EXECUTIVE SUMMARY
Recommendation to approve substantial amendments to the U.S. Department of Housing and
Urban Development Community Development Block Grant from FY2005-2006 through FY2014-
2015 Annual Action Plans; amend a subrecipient agreement with Habitat for Humanity - Legacy
Lakes; approve a subrecipient agreement with Naples Equestrian Challenge and increase or
allocate project delivery for the following: Habitat for Humanity - Legacy Lakes, Boys & Girls
Club of Collier County, Naples Equestrian Challenge and Direct Homeownership Assistance.
OBJECTIVE: To expend the County’s entitlement allocation for community amenity projects.
CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD)
Community Development Block Grant (CDBG) program funds locally defined needs for
programming and infrastructure. The Board approved the County’s CDBG FY2005-2006 through
FY2014-2015 HUD Annual Action Plans. The Board of County Commissioners approved the FY2005-
2006 HUD Annual Action Plan at the April 12, 2005 Board of County Commissioners meeting, the
FY2006-2007 HUD Annual Action Plan at the April 25, 2006 Board of County Commissioners meeting,
the FY2007-2008 HUD Annual Action Plan at the April 24, 2007 Board of County Commissioners
meeting, the FY2008-2009 HUD Annual Action Plan at the April 22, 2008 Board of County
Commissioners meeting; the FY2009-2010 HUD Action Plan at the April 28, 2009 Board of County
Commissioners meeting, the FY2010-2011 HUD Annual Action Plan at the April 27, 2010 Board of
County Commissioners meeting, the FY2011-2012 HUD Annual Action Plan at the November 8, 2011
Board of County Commissioner meeting, the FY2012-2013 HUD Annual Action Plan at the July 24,
2012 Board of County Commissioners meeting, the FY2013-2014 HUD Annual Action Plan at the
August 13, 2013 Absentia Meeting and ratified it at the September 10, 2013 Board of County
Commissioners meeting and the FY2014-2015 HUD Annual Action Plan at the June 24, 2014 Board of
County Commissioners meeting.
Community and Human Services (CHS) staff has identified available funds from current and previous
years. The unspent funds were a result of numerous factors, such as projects completed under budget,
projects not started, and unused administration funds.
The reallocation of unspent funds requires a substantial amendment for each of the Annual Action
Plans. HUD regulations and the Five-Year HUD Consolidated Plan require citizen participation
whenever a substantial plan amendment is proposed. The required notice was published in the Naples
Daily News on March 13, 2015. The advertisement identified a thirty-day public comment period
from March 13, 2015 to April 13, 2015. As of the agenda publication, no comments regarding the
substantial amendment were received.
The following substantial amendment changes are proposed to the FY2005-2006, FY2006-2007, FY
2007-2008, FY2008-2009, FY2009-2010, FY2010-2011, FY2011-2012, FY2012-2013, FY2013-2014
and FY2014-2015 HUD Annual Action Plans and listed below by project and funding year:
Add a New Project: Naples Equestrian Challenge Phase III – Site Development and Landscaping
– CDBG – Project Scope to read: “Fund all required permits and site development improvements,
consisting of, but not limited to: earthwork, site preparation, drainage, sewer collection and
transmission system, water distribution system, installation of perimeter fencing and wall,
roadway improvements and landscaping and irrigation systems”; Funding amount: $500,000
($129,988.23 from FY2005-2006, $134,864.20 from FY2006-2007, $60,851.28 from FY2007-

2008, $77,863.88 from FY2008-2009, $10,678.78 from FY2009-2010, $11,827.38 from FY2010-

The following substantial amendment changes are proposed to the FY2013-2014 HUD Annual Action
Plan:
Amend project: Habitat for Humanity – Legacy Lakes Road Improvements – CDBG; Increase
funding amount by $215,000 ($65,000 from FY2013-2014 and $150,000 from FY2014-2015) to
$715,000.
Amend project: Habitat for Humanity – Legacy Lakes Road Improvements – CDBG: increase
Project Delivery amount by $2,500 to $7,500
Amend project: Boys & Girls Club of Collier County – Design and Permitting for Immokalee
Youth Center – CDBG – Increase Project Delivery amount by $1,500 to $3,000 ($1,500 from
FY2005-2006)
The following substantial amendment changes are proposed to the FY2014-2015 HUD Annual Action
Plan:
Delete project: Grace Place for Children and Families – Campus Expansion – CDBG: $300,000.
Move $150,000 to Habitat for Humanity – Legacy Lakes Road Improvements, and $150,000 to
Direct Homeownership Assistance)
Delete project: Grace Place for Children and Families – Project Delivery – CDBG: $4,500 and
move to Direct Homeownership Assistance, Project Delivery – CDBG: $4,500
Amend project: Habitat for Humanity – Legacy Lakes Road Improvements – CDBG; Increase
funding amount by $215,000 ($150,000 from FY2014-2015 and $65,000 from FY2013-2014) to
$715,000.
Amend project: Habitat for Humanity – Legacy Lakes Road Improvements – CDBG: increase
project delivery amount by $2,500 ($2,500 from FY2013-2014) to $7,500
Add a New Project: Direct Homeownership Assistance – Project Delivery – CDBG: $4,500
The Board approved the subrecipient agreement termination (Item #16D10) between the County and
Grace Place for Children and Families – Campus Expansion at the March 10, 2015 meeting.
The first subrecipient agreement amendment with Habitat for Humanity – Legacy Lakes is partially
contingent upon approval of the Substantial Amendment to the Action Plan to increase funding by
$215,000 to $715,000. The amendment also includes clarification of the project’s required milestones,
modifies the retainage language and clarifies beneficiary requirements and deadlines.
The Direct Homeownership Assistance project was approved by the Board at the September 23, 2014
meeting through a substantial amendment (Item #16D1).

Staff is also increasing or dedicating project delivery for the following projects:
• Habitat for Humanity – Legacy Lakes – increase by $2,500 to $7,500
• Boys & Girls Club of Collier County – Site Design and Permitting – increase by $1,500 to $3,000
• Direct Homeownership Assistance – Allocating $4,500
• Naples Equestrian Challenge – Site Development and Landscaping – Allocating $5,000
Staff has completed a compatibility analysis for the attached subrecipient agreement between the
Consolidated Plan, the subrecipients grant applications and amendments, various years Action Plans and
amendments, Priority Needs Category and the subrecipient scope of work for the development of the
subrecipient agreements. Board approval of the subrecipient agreements confirms the basis upon which
payment is to be made which may only change thereafter by Board approved substantial amendment
and/or contract amendment if needed. Staff confirms that the projects are consistent with the Consolidated
Plan and the various years HUD Annual Action Plans.
FISCAL IMPACT: The proposed actions described in this executive summary have no new fiscal
impact. The funding source for the grant award is the Community Development Block Grant (CDBG)
Program. The combined grant award for the individual projects are listed in the table below:

GROWTH MANAGEMENT IMPACT: Acceptance and implementation of the substantial
amendments, contract amendment and development of a new project subrecipient agreement furthers the
Goals, Objectives, and Policies of the Growth Management Plan.
RECOMMENDATION: That the Board approve substantial amendments to the HUD CDBG from

This Amendment is entered into this day of 2015. bv and between
HABITAT FOR HUMANITY OF COLLIER COUNTY' INC., a private not-for-profrt
corporation existing under the laws of the State of Florida, hereinafter referred to as
SUBRECIPIENT and Collier County, Florida, hereinafter to be referred to as "CO[JNTY,"
collectively stated as the "Parties."
WHEREAS, on September 23rh 2014, the COUNTY entered into an Agreement with
the Community Development Block Grant Program funds to be used for Legacy Lakes Access
Roadway (Woodcrest Drive) Infrastructure Project Improvements Project (hereinafter
referred to as the "Agreement"); and
WHEREAS, the Parties desire to amend the Agreement to increase Community
Development Block Grant fi.rnding and to clarify beneficiary and milestones requirements.
NOW, THEREFORE, in consideration of foregoing Recitals, and other good and
valuable consideration, the receipt and sufficiency of which is hereby mutually acknowledged,
the Parties agree to amend the Agreement as follows:

PART I
SCOPE OF WORK
The SUBRECIPIENT shall, in a satisfactory and proper manner and consistent with any
standards required as a condition of providing CDBG assistance, as determined by €ellie*
Collier County Community and Human
Services (CHS), to perform the tasks necessary to conduct the progrirm as follows:
H+{VS CHS, as an administrator of the CDBG program, will make available CDBG
funds up to the gross amount of $50OB00 $715.000 to Habitat for Humanity of Collier County,
Inc. to fund construction and project delivery of an access road (Woodcrest Drive) to Legacy
Lakes development in order to construct units ofnew affordable housing in the subdivision.
1.I SPECIAL GRANT CONDITIONS
A. Within thirty (30) calendar days of the execution of this agreement, the
SUBRECIPIENT must deliver to I{I{VS CHS for approval a detailed project
schedule for the completion of the project.
B. The following resolutions and policies must be adopted by the SUBRECIPIENT's
goveming body within thiny (30) days of conveyance:
1. Affirmative Fair Housing Policy
2. Affirmative Action/ Equal Opportunity Policy
3. Fraud Policy
4. Conflict of Interest Policy
5. Equal Opportunity Policy
6. Procurement Policy
7. Residential Anti-displacement and Relocation Policy
8. Sexual Harassment Policy
9. Procedures for meeting the requirements set forth in Section 3 of the Housing
and Urban Development Act of 1968, as amended (12 U.S.C. 794 1u)
10. Procedures for meeting the requirements set forth in Section 504 of the
Rehabilitation Act of 1973, as amended (29 U.5.C.794)
C. Provide household beneficiarv information. to ensure that at least 5lo% of the
beneficiaries of the income surveyed area are low to moderate income beneficaries. to
be completed no later than September 30.2018. The area for the intended pro.iect
benefit must be fi lv surveved bv the SUBRECIPIENT prior to closeout and final
payment. Failure to serve the required percentage of low to moderate income
beneficiaries will require the SUBRECIPIENT to repav the COUNTY the CDBG
investment in full.

B. National Objective
The CDBG program funds awarded to Collier County must benefit low-moderate-and
middle-income persons (IMMI LMI). As such the SUBRECIPIENT shall be
responsible for ensuring that all activities and beneficiaries meet the definition of
Area Benefit Activities (LMA).
C. Project Outcome
The SUBRECIPIENT will engage in performing the construction and project delivery of
an entry road (Woodcrest Drive) to Legacy Lakes development in order to construct new
aifordable housing. The SUBRECIPIENT will obtain beneficiary income data for each of
the new homes built benefited by the project prior to project closeout.
