EXECUTIVE SUMMARY Recommendation to approve Tourist Development Tax Category "B" funding to support the Pro Watercross World Championships September 19-28, 2015, authorize the Chairman to execute the agreement and make a finding that this expenditure promotes tourism. OBJECTIVE: Approve funding for managing and promoting the Pro Watercross World Championships. CONSIDERATIONS: Collier County was recently awarded the 2015-2017 Pro Watercross Tour World Championships. This 5 day event will take place in Naples September 19-28, 2015 at Lake Avalon in Sugden Park. The Pro Watercross Tour has been producing great events in safe environments entertaining audiences throughout the U.S. for over 19 years. Watercross is a unique and thrilling sport and their events are a testament to their passion for the sport and commitment to their host cities. Below is additional information on this event: • The Pro Watercross Tour has become the world's leading personal watercraft (jet skis and wave runners) racing circuit, featuring contestants from all over the world. • Over 400 national and international competitors will travel to our community and bring with them their pit crews, families, friends, and fans. • The economic impact of this event is estimated at approximately $1 million in direct visitor spending in our community, and 1,500 hotel projected hotel room nights as a result of the event. • Personal watercraft racing otherwise known as "watercross" utilizes some of the most advanced equipment and technology. • Throughout the 5 day event, riders will engage in a test of skill, technology and innovation on and off the water—this is the NASCAR of Watercross. • Pro Watercross is the sanctioning body for UIM, which is the international governing body for power boating and is recognized as such by the International Olympic Committee. Pro Watercross is also a member of the General Association of International Sports Federations, and the Association of the IOC Recognized International Sports Federations. • The contestants will demonstrate their skills and compete on a closed race course on Lake Avalon within Sugden Park. • The World Championship will be marketed through announcements and advertisements place in nationally distributed watercraft magazines and the top PWC online magazines. • The Pro Watercross World Championship will also utilize regional advertising through two or more local radio stations running commercials from Monday prior to the event through Sunday of the event, with a live remote on both Saturday and Sunday of the event. Packet Page-901- 3/24/2015 16.F.1. • The Pro Watercross Tour Facebook fan base grew by over 275% in 2014 and will see continued growth in 2015, bringing additional awareness to our destination, and great word of mouth endorsement about the fun they had, where they went, and how they finished well, after our event. • The Naples event will be filmed and broadcast on numerous cable TV channels like the Beach Sports Network, Comcast Sports, Direct TV, Dish Network, Fox Sports, and other sports channels. International Distribution occurs through the Global Broadcasting Network. Typically the one hour program will air at least three times on the various cable channels. • Pro Water Cross will be responsible for managing and producing the race and providing officiating staff for the World Championship, race site permits and insurance. • Our area will also be promoted as follows: o One hour TV show produced and distributed for cable network broadcast. o Two (2) :30 second TV commercials during the one hour TV show o One (1) 0:45 to 1:15 minute destination vignette during the one hour TV show. o Webcast coverage will include two 3-4 hour broadcasts with additional destination commercials o The Naples, Marco Island, Everglades CVB will receive closing TV show mentions (billboards) for each segment o The Naples, Marco Island, Everglades CVB logo will be placed throughout the event area including the front side of the main announcing tower and on a large 3'X8' buoy on the race course with numerous TV camera shots o PA announcements at each 2015 Tour Stop promoting the Championships in the Naples, Marco Island, Everglades area. Pro Watercross offers our destination the opportunity to bring an exciting and entertaining event into their community, generating a tremendous amount of publicity, exposure for our area, and provide a substantial economic impact. The Tourism Department Sports Marketing team has brought this prestigious event to our community and as part of the bid award, our obligation is to fund the following costs to support and promote this event. The cable TV media rights will be secured through our agency of record as part of our FY 15 BCC approved media plan at a cost of up to $65,000 and seen in over 112 million households. FISCAL IMPACT: Funding for this event is included in the BCC approved FY 15 Tourism Department budget and Marketing Plan in Fund 184 for sports marketing and media advertising. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan from this action. ADVISORY BOARD RECOMMENDATION: The Tourist Development Council reviewed this item at their February 23, 2015 meeting and unanimously recommended approval 6-0. Whereas, UWP is in the business of staging professional watercross events and is desirous of conducting and promoting the 2015 Pro Watercross World Championship ("World Championship Event"), with the local event dates of September 19-27,2015;and Whereas,the parties desire to enter into an agreement detailing their responsibilities in relation to the event; and Whereas, the proposed event to be conducted by UWP is in the public interest, the Parties agree as follows: Section 1 — UWP SHALL PROVIDE THE FOLLOWING SERVICES FOR THE PRO WATERCROSS WORLD CHAMPIONSHIP AT NO COST TO THE HOST a. Provide a professionally run watercross racing event from September 19th through and including September 27th, 2015, or until final completion of the event; specifically designed to entertain an audience for a minimum of five(5)to six(6) hours each day. b. Provide all necessary equipment for the race including, but not limited to, computer(s), printer(s), buoys, a public address system, flags, stop watches, tents,tables, chairs, air compressor(s), pit passes, rope, supplies, etc. c. Provide qualified officials to run the event from the pit area to the race course from the commencement date of the on-site set-up through the end date of the racing event. d. Pay the expenses of all personnel specifically engaged by UWP to work in connection with the Pro Watercross Tour. e. Brief, supervise, and instruct all volunteers working in connection with the Pro Watercross World Championship. UWP will design, purchase, and distribute to each volunteer an "official" t-shirt with the event emblem. f. Provide safety patrol boats for officials' use and pre-race promotions. g. Provide all scaffolding and stage equipment. h. Prepare all the necessary insurance and official paperwork. Provide copies of all insurance to the Host in advance of the World Championship Event. Enforce adherence to safety and insurance requirements. k. Provide press releases and photos for local and national media. Design, arrange, print, and distribute the official schedule of events for the Pro Watercross Tour. I. Any sponsors to be added as signage for the event must be provide in a "vector" format or as a jpg image at 300 dpi by March 1,2015. m. Estimated room nights generated from the event would be a minimum of 1500 room nights. Section 2 — HOST SiTE REQUIREMENTS FOR THE EVENT As consideration for the rights and benefits granted herein and provided that UWP is in compliance with the terms of this Agreement,the Host shall provide the following at no additional cost to UWP: a. Host will allow UWP to use its personal watercrafts on the lake of Sugdon Regional Park for the purpose of tuning starting Tuesday,September 8,2015 through September 18,2015. b. Host guarantees the use of the event site, Sugden Regional Park, Naples, Florida,free of charge,starting Saturday, September, 12, 2015 through Tuesday September 29, 2015 or the completion of the Event, if later. c. Host is responsible for overseeing water traffic control through communication with local marinas,boat patrols,and signage in appropriate locations. d. Standby Ambulance with a minimum of two EMTs for each day throughout the event. Starting Monday, September 21, 2015-Sunday,September 27,2015:times to be determined. e. Provide participants/event parking&security. f. Advertising promotion– local advertising through digital and other sources (if available), which must be pre-approved by UWP before a commitment is made. g. Provide UWP with marketing material in order to help promote your community better to competitors and fans. h. Endeavor to provide UWP with ten (10) volunteers each day throughout the event week. Times to be determined. i. Provide UWP with hotel accommodations equaling fifty (50) room nights starting Monday, September 21,2015 -Sunday,September 27, 2015 or provide suitable lodging accommodations for fifteen (15) UWP staff near the race site. The Host will be entitled to all promotional, sponsorship, and merchandising dollars it raises pertaining to the World Championship Event. UWP is entitled to all series promotional, sponsorship, and merchandising dollars it raises. b. UWP agrees to honor all event sponsorship commitments regarding signage, booth space, etc., that the Host site makes pertaining to the watercross race, while the Host site agrees to honor all commitments regarding booth space, signage, etc., made by UWP. The Parties mutually agree to address all such issues at least 30 days prior to the commencement of the World Championship Event. c. The rights to the sale of soft goods merchandise pertaining specifically to Pro Watercross are retained by UWP,and UWP reserves the right to have a series'soft goods area at the event. d. The Host's insurance requirements are included in Exhibit "A," attached. A copy of UWP's insurance coverage shall be provided policy to the Host upon execution of this agreement. The Collier County Board of County Commissioners shall be named as an additional insured on said policy. Upon request, the Host can name up to three additional insureds. Section 4— INDEMNIFICATION a. To the maximum extent permitted by Florida law, UWP shall indemnify and hold harmless Collier County, its officers and employees from any and all liabilities, damages, losses and costs, including, but not limited to, reasonable attorneys' fees and paralegals' fees, to the extent caused by the negligence, recklessness, or intentionally wrongful conduct of the UWP or anyone employed or utilized by UWP in the performance of this Agreement.This indemnification obligation shall not be construed to negate, abridge or reduce any other rights or remedies which otherwise may be available to an indemnified party or person described in this paragraph. This section does not pertain to any incident arising from the sole negligence of Collier County. Section 5 — MAINTENANCE OF RECORDS In accordance with Florida Statutes,section 119.0701, UWP shall: (a) Keep and maintain public records that ordinarily and necessarily would be required by the public agency in order to perform the service. (b) Provide the public with access to public records on the same terms and conditions that the public agency would provide the records and at a cost that does not exceed the cost provided in this chapter or as otherwise provided by law. (c) Ensure that public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law. (d) Meet all requirements for retaining public records and transfer, at no cost, to the public agency all public records in possession of the contractor upon termination of the contract and destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. All records stored electronically must be provided to the public agency in a format that is compatible with the information technology systems of the public agency." The Agreement may be renewed for three (3) additional one (1) year terms upon mutual written agreement of the Parties and by amending the Agreement to provide for updated, future event dates. This Agreement may be amended only by written agreement of the Parties executed with the same formalities as herein expressed. UWP will work closely with your group as well as the local site representatives and sponsors and assist in the marketing of the event weekend. UWP will be working with your group to organize the promotion and publicity of the events. UWP will manage the on-site staging and set-up crews, ensure the professional on- site appearance of the event, and make certain all sponsors are represented. Officiating Team In total, there will be more than fifteen key officials plus numerous staffers involved in the production of the World Championship. These officials are responsible for assuring that each event runs smoothly and fairly, according to the letter of the rulebook, as well as assist with pre-race set-up, registration, promotions, and other related tasks. Goal of the Pro Watercross Tour •:• To generate valuable exposure for the host city in providing a high quality watercross racing event that showcases the host area, its sponsors through a multi-level marketing format. •:• To create a fun, exciting, and unique event experience for spectators and event participants. • To attract spectators, both locally and worldwide to an exciting watercoss event in your city to spend a fun-filled weekend enjoying personal watercraft racing and all that your region has to offer. Economic Impact The Pro Watercross World Championship in 2015 will more the double its typical attendance for the tour. Participants, their families, and support crew spend money on fuel, meals, lodging, miscellaneous expenditures, etc. Each host site will have a different economic impact, geographic location; marketing area and host site enthusiasm all come in to play. As an example, Charleston, WV has over a $1,000,000.00 impact directly associated with the Pro Watercross Tour. Pro Watercross Tour stops are three day events and World Championship will be a minimum of five days and bring in over 400 athletes into you community. Tuesday - Corporate Challenge* and media opportunities, Wednesday through Sunday: Amateur and Pro Watercross racing. *Corporate Challenge pending wind, wave and weather conditions. _._..._..._.. •A Produce and distribute a one hour TV show. "Pro Watercross World Championship" TV show that will highlight the athletes and a 45-75 second vignette on the host city or site i—*;"V aired nationally throughout USA. 4. Host City/CVB logo will be placed on a large 3'x 8' buoy out on the water for the TV show (in - the event of high winds the buoy will not be available), this buoy will give additional on - camera exposure to the Host City/CVB as the pro riders race past the buoy on the front straight away. ❖ Host City/CVB will receive closing billboards for each segment during each television show. 4. Web cast -two 3-4 hour broadcasts, one on Saturday and one on Sunday which will include a minimum of two :30 second commercials each day 4. Host City/CVB logo placement throughout the festival area, which will include four(4) courtside banners at each 2015 Pro Watercross Tour events. 4. Pay the expenses of all personnel specifically engaged by UWP, LLC to work in connection with the Pro Watercross Tour. ❖ Brief, supervise, and instruct all volunteers working in connection with the Pro Watercross Tour. UWP will design, purchase, and distribute to each volunteer an "official" t-shirt with the event emblem. ❖ Provide safety patrol boats for official's use and pre-race promotions. 4. Provide the scaffolding and stage equipment. ❖ Prepare all the necessary insurance* and official paperwork. o• Provide rules and regulations for the Pro Watercross World Championship, �� _ 1� , +�, solicit and acquire all entries for the Pro Watercross World Championship. ;°f`� ❖ Enforce adherence to safety and insurance* requirements. As consideration for the rights and benefits granted herein and provided that UWP, LLC is in compliance with the terms of this Agreement, Agent and or Host and shall provide the following at no cost to UWP, LLC: • Rights fee: Host Site would pay UWP, LLC.the rights fee of$65,000.00 of which $15,000.00 will be paid upon signing of contract and $50,000.00 to be paid to UWP, LLC at the beginning of the event weekend. • Host guarantees the event site,free of charge, starting Monday before the Event through Sunday or the completion of the Event if later. • Host is responsible for overseeing water traffic control through communication with local marinas, boat patrols, and signage in appropriate locations. • Standby Ambulance with a minimum of two EMTs for the day throughout the event. Monday-Sunday:times to be determined. • Provide participants/event parking&security. • Advertising promotion—local advertising in print and other sources (if available), which must be pre-approved by UWP, LLC before commitment is made. • Provide UWP, LLC with marketing material in order to help promote your community better to competitors and fans. • Provide UWP, LLC with 10 volunteers each day throughout the event weekend. • Provide UWP, LLC with hotel accommodations equaling 50 room nights starting Tuesday and departing on Monday OR Provide suitable accommodations for 15 UWP staff near the race site. *Please keep confidential all terms of this Agreement.* EVENT DATES Proposed event dates for the Pro Watercross World Championship date to be selected: Cl September 21-27,2015 SPONSORSHIP/PROMOTIONS The event host will be entitled to all promotional, sponsorship, and merchandising dollars it rises pertaining to the watercross event. The Pro Watercross is entitled to all series promotional, sponsorship, and merchandising dollars it raises. UWP, LLC/ Pro Watercross agrees to honor all event sponsorship commitments regarding signage, booth space, etc., that the host site makes pertaining to the watercross race, while the host site agrees to honor all commitments regarding booth space, signage, etc., made by Pro Watercross. The rights to the sale of soft goods merchandise pertaining specifically to the Pro Watercross are retained by Pro Watercross and Pro Watercross reserves the right to have the series' soft goods area at the event. It is understood that a copy of the insurance policy is available, upon request, and that also, upon request, the host site can name up to three additional insured on said policy. END RESULT Pro Watercross offers host cities/venue the opportunity to bring an exciting and entertaining event in to their community. The Pro Watercross generates a tremendous amount of publicity, exposure for your area, and bring a substantial amount of money to the region. The appeal of pro watercross racing will send out a message to the other lifestyle enthusiasts that something is happening in your area. On race weekend, people from all over the USA will descend on the city, fill hotels, and spend money in the local community. The added publicity will build traffic that will in turn generate more revenue for the city and the entire area.
