Official Record Book 972, Page 1466, all of the Public Records of Collier County, Florida, located
in Section 30,Township 48 South,Range 26 East, Collier County,Florida.
OBJECTIVE: To quitclaim and release the County's interest in the 30-foot wide strip of land
described as an easement for public road right-of-way as recorded in Official Record Book 130,
Page 447, Official Record Book Page 130, Page 449, Official Record Book 143, Page 313, and
Official Record Book 972, Page 1466, all of the Public Records of Collier County, Florida,
located in Section 30, Township 48 South, Range 26 East, Collier County, Florida, being more
specifically shown in Exhibit A.
CONSIDERATIONS: Petition VAC-PL20140001484 has been received by the Development
Review Division, Growth Management Department, from Michael Delate, P.E. of Q. Grady
Minor& Associates, as agent for the property owner to request the County quitclaim and release
the 30-foot wide strip of land described as an easement for public right-of-way as recorded in
Official Record Book 130, Page 447, Official Record Book Page 130, Page 449, Official Record
Book 143, Page 313, and Official Record Book 972, Page 1466, all of the Public Records of
Collier County, Florida, located in Section 30, Township 48 South, Range 26 East, Collier
County, Florida.
The 30-foot wide "easement" is referenced in deed language, attached hereto, stating that the
deeded property is "subject to an easement for public road right-of-way". Title insurance
companies will not insure these types of easements as legal access; however, the reservation
creates a cloud on title to the deeded property. This 30-foot wide strip of land currently provides
no public benefit and is not necessary for nearby properties to gain access to a public road. There
is no indication or evidence that any have been used for access. The development of the land will
increase the County's tax base.
The County does not acknowledge having any interest in the subject property(s), but the
Petitioner has requested a quitclaim deed from the County to clear possible clouds on the
property's title. A quitclaim deed conveys whatever title or interest a grantor has in the described
real estate. The instrument operates as a release of the grantor's title or interest in the property. A
quitclaim deed contains no covenants of title or warranty, and it does not purport to convey any
particular type of estate. The form's main use is to clear possible clouds on the property's title.
The Development Review Division reviewed this petition and found no reason for objection.

FISCAL IMPACT: Growth Management Department, Development Review Division staff has
collected a $2,100 "Petition to Vacate" fee from the petitioner which covers the County's cost of
recording and processing the Petition.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact
associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and
requires a majority vote for Board approval. (SAS)
RECOMMENDATION: That the Board of County Commissioners; 1) Approves the attached
quitclaim deed, relating to Petition VAC-PL20140001484, which will quitclaim and release the
County's interest in the 30-foot wide strip of land described as an easement for public right-of-
way as recorded in Official Record Book 130, Page 447, Official Record Book 130, Page 449,
Official Record Book 143, Page 313, and Official Record Book 972, Page 1466, all of the Public
Records of Collier County, Florida, located in Section 30, Township 48 South, Range 26 East,
Collier County, Florida, being more specifically shown in Exhibit A, and 2) Directs the Clerk to
the Board to record a certified copy of the quitclaim deed in the Public Records of Collier
County, Florida.

THIS INDENTURE WITNESSETH, That the Grantor,
IESINtj SORQONDT _ of Hells wood -and State of
Florida for and in consideration of the sum of Ten Dollars and
other good and valuable considerations in hand paid, receipt of
which is acknowledged, grants, conveys, and warrants unto THE
NATIONAL TRUST COMPANY, a national banking association organized
under the laws of the United States of America, Post Office Box
1857, Naples, Florida 33939, and duly authorized to accept and
execute trusts within the State of Florida, as Trustee under the
provisions of a certain Trust Agreement, dated the -15th day of
January , 19 81 , known as Trust Number 5 197 , the
following described real estate in the County of Collier
and State of Florida:
The East half of the Southeast quarter of the Southwest
quarter of the Northwest quarter, Section 30, Township 48
South, Range 26 East, Collier County, Florida; SUBJECT TO
existing restrictions and reservations of record; and

and across the South 30 feet thereof.
SUBJECT TO taxes for the current year.
THIS _S NOT HOMESTEAD PROPERTY.
TO HAVE AND TO HOLD the above described real estate in
fee simple with the appurtenances upon the trust and for the purposes
set forth in this Deed and in the Trust Agreement and Declaration of
Trust.
Full power and authority is granted by this Deed to
Trustee or its successors to protect, conserve, sell, lease, encumber
or otherwise to manage and dispose of the real estate or any part
of it.
•I In no case shall any party dealing with the Trustee in
relation to the real estate or to whom the real estate or any part
of it shall be conveyed, contracted to be sold, leased or mortgaged
by Trustee, he obliged to see to the application of any purchase money,
rent or money borrowed or advanced on the premises, or be obliged to
see that the terms of this trust have been complied with, or be
obliged to inquire into the necessity or expediency of any act of the
Trustee, or be obliged or privileged to inquire into any of the terns
of the Trust or Declaration of Trust; and every dead, trust deed,
mortgage, lease or other instrument executed by Trustee in relation
to the real estate shall be conclusive evidence in favor of every
person relying upon or claiming under any such conveyance, lease or
other instrument (a) that at the time of its delivery the trust created
by this Indenture and by the Trust Agreement and Declaration of Trust
was in full, force and effect, (b) that such conveyance or other
instrusent was executed in accordance with the trusts, conditions and
limitations contained in this Indenture and in the Trust Agreement
and Declaration of Trust and is binding upon all beneficiaries under
such instruments, (a) that Trustee was duly authorised and empowered
to execute and deliver every such deed, trust deed, lease, mortgage

or other instrument and (d) if the conveyance is made to 4 successor
or successors in trust, that such successor or successors in trust
have been appointed properly yand vested fully with all the title, estate,
rights, powers, duties and obligations of the predecessor in trust.
Any contract, obligation or indebtedness incurred or
entered into by the Trustee in connection with the real estate may be
entered into by it in the name of the then beneficiaries under the
Trust Agreement and Declaration of Trust, as their attorney in fact,
by this Deed irrevocably appointed for such purpose, or, at the
election of the Trustee, in its own name as Trustee of an express trust
and not individually and Trustee shall have no obligation whatsoever
with respect to any such contract, obligation or indebtedness except
only so far as the trust property and funds in the actual possession of
Trustee shall be applicable for its payment and discharge, and all
persons and corporations whomsoever and whatsoever shall be charged
with notice of this condition from the date of the filing for record
of this Deed.
The interests of each and every beneficiary under this
Deed and under the Trust Agreement and Declaration of Trust referred
to previously and of all persons claiming under them or any of them
shall be only in the earnings, avails, and proceeds arising from the
sale or other disposition of the real estate, and such interest is
declared to be personal property, and no beneficiary under this Deed
shall have any title or interest, legal or equitable, in or to the
real estate as such but only an interest in the earnings, avails and
proceeds from such real estate as aforesaid.
• And the Grantor by this Deed fully warrants the title to
the above-described real estate and will defend the title against the
lawful claims of all persons whomsoever.
