product warranty issues in partial
repair of the drainage system. A greater system repair is indicated, with the subsequent outcome
being a greater project cost that original estimated. City staff is now estimating a project cost of
between $180,000 and $204,000.As such, we are requesting a new total allocation of
$189,389.56 in Disaster Recovery Enhancement Funds (DREF). If sealed bid solicitations come
in higher than this amount, additional funds from non-grant sources will be sought to supplement
this allocation.
We appreciate your additional accommodation in this matter and hope you concur that putting
this community investment and asset in-place is in the best interest of all involved.
