EXECUTIVE SUMMARY
Recommendation to approve an after-the-fact contract Amendment and Attestation Statement
between the Area Agency on Aging for Southwest Florida, Inc. and Collier County to extend the
grant period through February 28,2015 for the Older Americans Act Programs.
OBJECTIVE: Provide uninterrupted support services to Collier County Services for Seniors' frail,
elderly clients.
CONSIDERATIONS: The Older Americans Act (OAA) Programs are federal program initiatives
that provide assistance to older persons and caregivers and are the only federally funded support service
programs directed solely toward improving the lives of older people. These funds are received by
Collier County through the Area Agency on Aging of Southwest Florida,Inc.
The current Standard Contract for the OAA Programs has an expiration date of December 31, 2014.
Historically, during the month of December, the County's Services for Seniors Program receives an
amendment extending the expiration date for the upcoming grant cycle. The amendment received this
year extends the existing grant agreement through February 28, 2015 or until a new agreement is
executed,whichever comes first. An attestation is also required to be executed with the amendment.
This item is being presented after-the-fact because Collier County received the contract extension on
December 2, 2014 from the grantor agency and is required to return it within 30 days. Pursuant to CMA
5330 and Resolution No. 2010-122, the County Manager authorized Stephen Y. Carnell, Public Services
Administrator, to sign the agreement. Collier County, as the Lead Agency, is responsible to respond to
seniors' needs and to manage the spending authority for the Federal and State funded Services for Seniors
programs.
On November 18, 2014 (Agenda item 16.D.11),the Board approved the necessary budget amendments to
reflect estimated funding for the Calendar Year 2015 Older Americans Act Programs since the grantor
has estimated that funding will be equivalent to the current CY14 funding allocation. When the final
agreement is received it will be presented to the Board, in conjunction with any necessary budget
amendments,to reflect any changes from the estimated allocation.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
item.
FISCAL IMPACT: There is no fiscal impact associated with this item, and therefore no budget
amendment is needed. Funds for the CY14 and CY15 OAA grants have been budgeted in the Human
Services Grant Fund 707 and Human Services Match Fund 708.
LEGAL CONSIDERATIONS: The underlying agreement expressly contemplates an extension by
mutual assent of the parties. This item is approved for form and legality and requires majority vote for
Board approval. -JAB

Commissioners, hereinafter referred to as the "Contractor," collectively stated as the "Pirties"which amends
contract OAA 203.14.
RECITALS:
WHEREAS, on February 13, 2014,the parties entered into the Standard Contractl for the Older American's
Act Program Title III for social services to be provided to Collier County's frail and eld rly seniors(hereinafter
referred to as"Contract"); and

WHEREAS, on June 2, 2014, the parties entered into a First Amendment to the Contract;and
WHEREAS, on August 14, 2014,the parties entered into a Second Amendment t) the Contract; and

WHEREAS, Section 3 of the Contract provides that the agreement is to expire or>l December 31, 2014;

WHEREAS,the funding source for a successor agreement for senior services is riot yet available to the
Agenda from the Florida Department of Elder Affairs;

WHEREAS,the Parties are satisfied with the arrangement that they currently enj y under the Contract so
that both parties wish to extend the Contract to February 28, 2015 while they await noti ication of funding of a
successor contract.

NOW,THEREFORE, in consideration of the foregoing Recitals, and other good and valuable consideration,the
receipt and sufficiency of which is hereby mutually acknowledged,the Parties agree as hollows:

2. Both parties agree to extend the contract to February 28, 2015. j
3. All other provisions of the Contract are to remain in effect and are to be perfumed at the level specified
