EXECUTIVE SUMMARY
Recommendation to approve a Resolution for Conditional Final Acceptance of the private roadway
and drainage improvements, and acceptance of the plat dedications, for the final plat of Runaway
Bay Replat PL20120000266, and authorize the reduction of the maintenance security to the amount
of$19,262.25 which represents 150%of the cost of the remaining required improvements.
OBJECTIVE: To have the Board of County Commissioners (Board) approve conditional final
acceptance of the infrastructure improvements associated with the subdivision accept the plat
dedications, and release the maintenance security except the amount of$19,262.25.
CONSIDERATIONS:
1) On May 28, 2013, the Growth Management Department granted preliminary acceptance
of the roadway and drainage improvements in Runaway Bay Replat.
2) Section 10.02.05 D of the Collier County Land Development Code allows for Conditional
Final Acceptance where the required subdivision Improvements except for the final lift of
asphalt, have received a satisfactory final inspection.
3) The roadway and drainage improvements will be maintained by the project's
homeowners association.
4) The required improvements have been constructed in accordance with the
Land Development Code. The Growth Management Department has inspected the
improvements and is recommending final acceptance of the improvements with the
exception of the final lift of asphalt. A performance security in the amount of 150% of
the cost of the final lift of asphalt will be held by the County and the remainder of the
existing security will be released.
5) A resolution for final acceptance has been prepared and approved by the County
Attorney's Office. The resolution is a requirement of Section 10.02.05 C.1 of the Land
Development Code. A copy of the document is attached.
6) The developer will be required to complete all remaining improvements within a 12 month
time period, in accordance with Section 10.02.05. D of the LDC.
7) This Fiddler's Creek PUD which encompasses Runaway Bay Replat has been found to be
in substantial compliance.
FISCAL IMPACT: The roadway and drainage improvements will be maintained by the
project's homeowners association. The existing security in the amount of$103,901.05 will be
reduced to $19,262.25 upon Board approval.

GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and
requires a majority vote for Board approval. - SAS
RECOMMENDATION: To have the Board approve Conditional Final Acceptance of the
roadway and drainage improvements in Runaway Bay Replat Application Number
PL20120000266, and authorizes;
I. The Chairman to execute the attached resolution authorizing conditional final acceptance
of the improvements and plat dedications.
2. The Clerk of Courts to release of the maintenance security, except for 150% of the
estimated cost of the final lift of asphalt.

RESOLUTION NO. 15-
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA AUTHORIZING CONDITIONAL
FINAL ACCEPTANCE OF CERTAIN ROADWAY AND DRAINAGE
IMPROVEMENTS IN RUNAWAY BAY REPLAT, ACCORDING TO
THE PLAT THEREOF RECORDED IN PLAT BOOK 51, PAGES 94
THROUGH 98; RELEASE OF THE MAINTENANCE SECURITY; AND
ACCEPTANCE OF THE PLAT DEDICATIONS
WHEREAS, the Board of County Commissioners of Collier County, Florida, on July 24,
2012, approved the plat of Runaway Bay Replat for recording; and
WHEREAS, the Developer has constructed and maintained the roadway and drainage
improvements in accordance with the approved plans and specifications as required by the Land
Development Code (Collier County Ordinance No. 04-41, as amended); and
WHEREAS, the Developer is requesting conditional final acceptance of the roadway and
drainage improvements pursuant to Section 10.02.05 D of the LDC, and release of his
maintenance security, less 150% of the estimated cost for the final lift,of asphalt; and
WHEREAS, the Growth Management Department has inspected the roadway and
drainage improvements, and is recommending conditional acceptance of said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that conditional final acceptance is
hereby granted for those roadway and drainage improvements in Runaway Bay Replat, pursuant
to the plat thereof recorded in Plat Book 51, pages 94 through 98, and the Clerk is hereby
authorized to release the maintenance security except for 150% of the estimated cost for the final
lift of asphalt.
BE IT FURTHER RESOLVED AND ORDERED that the future maintenance and other
attendant costs for those roadway and drainage improvements are required to be maintained by
GB 31, Ltd., and the Fiddler's Creek Community Development District, and Collier County has
no responsibility for maintenance of these facilities.
This Resolution adopted after motion, second and majority vote favoring same, this
