EXECUTIVE SUMMARY
Recommendation to reject RFP No. 14-6301 for Design Services for Clam Pass Park Boardwalk
and Restroom Facility and not proceed with the negotiated contract with Q. Grady Minor and
Associates, P.A., reduce the project scope to include repair and or replacement work, and re-
solicit with a new Request for Proposal.
OBJECTIVE: To provide improvements to Clam Pass Park that enhances amenities for the
enjoyment of the public.
CONSIDERATION: On May 30, 2014, staff issued a Request for Proposal (RFP)No. 14-6301
in accordance with Florida Statutes Section 287.055, the "Consultants Competitive Negotiation
Act", to select a firm to prepare a conceptual design for the expansion of the Clam Pass Park
Facilities. The RFP was reviewed and approved by Collier County and various stakeholders,
including the Pelican Bay Foundation. The RFP for design services included: design, permitting,
public meetings, construction documents,bidding, shop drawing review, and final certifications.
A publically noticed Selection Committee meeting was held on August 12, 2014 and after review
and discussion, and by consensus of the members, the responding firms were ranked in order of
the top three proposals. In compliance with Section 287.055, Florida Statutes, the ranking and
ability to negotiate a contract with Q. Grady Minor and Associates, P.A. was approved by the
BCC on September 9, 2014.
The Parks and Recreation Advisory Board (PARAB) recommended to reject RFP No. 14-6301
and to not proceed with the negotiated design contract with further recommendations to
eliminate the additional boardwalk and restroom facilities and obtain additional neighborhood
input before proceeding with the project. On November 24, 2014 the Tourist Development
Council (TDC) also recommended to reject both the RFP No. 14-6301 and to not proceed with
the negotiated design contract. The two advisory boards changed their recommendation after
considerable stakeholder opposition to the additional boardwalk and restroom facility.
Stakeholders requested more documentation on the need for the extension of the boardwalk and
restrooms, assurances that the project would not be detrimental to this sensitive coastal habitat,
and that the project be consistent with the land management plan being developed by the Pelican
Bay Services Division. Given this opposition, Parks and Recreation and Facilities Management
staff met with the Conservancy of Southwest Florida and determined that repairing and
renovating the current structures as a priority.
The consensus among Parks and Recreation and Facilities Management staff and the various
stakeholders is that repairs and upgrades to the facilities are required. Staff is recommending
revisions to the scope of work to include the following project features:
• Parking lot, water quality and drainage improvements.
• Reconstruct the wall between Seagate and Clam Pass Park that is in disrepair.
• Install a Kayak Launch at the southwest corner of the parking lot while addressing all
environmental issues related to environmental concerns.

• Repair and upgrade the electrical service associated with the concession stand operated
by the Naples Grande.
• Upgrade the entrance toll booth with the addition of space for the Turtle Monitoring
equipment.
• Improve the area of the deteriorated boardwalk and markers located on the existing paths,
and remove any derelict materials from the old pathway.
The Parks and Recreation Department will hold a public stakeholder's meeting to discuss the
project scope and obtain consensus. The Department will also bring the scope forward for
approval from the Pelican Bay Foundation, the PARAB, and the TDC before soliciting a new
RFP.
Staff will follow the Purchasing Ordinance and procedures to ensure fair competition is obtained
in the procurement of the services related to the project.
FISCAL IMPACT: The source of funds is from Tourist Development revenues appropriated
for this Project No. 90091 (Clam Pass Park Boardwalk and Restroom Facility) within the Parks
and Recreation Beach Park Facilities Capital Fund 183 (TDC Beach Parking Facilities). The
funds budgeted will remain within the budget for the project and appropriated according to the
approved work.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan
related to this action.
ADVISORY BOARD RECOMMENDATION: The PARAB previously approved this project
on May 16, 2007. The TDC approved this project on May 29, 2007. The project was brought to
the PARAB meeting on November 19, 2014 and the concept and design contract was
unanimously rejected by a vote of 7-0. On November 24, 2014 the TDC also rejected the concept
and design contract and recommended against the project with a vote of 6-0.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and
requires majority vote for approval.—CMG
