EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve an
Easement Use Agreement (Agreement) for Lot 12 according to the plat of Candlewood Two as
recorded at Plat Book 26,Pages 34 through 35 of the public records of Collier County.
OBJECTIVE: To approve an Easement Use Agreement with the current property owner of Lot
12, Candlewood Two and the Candlewood Residence's Association, Inc.
CONSIDERATIONS: The subject pool deck and screen encroach 2.3 feet into a 25-foot
Drainage Easement. The subject easement is dedicated to Collier County with no responsibility
for maintenance and to Candlewood Residence's Association, Inc. with responsibility for
maintenance. The Homeowner's Association has provided a letter of no objection to the
encroachment and stated that there remains sufficient area to maintain the easement. There are
no drainage facilities within the easement. Development Review and the County Attorney's
Office have reviewed the Agreement and Exhibits and recommend approval of the Easement Use
Agreement. The original screen permit was issued correctly in 1996, however, when the owner
submitted the spot survey to the County,the encroachment was missed.
FISCAL IMPACT: There is no fiscal impact. The property owner will be responsible for the
recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and
requires a majority vote for Board approval. SAS
RECOMMENDATIONS:
1. That the Board of County Commissioners approves the Easement Use Agreement with the
current property owner of Lot 12 of Candlewood Two, and authorizes the Chairman to
execute the Agreement.
2. Direct the Clerk to record the Easement Use Agreement.

EASEMENT USE AGREEMENT

THIS EASEMENT USE AGREEMENT ("AGREEMENT") is made and entered into this
clay of , 2015 by and between Alfonso and Diane Fontd.evila (Fontdevila)
and Collier County ("County"), a political subdivision of the state of Florida, hereinafter
collectively referred to as"Parties".
RECITALS,.
A. Alfonse and Diane Fontdevila are the record owners of the fee simple interest in
arid to that certain parcel of real property known as Lot 12, Candlewood. Two as
recorded at Plat Book 26, Page 34 of the Public Records of Collier County,
Florida, (hereinafter the"subject property").
B. Pursuant to that certain plat of Candlewood Two„ recorded at Plat Book 26, Pages
34 - 3:5, of the Public Records of Collier County., Florida, (the "Plat"), the County
is record owner of certain non-exclusive drainage easement rights, a portion of
which encumbers the Subject Property (hereinafter the "Easement Area").
C. The Easement Area is managed and maintained by the Candlewoad Resident's
Association, Inc.,who consent to the encroachment.
D. Alfonse and Diane Fontdevila wish to re-screen their swimming pool deck, which
encroaches 2.3 feet into the 25 foot drainage easement along the northerly
boundary line of Lot 12, and as shown.on lE',xhib:itt `A', (the "Encroachment"). The
County previously approved the enclosure in 1996 (SCCG•-9600013568)..
F;. Th.e drainage easement contains a svvale which conveys a portion of lot storm-
water runoff The Swale will continue to function as designed. There are no other
improvements within.the easement.
F. The parties to this Agreement have reached certain understandings with regard to
the erecroa.chmeant and now desire to set forth. their understanding in 'writing for
recordation
NOW THEREFORE., for and in. considerati:o:n. of the Recitals, the sum of TEN
DOLLAR.S ($10.00) and for other good and valuable consideration the receipt and
sufficiency of which. are hereby expressly acknowledged, the parties hereto agree as
follows:
1. The above recitals are true and correct and are incorporated herein.

C!. Fontdevilas will provide both the County and the Homeowner's
Association Whatever access they require to continue their non-exclusive drainage
easement and maintenance easement rights and further agrees to waive any claim of
damage to the encroaching pool deck arising out of either the County's and.Homeowner's
Association's maintenance activities within. the Easement Area, whether such damage is
intentional or unintentional..
3. The County agrees that until otherwise, notified., Foritdevilas may continue
the use of the pool deck within the Easement Area. The County retains the right,
however, in. its sole discretion, to demand by written request that the Encroachments be
removed from the Easement Area, which:Fontd.evills will do at their sole cost and expense
within a reasonable time from receipt of such request.
4, This Easement Use Agreement shall be recorded in. the Public Records of
Collier County, ]Florida., at Fontdevilas sole cost and expense. This Agreement is
intended to bind the Parties, together with their respective successors, assigns and heirs.
IN WITNESS WHEREOF, the parties hereto have executed this Easement Use
Agreement as of the date first above written.
