EXECUTIVE SUNIlVIARY
Recommendation to waive all applicable purchasing ordinance provisions and provide for the
payment of services in the amouut Af $49,975 to Preferred Materials Inc., for additional
protective barriers requested during a recent road resurfacing project by the Pelican Bay
Services Division.
OBJECTIVE: To pay for services rendered.
CONSIDERATIONS: As part of the annual road resurfacing program, the Road Maintenance
Department contracted with Preferred Materials, Inc., the primary vendor under contract 14-6232 to
perform work within the Pelican Bay Services Division (PBSD) MSTBU limits. During the initial
pre-construction meeting, PBSD staff directed the contractor to install protective materials to the
decorative brick crosswalks within the roadway. Neither quotes nor a change order was initiated by
Staff in advance of the work. The PBSD Board is fully aware of the cost associated with their
direction for protective barriers and assured funding would be provided to reimburse the County for
the cost and is pleased with the coordination and end product of the project.
Staff understands all purchases must be procured through Procurement Services pursuant to
Ordinance No.2013-69 and related procedures,and have provided additional training to avoid future
occurrences.
Pursuant to the Board's Purchasing Ordinance [Sections 9 B4 and 30], staff is requesting that the
Board determine that it was in the best interest of the County to utilize Preferred Materials, Inc., to
install the protective materials, waive any and all purchasing ordinances, approve the work and
resultant invoice in the amount of$49,975 to Preferred Materials,Inc.
FISCAL IMPACT: Funds in the amount of $49,975 are available in the Road Maintenance
resurfacing budget and will be fully offset with an Intergovernmental Charge to the Pelican Bay
Services Division MSTBU.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney. The
County's Purchasing Ordinance provides that "The Board of County Commissioners shall have the
authority to waive any and all Purchasing Ordinance provisions within lawful guidelines and upon
formal Board action." (Ord. No. 2013-69, §30) Accordingly, this item is approved as to form and
legality,and requires majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with
this Executive Summary.
RECOMMENDATION: That the Board of County Commissioners determines that it was in the
best interest of the County to utilize Preferred Materials, Inc. to install the protective materials,
waives any and all purchasing ordinances,and approves the work and resultant invoice in the amount
of$49.975 to Preferred Materials,Inc.
