EXECUTIVE SUMMARY
Recommendation to approve the use of an alternative road impact fee rate, previously
approved by the Board of County Commissioners for Taco Bell, for a new Popeye's
Chicken and Biscuits Restaurant being constructed in Golden Gate.
OBJECTIVE: That the Board of County Commissioners approves the use of an alternative road
impact fee rate, previously approved for Taco Bell, for a new Popeye's Restaurant being
constructed in Golden Gate.
CONSIDERATIONS: On April 12, 2011, the Board of County Commissioners approved an
alternative road impact fee calculation study for Taco Bell conducted in accordance with the
provisions of Section 74-204 of the Collier County Code of Laws and Ordinances; the review by
Tindale-Oliver and Associates, Inc.; and the resulting 14% reduction from the adopted Road
Impact Fee rate. The analysis provided that fast food restaurants that do not offer breakfast and
are not open 24-hours generate less travel than the average fast food restaurant with drive-
through.
Popeye's Chicken and Biscuits Restaurant is comparable in that it does not serve breakfast and is
not open 24-hours. The current adopted Road Impact Fee rate for a Fast Food Restaurant with
Drive-Through is $74,793.30 per 1,000 square feet. A 14% reduction will result in an adjusted
rate of$64,322.24 per 1,000 square feet. Approval of the use of the alternative impact fee rate
calculation to be used for Popeye's is recommended by staff and the impact fee consultant.
A copy of the Taco Bell Alternative Study is on file in the Impact Fee Administration Office.
FISCAL IMPACT: If the Board accepts and approves the use of the alternative impact fee rate,
the resulting rate is 14% lower than the current rate for a Fast Food Restaurant with Drive
Through. This adjustment accurately reflects the proposed facility's proportional share of the
cost of public transportation facilities needed to accommodate the proposed development.
GROWTH MANAGEMENT IMPACT: Impact fees provide financial resources for the
construction and/or expansion of the County's capital infrastructure, as necessary to
accommodate growth. Development is required to contribute its fair share of the costs of
providing public facilities necessitated by growth, however impact fees may not be collected in
excess of the amount reasonably anticipated to fund such improvements. The fees for Popeye's
Restaurant are based on an alternative road impact fee calculation which represents a current,
localized and accurate assessment of the facility's impact and associated cost of providing
transportation-related capital facilities attributable to the new development.

LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is
approved as to form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: That the Board of County Commissioners approves the use of an
alternative road impact fee rate, previously approved for Taco Bell, for a new Popeye's
Restaurant being constructed in Golden Gate. Further, directs the County Manager or designee
to add this category to the impact fee rate schedule at the next available opportunity.
